Judge: Hillary!’s Email Practices Did Not Follow Government Policy

Filed under: General — Patterico @ 7:44 am

New York Times:

A federal judge on Thursday said that Hillary Rodham Clinton did not follow government policies when she relied exclusively on a personal email account while she was secretary of state, challenging her longstanding claim that she had complied with the rules.

The judge, Emmet G. Sullivan of United States District Court, also opened the door for the F.B.I. to look through Mrs. Clinton’s server for messages that she may have deleted but that should have been handed over to the State Department.

Mrs. Clinton has said she gave the State Department more than 30,000 documents that she believed were related to her work in office. She then deleted roughly the same number of emails that she said were personal.

Judge Sullivan ordered the State Department to ask the F.B.I. to alert the department if it recovers any documents on Mrs. Clinton’s server that were not already in the State Department’s possession or that may be related to a request by the conservative group Judicial Watch.

At Thursday’s hearing in Washington for a Freedom of Information Act lawsuit filed against the State Department, the judge said of Mrs. Clinton’s email use that “we wouldn’t be here today if the employee had followed government policy,” according to two people who attended the hearing.

Will a member of Big Media put that quote in Hillary!’s face for a reaction?

  1. I am surprised no one is asking POTUS when did he know about the server? who told him about the server? did he ever send Hillary and email to it?

Because to think for 4 years not one email communication between WH and Hitlery …. LOL.

  2. Cuz fact is POTUS broke the law too by ignoring it.

At least 20-30 people in the WH knew about this server YET STILL CONDUCTED BUSINESS AS USUAL.

So …… I think they did it on purpose to frame her not really thinking it will reflect on the WH’s approach to conducting business.

Alot, not a few, people are very very guilty of this security issue. Just so happens it went so high up in the Cabinet that POTUS is by default guilty too and folks near him.

He was told. They were told. He knew. They knew. He/They let it happen. 4 years.

Goes to show you just how serious our POTUS is about National Intelligence. Zero.

  9. I think maybe this was done by Andy McCarthy already, but now (or very soon) there should be irrefutable evidence that Obama is worthy of not only impeachment (the process), but “found guilty” (or whatever they call it).

I wonder how such could best be presented to the American people, and I wonder what is the max% of people who would be swayed by it, even if only 5% of Americans who leaned Dem saw the error of their ways it might be a big help.

  11. It just gets worse and worse for Her Royal Majesty, the Once and Future Inevitable Next President of the United States. The other major developments this week are the announcement that at least 300 classified emails were found on her home server, and, just today, that contrary to Hillary!’s claims that any classified material on her servers was only retroactively designated classified, she had dozens of email messages that were “born classified,” i.e. clearly intended as such from the get-go.

While Obama himself probably didn’t directly send any e-mail to her, other people in the White House did.

What Hillary Clinton did is fool the people in the White House into thinking she had a state.gov e-mail address, although the e-mails they got never came from that address.

Hillary Clinton discused this at her first press conference. The evidence was almost buried there between some gobbledegook.

Secondly, under the Federal Records Act, records are defined as reported information, regardless of its form or characteristics, and in meeting the record keeping obligations, it was my practice to email government officials on their state or other .gov accounts so that the emails were immediately captured and preserved.

Now, there are different rules governing the White House than there are governing the rest of the executive branch, and in order to address the requirements I was under, I did exactly what I have said. I emailed two people, and I not only knew, I expected, that then to be captured in the State Department or any other government agency that I was emailing to at a .gov account.

In other words, she copied over e-mail sent to the White House from hdr22@clintonemail.com to a state.gov address, as she was supposed to do with ALL work email sent from clintonemail.com after about October, 2009, and by doing so, made them believe that that was her state.gov address.

But she only did that with email sent to the White House.

She was deceiving whoever was getting that e-mail at the White House.

There as also, by the way Q&A released in March, which gives you her claims:

I guess Hillary was busy with Clinton Foundation Senate work while this was going on.

  23. Every day Hillary’s lies lies lies become more exposed. Maybe the MFM might start paying attention. Today it was revealed that some of the information. That magically appeared in her servers that was never marked classified and never sent by Clinton need not have been classified because it was born classified and assumed to be classified in all circumstances. And as head of the State Dept and having been trained on these matters, Hillary knew that.

  27. Now that even a liberal pundit is tiring of Hillary’s act, I’m looking forward to Hillary’s “I’m the victim” press conference. I imagine it will go something like this:

Narrowing her eyes and jabbing the air with her index finger, Hillary Clinton declared “I want you to listen to me. I did not break the rules with my emails. I never told anybody to lie, not a single time, never,” as Bill Clinton shook his head and solemnly looked on. “These allegations are false and this needs to stop so I can get to work for the American people.”

  28. Did Huma and Ms Mills conspire to destroy evidence?

I wonder if all those miles Hillary traveled were really just her being an international bag man for the Clinton Foundation. Maybe she pimped out the power of the office for a $100M or so.
I think that is why there is a cover up.

Either David Kendall is feeding Hillary bad lies to tell, or she is going off script… probably both.

Either David Kendall is feeding Hillary bad lies to tell, or she is going off script… probably both.

There aren’t any good lies to tell.

They never expected to be where they are. Nobody was supposed to know about Hillary’s Clinton’s off-the-record e-mail account. And if they did find out, this was not supposed to come out at thw worst possible time: right at the start of a long, Presidential election campaign.

The whole game plan was based on keeping it secret. It worked for along time. She hid the fact that she had e-mails on a homebrew server, and the emails themselves, for one and half years after she was no longer Secretary of State.

If there hadn’t been a Benghazi investigation, and subpoenas of the State Department that turned up some e-mails FROM her, and a persistent, albeit slow, Gowdy committee, they would still be hidden and unknown.

Still, I am not sure if she and Bill really had the end game
    figured out.

Maybe it was that she’d become president and then change some rules or regulations. And she’d pretend either that she never e-mailed or it was too late to retrieve them.

Perhaps they figured it out as far as preserving and not destroying the emails
them, and then supplying whatever she chose, so she wouldn’t be accused of destroying government records.
