Victory Over Convicted Bomber and Perjurer Brett Kimberlin in the Fourth Circuit

Last night, in writing about Brett Kimberlin’s latest efforts to get his Wikipedia deleted, I said that his lawsuit against me was still alive — kicking around in the U.S. Court of Appeals for the Fourth Circuit.

I spoke too soon. This morning Ron Coleman and Bruce Godfrey informed me that the Fourth Circuit rejected Kimberlin’s appeal.

Meaning — subject of course to some B.S. motion to reconsider or petition for certiorari — that it’s over.

And for that, I owe (again) a huge debt of thanks to Ron Coleman of Mandelbaum Salsburg, PC and the Likelihood of Confusion blog, and Bruce Godfrey of Jezic & Moyse LLC.

  6. Twitter delenda est. I won’t go on it, not even to congratulate these lawyers on an occasion in which they well merit congratulations.

    I hope, though, Patrick, that you will copy & email the comments from this post to them, for they are absolutely worthy of recognition and congratulations: What they’ve just done is in the highest and best tradition of the legal profession. Your average fan and well-wisher here, reading about this, likely has only the foggiest notion of just how much time and effort and attention is required to vanquish someone like Kimberlin. I have a pretty good idea of what had to be involved, at a minimum. So I am very impressed, professionally and personally, and I applaud and salute them both, and if I ever have a chance to refer a nice piece of well-paying business to either of them in the future, I’ll do so without hestitation.

    And now the next victim will have an easier time of it. A Fourth Circuit affirmance like this — one page, on which the panel duly bothered to establish that yes, it looked individually at this appeal, and found Kimberlin’s position in it utterly without merit and unworthy of further discussion — sends a nice, clear signal to the next trial court judge, whether in the confines of the Fourth Circuit or anywhere else, state or federal, that appellate courts will back them up when they cut short the pro se litigation siege war designed by this miscreant.

    Messrs. Coleman & Godfrey deserve congratulations and commendation, but so too do you as their client and principal. There was no craven surrender nor even nuisance-value symbolic settlement here — nothing to encourage and reward Kimberlin’s abuse. I’m sorry you ever had to be among his targets, but unsurprised at the ferocity of your principled resistance and gratified by your ultimate triumph.
