It’s inartfully expressed, but Guiliani is correct in the context of interviews given to law enforcement agents and the use of such interviews in setting up prosecutions for or lying to investigators.

The investigators get to choose what they think the “truth” is when there is a conflict between the two statements given.

When Comey meets with Trump alone in the Oval Office, each is going to come out of that meeting with their narrative of what was said. There is no way to test one v. the other except in a contest of “credibility.”

So you are not establishing “truth” through the use of a jury process, you are establishing which person is believed by the jury.

It’s certainly possible that the more “believable” person is actually not telling the truth.

That is the context for his statement, and in that context Guiliani’s characterization is not wrong.

Another example of truth vs truth is the climate change mess.
Science that is settled even though the results keep changing. Climate change truths from 10 years ago have been found not to be true, same will probably go for truths written and spoken about today.

Comey, McCabe, Strzok, Brennan have all claimed to have “misremembered” truths which is another way of them saying that at the time of the interview or testimony they felt they were being truthful.
Or there are the word games Hillary used “wipe the hard drive? like with a cloth?”

Or a truthful answer that can get you into trouble like lets say…. ok… ear with me

Is it not at all interesting to anyone that an Associate Deputy Attorney General Bruce Ohr, a senior career staffer who worked under Dep. AG Sally Yates — there are between 7-10 Associates in that office, as well as less senior staffers — maintained contact for well over a year, deep into the Pres. Trump’s first term in office, with former Brit Intel officer Steele, who the FBI had officially closed out as a source because of his violation of the agreement with the FBI to have no contact with the press.

Does anyone else see significance in the email traffic between Ohr and Steele well into 2017 where Steele worries about whether the “firewalls will hold”, and after Comey is fired he worries that he will be “exposed.”

Is none of this is worrying in the sense that Ohr — after meeting numerous times with Steele — passed on the contents of his discussions with Steele to the same FBI who had found Steele to be untruthful, and to have violated the terms of his source agreement thereby making him “unreliable” in Bureau-speak?

Is none of this worrying that Ohr had repeated and regular contact with Glenn Simpson at Fusion GPS, and that his wife worked for Fusion GPS on the very same project that Steele was hired to work on?

No one here seems to be concerned that Ohr’s jump responsibilities had nothing to do with intelligence, counter-intelligence, or national security matters — he was head of OCDETF, and his portfolio of responsibilities as Associate Dep. AG involved US efforts and policies at combating narcotics trafficking.

Does anyone care that this takes the investigation far beyond the “professionals” at the FBI, and directly into the laps of the political appointees in the Obama DOJ?

What’s noteworthy in this piece is tu quoque argumentation on bad character:

The posture of these NeverTrumpers is transparently self-serving. Once we get past what too many Trump fans seem obliged to do — slatter somebody’s reputation — we get to some reasonably interesting meat. Horowitz regards Trump as loyal. He was loyal to Omorosa. He was loyal to Bannon and Sessions at the beginning of his term, when they were accused of being white nationalist racists. This seems pretty weak tea — Trump was reeady and willing to dispatch Bannon when he took too much credit for the 2016 campaign, and being the resident supergenius. And his feelings for Sessions are evident to anyone who glances at his twitter feed.

But this is what Horowitz defines as the real loyalty:

Has Trump kept his promises to his supporters? Has he stayed the course he set for himself of making America great again? That loyalty is the character trait that matters most in a leader, and should matter most in any assessment of Trump. He has taken great personal risks and incurred great personal costs. His reputation for example, was pretty good before he ran against Democrats and their media, who fueled an epidemic of hate portraying him as a racist and neo-Nazi.

I’m betting there isn’t another Republican who would not have wilted under these attacks. Who would have had the fortitude to stay the course, and keep his promises. That’s really good character. And it’s presidential.

And this is the thing anti-Trump Conservatives have to answer. Trump has done things — some fairly easy — that Conservatives for years said they wanted to do, and never did. Why does Trump have the intestinal fortitude to do them, and the Bushies and like minded Republicans did not?

