Obama to Tell Every School in the Nation to Let Boys Into the Girls’ Bathroom If They Want

I can’t see how this could be abused by boys wanting to peep on girls. Not at all!

The Obama administration is planning to issue a sweeping directive telling every public school district in the country to allow transgender students to use the bathrooms that match their gender identity.

A letter to school districts will go out Friday, adding to a highly charged debate over transgender rights in the middle of the administration’s legal fight with North Carolina over the issue. The declaration — signed by Justice and Education department officials — will describe what schools should do to ensure that none of their students are discriminated against.

It does not have the force of law, but it contains an implicit threat: Schools that do not abide by the Obama administration’s interpretation of the law could face lawsuits or a loss of federal aid.

Maybe this will dampen people’s enthusiasm for government-run schools.

Instead of drilling a hole through a wall, horny 16 year olds will instead walk boldly through the girl’s locker rooms raging hard-on in full view shushing angry naked and humiliated teenage girls holding little towels over their naughty parts, and assuring them that in fact they also are teenage girls.     Absent recognition of LGBT as a suspect class, the assertion of transgender rights under the Due Process or Equal Protection Clauses may rely on the equality and dignity formulations ofObergefell v. Hodges (2015).

    In Obergefell, Justice Kennedy’s majority opinion explained that “[t]he Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity.” Hence, the liberties protected by the 14th Amendment extend to “intimate choices that define personal identity and beliefs.” Law professor Lawrence Tribe has celebrated that “Obergefell’s chief jurisprudential achievement is to have tightly wound the double helix of Due Process and Equal Protection into a doctrine ofequal dignity,” and the decision’s establishment of same-sex couples’ freedom to marry was “understood by all to directly redress the subordination of LGBT individuals.”

    And Scott Skinner-Thompson, associate law professor at NYU, has noted the case’s potential implications for trans rights: “The court’s recognition that both due process and equal protection require that individuals be permitted to self-determine—to define and express themselves—has unmistakable extension to rights for the transgender community. . . . . Understanding that transgender identity is, in part, about access to the ability [to] express and define oneself makes the relationship between the court’s ruling and transgender rights clear.”

    When an out-and-out leftist is currently in the White House, I’m not sure why you think a big squish-squish like Trump is somehow the big influencer at the moment. I mention that, nk, even more so since you did mention not long ago that you do have shades of liberalism in your philosophy or take on the world.

    As for the ongoing socio-political debacle that is America, and Western civilization, in the 21st century, this particular situation does crop up in light of the former Bruce Jenner reportedly regretting his decision to become a female.

    Yet the same people claim that there is a “rape culture” present.

  14. This will not end well. It was my experience coaching in inner city high schools that the administrations were very adept at playing the discipline game. Rather than enforce simple rules on campus, like don’t gang up on someone you don’t like and kick the hell out of him at lunch, which would lead to eight or nine disciplinary actions against a favored racial class, which could result in Federal intervention, the administration would look the other way. This had the expected result of encouraging the more violent ones to feel comfortable in their bad habits. By the second month in the fall semester, these characters, generally incoming 9th graders, misjudging the situation, could be counted on to overstep a hitherto nonexistent line, and committed a felony in view of a police officer. The police then charged the culprit. Having a felony arrest, the undesired student was then assigned to a special school, never to be seen again at the nice school with the excellent racial discipline record. Of course, there was the victim of the felony to be concerned about, but more often than not it was someone who was attacked off of school grounds, as in the sidewalk fronting the school, and so no one at the school needed to be concerned.

    Letting aggressive boys into the girls bathrooms on campus will create a problem that can’t be handled by this method of exporting the bad behavior to a locale were the police can step in. The girls bathrooms on campus will be a special little universe, a sort of free fire zone. And even the most obtuse gangster in training will understand that what he can do on campus freely, in the privacy of the girls bathroom, is not something that will be overlooked on the sidewalk in front of the school.

    This is his standard MO. He is laying in the administrative rules that will allow the bureaucrats to punish rebels in the future, long after Obama’s gone.

