Of course, Kerry might have just been counting on getting a free pass from the media. Nothing yet on CNN, Fox, MSNBC or ABC. While it is Sunday, what’s the chance that NOBODY at any of these fine media outfits is surfing the web?

  4. John Kerry is a lawyer and a member of the Bar in Massachusetts. Under Rule 8.4 of the Rules Professional Responsibility

    “It is professional misconduct for a lawyer to:

    (c) engage in conduct involving dishonesty, fraud, deceit or misrepresentation;”

    Note: There is no requirement the misconduct occur in the course and scope of his acting as an attorney. It is a fitness to practice law issue.

    And according to Rule 8.3

    “(a) A lawyer who knows that another lawyer has committed a violation of the Rules of Professional Conduct that raises a substantial question as to that lawyer’s honesty, trustworthiness or fitness as a lawyer in other respects, shall inform the appropriate professional authority.”

    Cheating during a Presidential debate is dishonest, deceitful and fraudulent. A complaint need not be filed by a lawyer.

  5. Cheating in the debate, if it occurs, would be a simple breach of contract.

    Breaches of contract do not involve moral turpitude, and you’d be extremely hard-pressed to get a bar committee to even look into it.

  8. Don’t fall for that “pen” crap. I’ve been hearing reliable reports that it was some kind of digital assistant, probably with all his answers on it. Really!

    It was very clever of Kerry to pull a stunt like this while nobody was looking. Good thing Fox was in charge of all the cameras or we’d never have known the truth.

  9. 2 items: Kerry doesn’t care about bunker busters, nuclear or otherwise; he just wanted W to say ‘nukular’ in the debate (hey, it’s a cheap shot, but that hasn’t stopped them up til now)…
    and the piece of paper said ‘Vietnam’ with a red diagonal line and circle (and I’d like to personally thank him for that) 🙂