I believe Trump’s unending sense of personal grievance, racism, perpetual unpreparedness, corruption and indifference to ethics will stain Conservatism for years. The trickiness of the anti-Trumper is making that case, and also making the case that if never-Trump conservatives actually take over, they will actually DO anything. That’s the real challenge.

Trump has done things — some fairly easy — that Conservatives for years said they wanted to do, and never did.

Moving the embassy to Jerusalem is the only thing I can think of, and that requires an asterisk because Dubya said he would “begin the process”, recognizing that the embassy’s location gave us leverage over both sides that would evaporate once the move was completed. And so it has.

I think the embassy should be in Jerusalem, but this affects the lives of Americans not at all; weighed in the balance against Trump’s disastrous Keystone Kops foreign policy, any good moving the embassy has done pales in comparison to the real harm Trump has done in nearly every other region of the globe.

Other than that, Trump has broken every promise he made during the campaign:

1) Appointing pro-life judges who will overturn Roe, nope.
2) Building a wall higher than the Great Wall of China and making Mexico pay for it, nope.
3) Repealing Obamacare and replacing with something that “takes care of everyone” better at a fraction of the cost, nope.
4) Hillary Clinton sent to prison, nope.
5) Eliminating the national debt in 8 years without raising taxes, nope.
6) Ending crime and violence, nope.
7) Death penalty for all cop-killers, nope.
8) Complete and total ban on Muslim immigration, nope.
9) Immediate end to DACA, nope.
10) Summary execution of the wives, mothers and children of suspected terrorists, nope.

It’s inartfully expressed, but Guiliani is correct in the context of interviews given to law enforcement agents and the use of such interviews in setting up prosecutions for or lying to investigators.

I don’t think they usualy prosecute when two witnesses contradict each other. There has to be some other proof. Otherwise you have got the very definitoon of reasonable doubt. On top of that, Mueller is bound by a DOJ policy not to indict asitting president. he could recommend impeachment, but you don’t need a criminal act to do so, and a House ZDemocratic majority would — well what it would do is condict alot of investigations, while looking for soemthing stronger.

The President then returned to the topic of Mike Flynn…The President returned briefly to the problem of leaks. I then got up and left out the door by the grandfather clock

I think it quite possible that Trump said a few words about Mike Flynn, and might have opened up with that even, but didn’t think anything of it, and the main purpose of that meeting was to discuss leaks and that NYT story. Later when asked about it by his lawyers months later, he might nto even remember he did say something about Mike Flynn.

And what Flynn said he didn’t do – drop the case against Flynn – is precisely what he did do, immediately.

This is simply a part of the larger war, and victory is measured by the amount of forward progress towards the goals (of which many Republicans claimed to be on our side but turns out they were just lying like John McCain.)

I’m not sure how we dig ourselves out of this hole. In the age of Trump, and look at the Republican primaries, who can be more Trump than Trump. Even though that will actively make it much more likely for a Democrat to get elected.

Democrats are at least being smart enough in competitive House districts to not actively trying to lose. Sure you get some Ocasio-Cortez’s in 95% blue districts, also a person that has never been elected to anything before, but those 60 districts that look like OH-12 aren’t getting her as an opponent.

A GOP that wins by being “Trump” — as he is now — deserves to lose. I don’t want the alternative, either. But I won’t vote for racism sexism corruption authoritarianism.

Trump isn’t forever. I prefer a small government party with respect for civil and property rights. The pre-Trump, tea party GOP was headed that direction, and ought to be able to go that way again. But it did change course. Trump had something that lured the people who were supporting that away, and, for the most part, are keeping those core folks happy.

Those who liked the old tea party and have gone neverTrump can either be cranky, or work at collecting up their lost voters, while not embracing Trump’s disgraceful aspects. I’m not sure what the right course really is, because the attraction to the base may be the disgrace. However old I am, I have enough years left that I don’t want to spend the rest of my life feeling my country is totally screwed. So my question, and feel for the future, is how does the GOP, or whatever that becomes the voice of the right, succeed in shaking off Trump.