    I got an email from our diversity gal back in 2010 asking us to answer a federal “voluntary” survey about our ethnicity, or the college could risk losing federal money. I refused. I refused the second email too, about the “voluntary” survey. Eventually I left for another job. Also got the email there, with an asterisk that said “supervisor will make visual identification” if employee declines to answer. This is all to force employers to hire people of certain races.

At at least 100 high schools across the nation, a group of boys, at least five or six but the more the better, approach the principal and demand access to the girls’ locker rooms, declaring themselves to be girls. They are ready for the principal to come up with all sorts of ad hoc criteria to distinguish them from actual “trans-girls”, but these will have been obviously made up on the spot, and will be easy to challenge as without legal foundation.

    After two or three such attempts have been refuted, they hand the principal a letter signed by all their parents backing up their demands, and a letter from a lawyer (from one of the legal foundations that deal with this sort of thing) saying “I represent these young women, and if they are not allowed to use the girls’ locker room I intend to file suit for them”.

    Once the principal has had a few minutes to absorb this, they pull the next card: “Oh by the way if you do let us into the locker room, expect a law suit by our sisters who will claim that they are being denied a safe space to undress. Why yes, they have the same lawyer, who will be just as happy to represent them as us.

    “The only way we don’t sue you is if you declare an official policy that people with penises don’t belong in the girls’ locker room no matter what they call themselves, and reply accordingly to the letter you got. Yes, the 0bama administration may go after you, but then again they may be bluffing; one way or another you’re taking a risk, so pick your side now.”

  20. Obama is doing this because he can. And every day he discovers something new that he can do. Our only hope is that he suddenly learns how to play golf, and decides to devote himself to a new career while the green’s fees are covered by the WH slush fund.

    Yes, actually. You already can do that, and the police do have to protect you as much as they protect anyone. A more interesting question is whether a public school student could assert the right to do so at school. In principle yes, the law would be on your side, but it would take a few lawsuits to get it through the heads of reluctant principals.

    Oh, the DOE/DOJ agree that there are two. They just say that membership in one or the other does not depend on anatomy but on personal declaration. If you say you’re a girl then you’re a girl, and are entitled to use the girls’ room, and if the other girls are mean to you because of your penis then they’re bigots and must be disciplined.

    Of course it’s all of one piece, and I agree with the analysis in your followon comment. As far as it goes. But it doesn’t go far enough.

    We’re already dealing with the absurd, reality bending consequences of the Obergefell just on the SSM marriage issue alone. Some states, like Kali, require that insurers provide same-sex couples with “fertility” treatments along with heterosexual couples. I put fertility in scare quotes because with same-sex couples it is not a matter of fertility. It is a matter of biological impossibility. Both people can be fertile, doesn’t matter. Two people of the same sex can not produce children together.

    It is now “hurtful” and indeed “hateful” to point out this reality. That there is no such thing as marriage “equality” because nature in the form of biological reality gets the final say. You can call a relationship between two people of the same sex a marriage just like a union between two people of the opposite sex. But they are functionally different. Therefore, not equal. But PC requires us to blind ourselves to the facts lest we be called “homophobes” and bigots for saying chromosomes matter.

    This was the first step in un-mooring reality from what is socially acceptable,, at least in some circles.

    It continued; now in some states when a lesbian or gay couple outsources its procreation to a third party the happy couple gets to list a woman as the father or a man as the mother depending on whether they are part of the L or G portion of the increasing list of insane possibilities. And worst of all we’re all supposed to be “polite” and buy into the fiction that some dude is really that kids mom instead of acknowledging the reality the kid’s mom is actually a woman who is now out of the picture. Or that the butch lesbian is the kid’s dad, when in fact “dad” contributed the contents of the turkey baster.

    In other words, we’re all supposed to walk in lockstep and buy into the lie or suffer the consequences.

    George Orwell was there at the beginning of this, and he thought it was curable at the time but unfortunately things have turned terminal.

    It has had the opposite effect. Now the 97-99% of people who are not gay or transgender have no right to a shred of dignity or privacy. In Fort Worth schools they used to have a policy that anyone who identified as “transgender” (again a biological impossibility) could use a single-stall
    restroom. But that won’t due for our totalitarian overlords. That would imply that the straight kids who do not want to compromise their dignity or privacy by having to appear in various forms of undress in front of someone clearly of the opposite biological sex have rights that anyone should respect.

