Ted Cruz to Visit Kim Davis in Jail; UPDATE: Released

The 2016 presidential campaign is coming to the jailhouse steps in Kentucky Tuesday, as GOP contender Ted Cruz is travelling there to visit Kim Davis, the clerk who has been jailed for refusing to issue marriage licenses to same-sex couples.

Also travelling to the scene Tuesday is former Arkansas Gov. Mike Huckabee, who is holding a rally to show solidarity for Ms. Davis, the Rowan County clerk who was jailed for contempt by a federal judge after she repeatedly defied his order to issue marriage licenses to gay and straight couples.

Both the Cruz and Huckabee campaigns have been courting religious conservatives, many of whom have been outraged by Ms. Davis’s case. They believe her treatment confirms fears that the Supreme Court’s recent decision upholding gay marriage threatens the religious liberty of people who oppose same-sex marriage because of their faith.

Explaining Mr. Cruz’s plan to visit Ms. Davis in jail Tuesday, his campaign spokeswoman Catherine Frazier said, “It is important to Sen. Cruz that Kim Davis and all Americans understand his commitment to defending their first amendment rights to religious liberty. The First Amendment is foundational to all other freedoms we enjoy and it is tragic that in America today, our own citizens would have to worry about being targeted or arrested for merely living out their religious convictions. Sen. Cruz will continue doing everything in his power to defend Kim Davis and ensure that no other Americans are further targeted for their religious beliefs.”

Meanwhile, Ms. Davis has filed an appeal from the court’s decision. Most of the fire appears to be directed at the Democratic governor.

UPDATE: Davis has been ordered released from jail. But her lawyer says she will continue to order that licenses not be issued to same-sex couples, so she’ll likely be back in custody in short order.

  5. I think few people are arguing she has the right to hold up SSM licenses in her jurisdiction. But the heavy way they’ve come down on her is amazing and attention should be directed to that. Give credit to Huckabee and Cruz for doing that.

  8. As Volokh points out, persuasively, her claim to a religious accommodation from the state is pretty good, and turning the tables against the governor is kind of interesting.

    Perhaps it is the Governor who should be jailed for refusing to allow Davis the accommodation she needs to issue these licenses.

    She wants it to read “The Country Clerk’s Office has determined ….”

    The governor refuses this accommodation. There is a strong RFRA in Kentucky. She’s claiming HE is the sticking point, not her.

    And a lot of the shrapnel from that needs to hit David Bunning squarely in the face, who in light of the way he forced a form of politically-correct speech codes and reeducation training onto a group of high school students and their school a few years ago, deserves to receive plenty of ire and disgust.

    Former Arkansas governor and current Republican presidential candidate Mike Huckabee is expected to attend another rally outside the jail on Tuesday. But several dozen Davis supporters showed up outside Judge David Bunning’s Campbell County home on Monday afternoon, calling him a tyrant for sending Davis to jail.

    Police cars and protesters lined the streets, turning the northern Kentucky neighborhood into quite a sight to see.

    “If you can’t show us a law she’s broken, then free Kim Davis,” said Cal Zastrow, one of the protesters. “Now.”

    Supporters at several rallies and events have carried signs calling Judge Bunning a tyrant ever since Davis was locked up last week after the federal judge held her in contempt of court. Protesters said they wanted to bring that message to the judge’s neighborhood.

    “Judge David Bunning has committed a grievous crime,” reads the flyer handed out to neighbors on Monday, under the heading “PRAY FOR JUDGE DAVID BUNNING to REPENT.”

  18. Who knew? Judge Bunning reads PP and was convinced by nk there was no rationale to keep her in jail.
    But if there is no remedy, like a standing order from the judge that gives deputies power to grant licenses without her signature,
    then we’re back at square one,
    except the judge can say, “I let her out, but she did it again”.

    But if that is the form which Davis wants changed….I don’t see the logic of her objection. There is no language there that suggests that she personally approves of such a marriage…and if it does, then none of the suggested changes in how the document is worded would make less of a suggestion.

  27. hf’s link contradicts the quote in #11. There is no mention of anyone determining anything. There is a statement that the information provided by the applicants is “true to the best of our knowledge” with signatures of the applicants and a deputy clerk. I don’t see how the clerk could determine the truthfulness of the information without examining a lot of public records in other states, so I suspect she is basically witnessing the signatures.

    Instead, it says that these people are entitled to be married under the laws of Kentucky which, strictly speaking, is not true, and has her name and signature on it. She doesn’t want her name on any such certification.

