Britney Spears loses Custody of Children

A superior court judge has ordered Britney Spears to turn over custody of her sons to ex-husband Kevin Federline:

“A judge on Monday ordered Britney Spears to turn over custody of her two children to ex-husband Kevin Federline this week.

Superior Court Judge Scott M. Gordon ruled that Federline will take custody of Sean Preston, 2, and Jayden James, 1, beginning Wednesday “until further order of the court.”

This decision isn’t surprising given the allegations and evidence of Spears’ questionable behavior. However, the decision is notable because you don’t often see mothers lose custody of their children.

  1. She temporarily lost custody of her kids. As to mothers losing custody of her children, recently, David Hasselhoff’s ex-wife, Pamela Bach lost custody of their kids. I’m not sure how that happened when he appears to be the one with the serious alcohol problem.

  2. The headline should be adjusted to “Britney Spears Nanny loses her job” to be more appropriate. I’m pretty sure other than a few key photops, “Mommy” has been all but absent from those children’s lives. And the times she has spent with them in the public eye has either physically or emotionally endangered them.

  8. THANK GOD! federline deserves the kids after allthe CRAP brit has put them through. With all the drugs and alcohol and partyin she does.. she will ebd up hurtin them! Federline is not just wantin more mone either.. he loves those boys and takes better care of them then she does or ever did!   10. I feel sorry for the players in this drama but child custody is an area of the law where gender still seems to matter in some cases/courts. I find that interesting and, frankly, old-fashioned.

  11. In child custody cases, the law states that child safety is paramount. I unhold the court’s ruling because the judge apparently received enough evidence again Britney to warrant him awarding custody of the children to Kevin. I am not particularly fond of Kevin and him not caring for his other two children and to say he is asking for more money from Britney I am not at liberty to know. Reports document otherwise. Given the publicity Britney has received recently I think it is safe to assume that the kids at least for now should be with Kevin who seems to have quit the party scene and hopefully it will wake Britney up and she will realize how important her children are. I would love to have the old Britney we all loved and knew back. I can’t help but wonder what happened to her.

  13. Re: Alfie… New meds as in not taking them? Maybe keeping the bottle taped to the monitor would be an idea worth looking at..

    I think it is remarkable that a wealthy mom lost custody.
    I assume Britney had better representation in court than the average mom, but then again expensive doesn’t always equal better.

    Was the lawyer representing her generally thought of as good at this type of case?
    Or was it more that Britney’s legal team decided it was in their clients best long term interest to fight this battle strategically as part of a larger war?

    Seriously, “Mister Moms” have gotten custody in other, less publicized, cases where there was no more “fault” than the mother concentrating on her career and the father raising the children.

    True, but it’s still unusual in some places/courts and often paternal custody occurs by agreement rather than by Court order.

    Look at the Mary Winkler case. Can you imagine any father even being considered for custody in the same circumstances?

  20. It is sad to see anyone hit rock bottom like this. Her kids will bear some of the weight as they become adults. I truly hope she manages to get it together.
    I live in Louisiana and the paternity laws here are from the french laws, which give the husband a bit more weight in custody cases. One of my daughter’s friends left the state with his mom because the mother worried that the dad would get custody in a La court.
    I’m not a lawyer so the french reference may be only partially true.

  25. I read somewhere that the Victorians had a policy of giving the husband custody in divorce cases, as a deterrent. I.e., the husband doesn’t get out of caring for the kids, and the wife loses custody, a disincentive for both sides.

  27. We’re a long way past the Victorian era. I’m no divorce lawyer but I have done more than a little pro bono work in child support enforcement. The policy these days is that a child needs both a father and a mother. But it’s not really in the courts’ power to force the parents to put the bitterness that led to their divorce aside and look to what’s best for their children. They have to come to that decision themselves.