    Actually, those straight kids and their parents opposed to this madness have the law entirely on their side.

    Since when has this administration respected precedent or the Constitution when it gets in the way of fundamentally transforming the United States? The thing is the Obama administration realizes they don’t have a leg to stand on when it comes to imposing boys on girls and girls on boys in bathrooms and locker rooms (I realize the latter sounds like a teenage boy’s dream but if you remember when you were a kindergartner or in early elementary school you might not have enjoyed it so much). That was the importance of Loretta Lynch’s Orwellian “Jim Crow” speech (again with the George Orwell). As the SCOTUS has repeatedly ruled students to not check their rights at the schoolhouse gate. They retain those rights and as the Pacific Justice Institute (which has been
    on the front lines fighting this lunacy) one of the most fundamental of those rights is the right of “choosing not to undress or be in a state of full or partial nudity in the presence of members of the opposite biological sex. To this end, federal courts have recognized that anti-discrimination laws which ostensibly would give individuals no discretion in sharing intimate spaces such as bathrooms with the opposite sex yield to higher privacy considerations and common sense.” (The letter then goes on to cite case law.)

    Since the law is against them, the administration is moving to get PC on their side. If you would stand on your rights, you’re no better than a Klansman or an old fashioned Democrat; i.e. southern racist segregationist. In other words, if you’re a 14 y.o. girl and you don’t want to shower with a 16 y.o. boy then there’s something wrong with you! Only a bigot would assume that the intact and erect male genitalia confronting you in the shower means “she” is not a girl.

    Hence “transphobic.”

    There is a method to this madness. If you believe, as the radicals on the left do that we must smash the bourgeois family and create the new soviet man then we must start smashing a lot of eggs.

    Religion and family are the two primary competitors with the state for a person’s affection and loyalty. Totalitarians have always hated that. Therefore they must both be
    destroyed.

    The Obama administration isn’t forcing the Little Sisters of the Poor to commit an excommunicable sin because there’s some crying need for mostly elderly nuns to provide themselves or what limited lay help with contraceptives and abortifacients. It’s to eliminate them as competition. It’s a deliberate assualt; either violate your vows or pack up and go home.

    The US Constitution says we have the right to the free exercise of religion. Obama the constitutional scholar keeps talking about “freedom of worship.” Proving that he is indeed quite the constitutional scholar. Because that was the right people had under the old Soviet Constitution.

    Remember Julia? Married to the state. She had a cat and a vegetable garden and a cradle-to-grave nanny state.

    Remember the 2012 Democratic National Convention? Government is the one thing we all do together. They’re making that true by imperial decree using the hammer of the administrative state.

    And with transgenderism, in other contexts, they argue that there are more than two sexes. So why suddenly with bathrooms, is it binary? Facebook allows 56 genders! (although you can discover all the possibilities only by trial and error)

    As a political maneuver, I would have thought this would not have come until HRC was in office.
    Unless they are afraid HRC will lose and need to do this now.

    As I said before, I think a respectful but firm stand against this is a political winner.

    Early word is that Trump is opposing by saying it is not a federal issue,
    but was also initially against the NC state effort to “protect a two separate bathroom policy”.

It’s about crushing dissent as social norms are redefined while simultaneously eliminating any remaining Judeo-Christian values. Morality must go. All the progressives needed to get this in full motion was was a willing president.

  37. Dana is right – this is not about bathrooms, or public schools. It is about the negation of the category of “woman.”

    There is now no such thing as a “sex, “ other than what the federal government deems (or something similar to what the Fourth Circuit held and most certainly, the Supremes will hold), and any person born with a penis (hereinafter referred to as a “man”) can decide at any time, for any duration of time, that he is, in fact and truth, exactly the same as a person born with a vagina (hereinafter referred to as a “woman”). Therefore, the category and identity of “woman,” are destroyed except as women or women’s places, spaces, physicality, etc. serve the needs of men who insist they are “women.”