  39. Section 420.020 of the Kentucky marriage laws provide:

    No marriage shall be solemnized without a license therefor. The license shall be issued by the clerk of the county in which the female resides at the time, unless the female is eighteen (18) years of age or over or a widow, and the license is issued on her application in person or by writing signed by her, in which case it may be issued by any county clerk.

    This provision has two interesting consequences. First, it specifically provides that the license must be issued by the clerk of the county, which I imagine is the reason the clerk’s attorneys claim any license that isn’t issued under her name is void.

    Second, if we were in law school, I know the professor would give us a hypothetical about an 17-year-old female plaintiff residing in Rowan County who wants to get married, because under Kentucky law she can’t go to another county to get married. (It probably has something to do with parental notice/knowledge.) I wonder if that passage will survive SSM for minor men or women?

    the real key to the legality of it all is that the deputy clerk has all the marriage licensing powers that that lady has

    Maybe it doesn’t matter. I’d hate to set aside a consensual marriage over something like this, but the statutory provision is clear and the law can be technical at times. This may be one of those times.

  53. Here’s the relevant statute, happyfeet. KRS Section 402.240:

    402.240 County judge/executive to issue license in absence of clerk.

    In the absence of the county clerk, or during a vacancy in the office, the county judge/executive may issue the license and, in so doing, he shall perform the duties and incur all the responsibilities of the clerk. The county judge/executive shall return a memorandum thereof to the clerk, and the memorandum shall be recorded as if the license had been issued by the clerk.

    That gives the county judge authority to issue the license in her absence, so he could do this while she was in jail — although arguably he should have put his name on the form where it says “Name.” But now that she’s no longer absent, his authority ends.

And there’s a power state chancery judges have that federal judges might not. “The law deems done that which ought to be done.” A state judge does not need the governor or whomever to agree to a consent decree or to a different form.     The ad hoc nature of the form and the requirement that her name be on it lend substance to her contention that these licenses are null and void.

    It did strike me earlier today that the licenses are required to be filled out and returned to the clerk by whoever presides over the wedding, and filed into the records by the clerk.

    I think I see a new round in Bunning v. Davis that centers on filing these licenses.

  68. I see from Exhibit B, that KY country clerks can exempt themselves from issuing hunting licenses under current law. This is apparently to avoid forcing “people of conscience” to issue licenses to kill Bambi. Having done that, they seem a bit screwed trying to avoid religious accommodation.

  75. If I were the County Sheriff, I wouldn’t jail the woman. I’d send all Federal officials packing out of my county and I would wait for the Supreme Court to come down and try and enforce their nonsense.

    When Senator Cruz exited the jail a throng of journalists beckoned him toward their microphones, but an aide to Mr. Huckabee blocked the path of Mr. Cruz, who appeared incredulous.

    Like which laws? The federal RFRA? Probably not. The state RFRA? Probably not that one, either. The law that allows clerks to opt out of some duties (e.g. issuing hunting licenses) due to conscience, but apparently not this one because it hadn’t been an issue yet? But heck, let’s just give up on counts and even thinking and just go by what some poll says.

  85. I watched the Kelly File last night and I was disappointed by the relatively low level of understanding they exhibited of Davis’ imprisonment. Our discussions here have exposed a great deal more information, like the idea that Davis would have been required to attest that the “female” resides in the county if under 18. These are small details, but they should have been modified by the State and not dumped on the county clerks. Kelly also seemed unaware of the hunting license exemption that was provided by the State for clerks who had a religious objection to hunting. These make the Judge’s actions even more tyrannical and violent. And if Patterico says being put in jail is not an act of violence, then I must wonder why he was (rightly in my view) upset at being SWATTED. After all, if he just lies on the ground, face down with his arms handcuffed behind him, the worst that can happen to him after the police clear his house is a night in jail. This assumes, of course, that the police don’t toss a flash-bang grenade into his child’s crib while ensuring everyone is safe.

  92. There is a fast setting version of JB that sets in about 5 minutes, but it is not rated as strong as the original, but it is still strong.
    They also make things especially for wood.

    for dad it was always his choice whether and how often to do weddings but he was booked pretty far out cause of people liked how he did it and he liked surprising mom on the way home with stuff he got with the extra pocket monies

    Salmon season is open thru December where I live, but pickings are slim. We’ll be giving it a try over the next few months anyway. Our big day was out of Anacortes and we caught the fish just south of San Juan Island in the lower reaches of Haro Straight. The fish were most likely headed for the Fraser River.
