Hillary’s Quickie Email Press Conference: Vote Early Before This Gets Worse!

It’s almost as she’s . . . a little bit worried by what might come next.

Don’t blink or you’ll miss the whole thing. The statement and Q&A together last less than four minutes. That said, my favorite part comes at 2:10, where the panic visibly starts to creep in as she sees it all possibly slipping away:

You know, I think people a long time ago made up their minds about the emails. I think that’s factored in to what people think, and now they’re choosing a President. So I would urge everybody to get and vote in all the states that have early voting, because I think Americans want a President who can lead our country, who can get the economy working for everyone, not just those at the top, and who can bring our country together.

Please hurry. Vote as soon as you can! Before . . . before the next shoe drops . . .

Her prepared remarks closely track the points made in the John Podesta email reported earlier. The talking points are clear: 1) We’re 11 days out from the election; 2) Comey says he doesn’t know if the emails are significant; 3) nothing will change from the FBI’s decision in July; and 4) hurry up and get the details out.

Her smile has never looked so forced.

  21. A much better strategy for Hillary to direct attention away from the FBI investigation would be to find an unattractive woman to accuse Donald Trump of sexually harassing her. Trump would then spend the next five days tweeting about how he would never have sexually harassed the woman because she is not pretty enough for him. Any coverage of the FBI investigation would be relegated to the background in the meantime.

Director Comey serves at the pleasure of the President; there is no way on God’s earth he would have announced the reopening of the investigation eleven days before the election unless whatever was discovered was so bad that, had he delayed the announcement, some of his underlings would have leaked it anyway.   41. Being very ignored in all of this was the Wikileaks revelation that Hillary Clinton is a drunkard. She’ll have a hangover answering the 3 AM phone call because she’s drunk at 3 PM.

    As loathsome as Donald Trump is, he’s (slightly) less worrisome than having an habitual drunk as Commander-in-Chief of the Armed Forces, and having the sole authority to use nuclear weapons.

    I did site searches, this morning, of both The New York Times and The Washington Post, for “sober her up”, the words used in Jennifer Palmieri’s e-mail to John Podesta, and neither paper had even mentioned it. The professional media are covering up what I believe is a huge story.

The purpose of early voting is to allow the whipping teams a warm up period prior to election day and she appears to be sober enough to understand the whipping teams aren’t hitting their targets in what were very easy locations in ’08 and ’12.

    That’s a phrase which is often used in contexts having nothing to do with actual alcohol, most typically to describe someone who’s so out of touch with reality that they need someone to help them recognize reality. The context — subordinates debating who among them ought run the risks of trying to implement the unpleasant reality check in an upcoming meeting or phone conference — strongly suggests that exact usage to me here.

    If Hillary Clinton has a serious booze problem, at her age and after the number of years in which she’s been under a public spotlight, I’d expect some corroboration that actually involves alcohol. Color me unimpressed and unpersuaded by this “email bombshell,” which I think is being magnificently overplayed. When it comes to finding grounds to criticize the Clintons, one need not strain like this.

  54. Has anyone here ever tried to actually sober someone else up? Unless you’re using IV fluids, you’re not going to get much improvement over just putting the subject to bed. You feed a drunk coffee and you get a caffeinated, jittery drunk, but they’re still drunk. You put a drunk in a cold shower and you get a shivering, angry drunk, not someone who can pass for sober.

    We’ve seen tons of indications that Clinton has a problem grasping things that the rest of us consider part of our everyday working reality — things like “It’s bad when you pretend you’re above the law.” These Clintonista emails are indeed replete with many, many, many examples of subordinates gnashing their teeth and venting their frustrations that their boss is insulated, isolated, and prone to spectacularly bad judgment pretty much 24/7/365. One doesn’t have to assume she’s a closet alcoholic to explain her consistent choices over the years, and indeed there are far better explanations that actually have direct empirical support.

    When I was at AOCS and none of could have legally gone to New Orleans as it was out of range

    And we had all gone to New Orleans and one guy was still drunk when we tried to cross the quarterdeck that Sunday night. It kinda worked as we were allowed to pass. But nobody was fooled. The next day my DI slapped his hand down on my shoulder as I was in the line for breakfast, and told me in no uncertain terms he knew what I had been up to.

