  2. Not as statist as O’Connor but still a lot. Too timid on the Second and Fourth. Too much reliance on pre-Revolutionary War common law and English statutes.

  3. He’s remarkably charming — articulate, wicked-smart, but also funny and personable. I love him too.

    My ex is a single-issue voter — pro-choice, hence reflexively Democratic. Somehow she got dragged along with one of her acquaintances to an event at which Scalia was speaking. And to her astonishment, after being obliged by the circumstances to actually pay attention to Justice Scalia, she came away liking him intensely, albeit against her wishes. That made me giggle a lot.

  6. Forty six is a good age, too. Now, I’d rather have a more libertarian choice; Randy Barnett or Janice Brown, but they are a bit older now. It should be interesting, in a day and age where Roe is no longer really up for grabs*, whether the Court will turn away from the megastate.

    * I doubt there are more than 2, and certainly no more than 3, votes on the Court to overturn Roe/Casey. There might be none.

  9. Nobodys perfect. The Justice is a great legal scholar but not up on his history. Contrary to his belief, cannon of all sizes were regulary purchased and used by private citizens before & after the adoption of the Second Amendment. As the purpose of the Second Amendment was to protect against foreign invasion and domestic tyranny, denial of the right to posess any military ordinance would defeat the purpose of the amendment. How would a milita band be expected to stand & fight when their opponent takes the field with 16 pounders loaded with grapeshot?

  13. What’s so great about Clement? He’s a hired gun. He argued Raich – our generation’s Filburn – before the Supreme Court. I think there’s sufficient grounds to suspect that he’s the type to “grow,” i.e., puss out, after a few years on the court, as Justice Roberts did.
