Motorist Attacked by Pro-Immigration Protesters — And Who Gets Arrested???

I’m appalled that the motorist was arrested. (Although maybe the cops didn’t see the whole thing, so I can’t necessarily blame them.) I think the woman who leapt onto his car should have been arrested — probably with a few of her fellow protesters. Yet this guy is booked on assault with a deadly weapon? You’ve gotta be kidding me.

I hope the case is re-evaluated now that the video is available.

I’m on jury duty next week. Bring a case like this to me and I’ll vote to acquit and then lecture the prosecutor.

Outrageous.

    In a designated cross-walk and in compliance with any traffic control signal or sign. Jaywalking is against the law in LA.

    The worst thing against him is that the police were already there trying to control the crowd, and there seems to be no compelling necessity for him to use self-help.

  7. It is an excuse, actually, for anything more serious than a traffic offense (those are usually absolute liability). It goes to intent, which is the state of mind which needs to be proven for the crime he has been charged with. Even negligence, if you are in a place you have a right to be, doing what a reasonable person would be doing, and the complainant’s tortious acts triggered your disability.

  8. For example, I suffer from pyramidal spasticity in my left leg. Just about anything can make it jump — like a frog’s leg when an electric current is run through it. If a former President were to goose me, and I was to kick his wheelchair over, that would be a colorable defense. 😉

  9. @7/8- Interesting. Usually give vehicles w/those plate a wide berth on the road anyway not only for consideration of those driving but the vehicles themselves as some are equipped w/levers and contraptions seemingly more time consuming to manipulate while motoring.

  10. What I’m seeing is a bunch of professional SEIU thugs run towards a car was that in motion. Maybe if they had been able to speak English, they could have understood what was happening.

    Also this looks like one of those intersections with the crosswalks going in each direction so it might have been confusing.

    All in all, not the motorist’s fault at all. SEIU clearly jumped onto the car and in front of it.

  11. Video of the incident shows a small group of protesters in front of a blue sedan stopped at the intersection. When the car begins to move slowly forward, some protesters placed their hands on the car and tried to stop it. At that point, the car began to move faster and at least one protester jumped on the car’s hood. With protesters screaming, police stopped the car a short distance later in the middle of the intersection as one officer hit the hood with a nightstick. No one else was in the vehicle.

    Carpenter said no victims have come forward so far. Police are asking any witnesses or people who were injured to contact them. David Huerta, president of the SEIU United Service Workers West labor union, said “several” of his members went to the hospital but had no other information about potential injuries.

    Claudia Aguilera, 46, of Los Angeles jumped onto the hood of the car as other protesters pushed against the grille and hit the passenger door with sticks. She was on the hood for about seven seconds as the car accelerated before she said she slid off on the passenger side.

    So, protesters, instead of moving out of the way, voluntarily put their hands on the car. A woman admittedly jumped on the hood of the car. She did not fall off, but slid off, and one assumes landing on her feet, as there is no body on the ground in front of the stopped car, which indicates the car was not going fast at all (although the report makes it sound like it), and now an SEIU official claims several protesters went to the hospital but the police said no victims to their knowledge. Why on earth would we believe members went to the hospital? Who went, what were the injuries sustained? Because it seems pretty suspicious that a woman who jumped on the hood of a moving car was able to slide off and land on her feet, but others ended up in the hospital.

  16. Running over protesters seems like good sport but as we see with the woman killed at charlottesville. Creating maryters for the other side waving the bloody shirt is not a good thing. this is why the hated here establishment supports gun control for negroes and mexicans so they can’t shoot back.

  23. No, he was definitely right to stop when police ordered him to stop. I think he acted reasonably at all times. I might not have pulled my car forward at all, but maybe he was scared and trying to get out of there.

    I don’t even care about the politics of the people. This is all about behavior.

  25. I watched the video. The driver was wrong to push the person who stood in front of the car. The driver was d*mned lucky that person did not loose balance and fall under the the front of the vehicle while it was moving.

    I agree that the person who jumped on the car a bit later was wrong to do so just as the persons who beat upon the vehicle were wrong. If a relative of mine had been driving, I would have lectured them on he stupidity of what they had done; endangering the lives of multiple pedestrians. I agree with the arrest. What comes next (justice) for the driver is to be found in court.

    The car had a handicapped license plate, so perhaps that led to the driver’s decision making. I don’t how, just a thought though.

    Also, the lights to turn left or go straight were red at the time the driver pulled forward through the intersection.