    I think the best evidence I can offer for why I wasn’t the drunk party in all this is my attempt to reconstruct my hat. Officer candidates are required to be in uniform, and consequently to wear a cap that is something between an officer’s and a chief’s cap. The gold ribbon is different, the anchor is different, but the uniform store was open, the parts were there, and I could get wire cutters.

    It required timing, showing up before liberty expired and before they turned the lights on.

  61. While I also tend to believe it had nothing to do with alcohol but rather a metaphorical “sober up,” I also think it would be foolish and naive to rule out a booze problem. To do so would be to ignore what we already know to be true about her: She is a well-practiced, congenital liar who is paranoid and fearful, and obviously surrounds herself with people that will do everything in their power, and beyond, to make sure no one sees behind the veil of secrecy. The woman hides many, many things, and for years, successfully so. That this latest crack in the sealed casing which has exposed yet more deception, may indeed eventually lead to evidence that she has a problem with imbibing too much. But that has hasn’t happened yet.

    My feels is an undiluted sazerac is the way to go. They’re *never* served this way so you have to ask.

    It’s more complex and playful than the Waldorf, which seemed a rather stern little fellow in both incarnations. (Granted there’s no real consensus on how to build a Waldorf so I might play with that one a little more sometime.)

  72. The morning after: a few notes based on experience.

    Reporting this morning is that there are “tens of thousands of emails”, and what Comey granted to investigators was the opportunity to review them for their relevance, meaning they don’t know what they have.

    Couple of thoughts:

    The earlier investigation concerned emails that went through the Clinton server — not emails in general. Abedin had a Clinton.com email address, so any emails on her address account would have been relevant. But the investigation did not, to my understanding, extend to the broad email practices of her entire inner circle.

    A couple things to keep in mind here — no search warrants were obtained and no grand jury subpoenas were issued. That means the investigators did not get Abedin emails from her AOL account, which is being referred to in reporting.

    There are two ways to access email material that might be found on a laptop. First, you can search the hard-drive for emails that have been downloaded and stored there. Second, you can sign on to the person’s email account through the web portal if you have their address and password.

    If the computer was provided voluntarily, then the owner of the computer has likely relinquished any expectation of privacy under the 4th Amendment, and everything on the computer is fair game.

    if the computer was provided pursuant to a grand jury subpoena, and the owner did not got to court in order to limit the use that can be made of what might be on the computer, then what might be found on the computer is likely fair game.

    If the computer was obtained via a search warrant, then any search of the computer must be tailored to extract only the information relevant to the investigation that was the basis for seeking the search warrant. The GENERAL analogy is that a computer is like a filing cabinet full of thousands of documents. The search warrant only authorizes the agents to seize evidence relevant to the crime under investigation, and not to just rummage through the everything.

    I’ve looked, but cannot find, any reporting on how Weiner’s computer came into the hands of the FBI — voluntarily or otherwise.

    But what I find very interesting in Comey’s letter is the part of his second to last paragraph which says “I agreed that the FBI should take the appropriate investigative steps designed to allow investigators to review these emails….”

    A significant question to me is how “tens of thousands” of emails would find there way onto the hard drive of a laptop. Remember, the second way to access emails on a computer is to sign into the account through the service provided using the username and password. BUT, my understanding of the law in this regard based on my own experiences as a fed — though I haven’t looked at the issue in a few years — is that any such effort requires consent or a search warrant. Just having access to the computer and the account isn’t enough to legally be able to read a person’s email account. And, not only is a search warrant required, sometimes the circumstances are such that a WireTap order is necessary. My recollection on this is foggy, but I think when law enforcement wants to read emails that have not yet been opened by the recipient, that’s considered an “intercept” of a communication in the same fashion as listening in on a telephone call — a T3 intercept order is required.

    So, back to the question of how tens of thousands of emails end up on a laptop’s hard drive, and what have the investigators actually seen so far.

    This laptop was obtained by investigators most likely in late Aug or early Sept., by a completely different group of FBI agents with no connection to the Clinton email investigation.

    The hard drive was sent to FBI tech agents in the same office — every office has agents trained to exploit electronic data with hardware and software assigned to them. It is not necessary for the device to go to the FBI lab or some office in DC. I would not expect that there was any extraordinary sense of urgency in processing the hard drive for the Weiner investigation. The case is pretty ordinary in terms of those kinds of cases, and the FBI has thousands of them open nationwide.

