Defendants in Mosque Bombing Plot Trial Want Trump Voters as Jurors

A curious tidbit left over from Friday night. If you live in rural Kansas and are a Trump voter, there are some folks who allegedly planned to bomb a mosque who would like to have you on their jury. They think that you, the Trump voter, would be more sympathetic to them:

Three men accused of plotting to bomb a mosque and apartment complex housing Somali refugees asked a federal judge Friday to include prospective jurors from rural western Kansas because they are twice as likely to have voted for President Donald Trump.

A defense motion argues that plans to only summon citizens in the more urban counties closest to the federal courthouse in Wichita is a discriminatory practice that excludes rural and conservative jurors. The trial begins March 19.

Gavin Wright, Patrick Stein and Curtis Allen are charged with conspiracy to use a weapon of mass destruction and conspiracy against civil rights for allegedly planning to detonate truck bombs in the meatpacking town of Garden City the day after the November 2016 election. Wright also faces a charge of lying to the FBI.

“This case is uniquely political because much of the anticipated evidence will center around, and was in reaction to, the 2016 Presidential election,” defense attorneys wrote.

These are militia loony tunes who apparently believed that if Trump won, Obama was going to roll in the tanks and declare martial law.

Being a Trump voter obviously doesn’t make someone a supporter of terrorism, whether it’s terror against Muslims or terror against the populace at large. But there’s no doubt that the folks on trial here would have a better chance with rural Trump-voting Kansans than with urban Hillary-voting ones. That’s not a slur on Trump voters. It’s a fact. Similarly, if the defendants were Antifa/Black Lives Matter folks looking to blow up a police station, their defense attorneys would be looking for the most urban Hillary-voting group possible — and that fact is not a slur on Hillary voters or a suggestion that all Hillary voters are Antifa supporters. Again, it’s just a fact.

Just a little reminder that defense attorneys in criminal trials, like people running for office (oh hi Roy Moore!) often prey on people’s basest emotions and prejudices. Human decisionmaking can be a nasty process, can’t it?

  11. There is very little doubt in my mind that the prosecutor, the defense, and the judge conspired to pick to most cop-friendly jury they could in the Daniel Shaver case. I would be very surprised if they did not. The defense attorneys because it’s their duty, and the judge and the prosecutor because they and the police are on the same team.

    That’s why cops don’t get convicted in excessive use of force cases. It’s all for show with the big dogs pretending to hold the little dogs accountable for harrying the sheep.

  12. This idea is nothing new. In colonial America, the Brits used to transport “terrorists” back to England to face English juries that had no sympathy with the colonials.

    As a result, the 6th Amendment says:

    In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law

    Some say that this reflects an interest in jury nullification, but it seems more an insistence that context is important. And sometimes this works in the State’s favor too. If OJ had been tried in Santa Monica, the nearest courthouse to the crime, he probably would have been convicted.

  14. There’s this cop see? After work, he stops at the bar and has a half-dozen shots and beers. Then he gets into his car, drunk, runs a red light, and hits two pedestrian in the crosswalk. One is thrown 20 feet away. The other goes through the windshield of the cop’s car.

    The police are called, and the sergeant from the second shift shows up to make the report. With tears in his eyes, the drunken cop asks: “Sarge, how are you going to write this up?” And the sergeant says: “Well, I think we’re going to charge this one with breaking and entering, and that other one with leaving the scene of an accident.”

I was defending the girlfriend of a drug felon who was in the room with drugs (he was on parol, caught in room with drugs hidden in the drop ceiling, she was visiting and in fact tested clean) the Prosecutor dropped the case (conspiring to traffic) during voir dire when one juror answered the question “do any of you know police officers or law enforcement” thus: “yeah, you are the asshole who tried to railroad me and seize my cabin when the cops caught my nephew smoking dope in the woods.”

    It was glorious. Of course 6 months later, the girl was caught carrying. The war on drugs really is the war on the terminally stupid.

This week, it was ABC’s “Never-Trump” Megyn Kelly’s chance to exact revenge on President Trump, who after attacking him during his first debate, lost her conservative Fox News fanbase and basically saw her promising career come to a screeching halt. ABC picked up Kelly in a $23 million per year contract in a gamble that liberals would warm up to the formerly conservative host. ABC has since found out that conservatives no longer want anything to do with Kelly, and liberals despise her for her past performances as a top-rated host on conservative-leaning FOX News.

  24. About a year ago I made a comment here about how I have never known an honest cop. Well, I got jumped all over by some of you guys. Truth is, being a restaurant/bar owner for 37 years I knew all the cops in all the districts I owned places. One of my long time best friends was a sergeant in the Philly cops (unfortunately he’s dead now) and he was as crooked as they come. Great guy, great friend but crooked. All the cops I knew owned a home in Philly (required to work there) always in a nicer area and one in Wildwood or OC Maryland. The vacation homes went up to as much as $900k. They all owned top level cars: Caddies, Lincolns, Jaguars. As did their wives and usually girlfriends who they kept on side apts. Most owned boats or high end Harley’s, skidoo’s or 4 wheelers. Some had hunting cabins in the Pocono’s. All on less than $80k a year. Not bad.

    I was with my buddy the Sarge when he went into a Hallmark store and got a big card and a silver picture frame, then went next door and got a Seiko watch, then we hit the deli where he “bought” me lunch and as we left we went through the beer distributor who threw two cases of Heineken in his trunk of his Lexus. He never reached for his wallet once. Oh, it was all “his” gift for the wife’s birthday.

    CNN has quietly walked back more of their “bombshell” reporting on the Trump-Russia collusion narrative, and this time it’s a story relating to Attorney General Jeff Sessions’ security clearance forms.

    In May, CNN reported that Sessions had failed to disclose meetings he had with the Russian ambassador when he was a senator. Justice Department officials told CNN that Sessions had not listed those meetings on a security clearance form, even though the form says to list “any contact” with the “foreign government” or its “representatives” in the past seven years.

    CNN framed the non-disclosures as more evidence of collusion between Russia and the Trump team, writing, “He has come under withering criticism from Democrats following revelations that he did not disclose the same contacts with Kislyak during his Senate confirmation hearings earlier this year.”

    At the time, Sessions said he was told by the FBI not to list meetings “connected with his Senate activities,” but CNN’s legal expert denied those claims.

    “A legal expert who regularly assists officials in filling out the form disagrees with the Justice Department’s explanation, suggesting that Sessions should have disclosed the meetings,” CNN asserted.

    The CNN report led to breathless coverage by the rest of the legacy media, who painted the non-disclosures as a Trump official trying to hide problematic meetings with the Russians.

    However, CNN admitted early Monday that FBI emails prove that Sessions’ explanation for the non-disclosures is accurate.