    While the ethnocentric side of me salutes the Felipe response, I would disagree, hell I dont think you should stop at the scene of a hit-and-run if you judge the “neighborhood response” to be instantaneous and severe – in those cases, I would instruct myself and others to phone in the accident give location and then proceed to nearest police or fire station in surrender pose.

  30. It’s a lucky thing the cop’s instinct was to use his nightstick and not his gun. Possibly the World Series influenced him.

    The reason the driver was charged with assault with a deadly weapon, is that cops want cars classified as deadly weapon. That way they can justify shooting unarmed drivers. There are dozens of cases like that every year. As common as “I thought the cell phone was a gun”. A deadly cliche, but it gives the Blue Wall something to hang its hat on.

    All they did was drop boulders from an overpass onto oncoming cars, no way they meant to hurt anyone….

    Doesn’t that depend on the speed of the car. If it’s 30 miles per hour or maybe 25, then it is deadly weapon. If it is traveling forward at 5 mph maybe not so.

    The first Chicago case I remember, from forty plus years ago, it was an off-duty cop in his car who got upset that the music from the car stopped in traffic next to him was too loud.

  40. I would imagine a car is always a weapon. Velocity makes it a striking/hitting weapon but gravity makes it a crushing weapon even if not moving fast. A car needn’t be traveling at 25 mph to crush a person. I know, I saw it happen.

  42. One of the first things I learned about “rules of the road” was that if a police officer is present, his instructions take precedence over everything else, including traffic signals. So legally the driver should have waited for the police to allow drivers through, even if the police are idiots* who are letting the children play in the street. And there’s nothing I see that could be construed as a life threatening situation prior to the driver starting to move his care forward.

    The police failure was not the arrest of the driver, but the non arrest of the people who hit/jumped/attacked the car. They made it a life threatening situation, once the car moved forward. And if the LA Times could find the hood jumper so easily, the LAPD should be able to as well.

    *I’ve encountered enough police officers doing traffic duty here in Florida to suspect that it’s something relegated to the lowest IQs among them. Certainly more than a few think it fine and dandy to keep drivers waiting five or ten minutes for no obvious reason.

We had an incident in Chicago this last May in which a woman chased another with her SUV on the sidewalk and pinned her to a tree, killing her. That is cut and dried. Teenagers “reversing in an aggressive manner” is more the kind of case I had in mind.

  64. I agree with Law prof. Glenn Reynolds on this matter. In some states the definition of kidnapping includes both taking an individual somewhere against their will and preventing them from leaving a place against their will when they no longer wish to be there.

    If a crowd is using physical force to block roads that ought to meet the definition of kidnapping. It’s a crime in Texas, although it isn’t kidnapping. But it should be. But moreover, the whole point of doing so is according to the leftists who do this is to make me and people like me feel uncomfortable. I.E. put us in fear.

    Which leads me to ask, how much force can be used against me before I am justified in responding with deadly force? Instapundit got into some trouble when he said that motorists would be justified using their vehicles as weapons whenever a mob is blocking the road. If they’re capable and willing to do that, what else are they capable of and willing to do. Remember Reginald Denny.

    Deadly force is justified under the laws of Texas to prevent among other things aggravated kidnapping.

    I remember riding my mini-bike on the 57 all alone, a few days before it opened.

    The 57 really was the beginning of the end for that area. What was a beautiful cove in the hills full of citrus groves, corn and wheat fields (and yes, oil wells) was paved over in a decade. Firestone boy scout camp and Sleepy Hollow used to be the far reaches for where I was allowed to wander…..back when kids could wander.

Anyone else remember “Bridgegate?” Is engineering traffic jams only a crime when Republicans do it, but a sacred form of protest when the SEIU does it?   72. The Drunk Uncle is a genius. DUI penalties and costs being what they are a few hundred dollar ticket for the kid is well worth it. He went from a possible $10k in costs, a suspended license for a year, driver school, DUI school, $200 a month for a year of ignition interlock, and five years of a 40% car insurance increase. There are less punishments for pistol whipping a Korean 7-11 owner during a robbery than for a DUI.

Pretty much all of the OC was heaven. 20 minutes to get to the beach from Anaheim… riding my Schwinn Stingray bike on roads that wound thru orange groves over to Angel’s Stadium to watch a ballgame for $1.65. Dove and rabbit hunting with my Sheridan “Blue Streak” pump pellet rifle in the groves that stood where the 57 freeway now stands. Climbing thru the fighter jet shell at the Boysen Park playground. Catching Alligator lizards and scorpions along the banks of teh Santa Ana River… watching as my friend set fire to an old rickety farm house in the middle of the orange grove near the intersection of Lincoln Avenue and Rio Vista… oh… wait…