    The first thing the Weiner investigators are going to get back from the tech agent’s forensic analysis is simply an index of everything on the hard drive. From there the tech agent and the case agent will narrow their focus to stuff that actually matters to the investigation.

    In the Wiener case that’s going to include dick-pics, emails to particular addresses associated with the case, any emails attaching dick-pics, and any TM data that is stored.

    With regard to emails, they would have to be downloaded onto the hard drive and stored there. But pervs involved in the stuff Weiner was involved often times catalogue their activity by storing stuff.

    On emails, the index produced by the FBI’s forensic software can be sorted by “To”, “From”, Subject, and by search terms. My guess is that through this sorting method, the Weiner investigators realized they had a large number of Abedin emails, including Abedin emails that went to/from/thru her Clinton.com account.

    The “tens of thousands” of emails might only be a reference to how many are stored on the computer. If its Weiner’s computer, which seems to be the case, the biggest part of them might all have to do with him and his activities. But the FBI agents on his case would have immediately grasped the significance of any Clinton.com emails in the archive, and the potential relevance to the Clinton investigation.

    Oftentimes the FBI will go through internal hurdles involving agents in one case asking for internal permission to share evidence with agents in a different case — especially when different offices are involved. I’m quite confident that the agents on the Clinton email investigation have a detailed index of all the emails they reviewed in their investigation, and maybe a list of emails they could identify as having existed but where no copy of the email was ever found.

    The way Comey’s letter is written, my guess is that the Clinton case agents have seen a list of Clinton.com emails on the index from the Weiner computer, and there are emails in the index that don’t match their index of emails they have reviewed already, and they sought approval to get the actual emails themselves along with the meta data from the case agents on the Weiner case.

    This would explain his comments in the letter that they didn’t yet know the contents, and he agreed to allow the agents to take the “appropriate investigative steps designed to allow investigators to review these emails.” It might be that some/all of the emails were deleted on the computer, but located using the forensic tools used by the tech agents.

    Last point — if tens of thousands of emails have been downloaded onto the hard drive of the computer, who did that?

    this is so you can work with your emails when you’re not connected to the internet

    say you have access to the same email account from outlook on your pc at work and your pc at home

    if you delete something from your inbox at work, when you pull up your outlook at home that night it will be gone from your inbox there too

    but you can also choose to archive your emails – and a lot of time you HAVE to because your server accounts has a limited amount of storage – so outlooks has a feature that lets you move all email over x number of days old off the server and onto your hard drive

    SWC – You’re not wrong, exactly. You have some details wrong, but not in a way that really makes a difference in the end. Mostly technical details, but this stuff is always changing and hard to keep up.

    The other thing to remember is that Weiner’s investigation is partly an investigation into possible child porn. He was, after all, sexting with a 15 year-old. The FBI takes that stuff seriously. There are a few internal walls that are bypassed when it involves the exploitation of children. That may have played a factor, although it normally goes the other direction (you are investigating something illegal and find child porn during your investigation).

  84. @SWC: In my experience, every time you open up Outlook it starts downloading your emails, whether you have chosen to open them or not, whether you’ve opened it already or not. I don’t know how easy this is to turn off.

    I work in an industry where individuals are personally liable for data breaches. Consequently I never open Outlook on any other machine except my workstation. If I need to use my work email I use the webmail or I log in to my workstation remotely. I do not have, at home, any machine with Outlook on it.

    Probably at some point Huma Abedin logged on to her HRC mail through Outlook using Weiner’s machine. If she’s not super tech-savvy, she probably downloaded every email she’d ever sent or received up to that date onto Weiner’s machine.

    So there’d be tons of stuff on there that Hillary never sent over when she was supposed to.

  85. One of the reasons I use Linux and open-source applications is because they do not allow me to simply consume software. I have to have some idea of how it works in order for it to work. I do sacrifice some convenience, and I never have the latest and greatest, but I don’t get spyware or viruses and I don’t accidentally commit Federal crimes when I check my email.

    People just buy this stuff and use it with no idea of what it’s doing. Which is why the tech giant have such outsize influence on everything.