    If a man decides he is a woman (even if just for that afternoon) he has the right to enter spaces set aside for women, such as their bathrooms, locker rooms and changing rooms. He may state that he “feels” like a woman (apologies to Shania Twain), and must be treated like one; he may claim he is afraid to toilet, shower or change with men. An accommodation such as allowing a separate space for a him who feels like a her is not acceptable – he must watch women toilet, shower and change. It does not matter that his internal reality has no correspondence with actual reality, and that the women do not share his delusion and do not want to be the objects of this particular “male gaze.” The women in that toilet, dressing room or locker room exist in reality only to provide the “therapy” he states he needs and to provide him a space away from the “male gaze.”

    Women therefore have no voice or right to object to any “male gaze.” How can a woman know that a particular man is, in fact, a man? She has no right to object to a “male gaze” anywhere – only a bigot and transphobe would assume a man is not, in fact, a woman – and a lesbian woman at that.

    Traditional women’s teams have no right to federal funds under Title IX. Who is to say that the men who say they are women cannot populate the women’s lacrosse, soccer, softball, swimming and tennis teams? No one can say that. These men, who are now, in fact, women, can push every woman off the team. No set-asides for women. This is because men who say they are women are as much women as vagina-women. They are better women, because they are, on average, stronger and faster. The best woman for the job will always be a man.

    So, if a man cannot or does not want to make the men’s team, all he has to do on tryout day is “identify” as a woman. If 15 to 20 such men decided to do that for the lacrosse or tennis teams, it is highly likely the entire team would be men – identifying as women of course. And since no one can “discriminate” against such men, and because there is no requirement other than the man’s bald assertion that he is a woman, the school gets credit under Title IX for supporting “women’s” sports.
    Olympic and professional sports will soon follow.

    There is no need to encourage women in the STEM fields, if there are enough men who identify as women in those fields. Who is to say that those men are not women? No one can say that – so when colleges, medical schools, engineering firms, etc. report the percentages of men and women in their programs or on the job, they will get “woman” credit for every man who identifies as a woman on the day the reports are prepared. Even the “Vagina Monologues” performances have been canceled because of the men who say they are women. No category of “vagina” is allowed – even in the arts. “Women’s Studies” are becoming “Gender Studies” – no category of “woman” allowed.

    Women will have no protection against job discrimination, college or graduate school entry, or choice about being housed with men in dorm rooms, hospital rooms, or prisons under the same criteria. All a man has to do is state to the company, hospital, prison or college that he “identifies” as a woman (at least on that day!) It does not matter if he is married to a woman, that he is a father or will father children, that he dresses and presents as a traditional male. Who is to say that he is not a woman? No one can say he is not a woman.

    In time, vagina-women can be pushed back out of the academy and labor force into the jobs the men never wanted anyway. They will lose all privacy in hospitals, dorms, prisons. Rape in prison? Heck, that has been happening for decades. So what?

    Women’s physicality, their relative vulnerability do not matter – they exist only to confirm certain men at certain times in their claims that those men, are, in fact, women. The only vulnerable ones are the men claiming to be women. Men can claim unlimited protection, which is to inhabit the spaces of women. Women may not claim any such protection.

    Women now have no say as to who is in their “identity group.” Contrast this with black identity. Black identity groups are more popular than ever – “safe spaces” away from whites on college campuses, “Black Lives Matter,” and “black power” are all acceptable expressions of “black identity.” Rachel Dolezal, a white person who attempted to be “identified” as black was shut down – others “questioned” her racial identity. The government and the media approve of black (and Hispanic) identities as categories. They deny that a “woman identity” is a real category.

    Reducing “woman-ness” to the thoughts inside a man’s head inevitably results in limited utility for “woman” in society. The only utility vagina-women will have (outside of confirming a man’s identity as a woman) will be as breeders, models and actresses (and maybe not even as models and actresses – see Sports Illustrated).

    A misogynist paradise – woman-hood defined owned exclusively by men! Woman’s utility reduced to breeder. The women’s movement completely obliterated, your daughters left with whatever educational and vocational crumbs the men do not want – enforced by the government, courts and thought leaders of that movement. I definitely do not like the idea of the Executive legislating through executive orders, much less “sweeping directives,” and that aspect of this story does bother me. Protecting civil rights is one thing; mandating one-size-fits-all rules is another thing.

    At the same time, I think there is an undue measure of fear-mongering around this issue. There’s a balance to be struck here – one that accounts for the unfairness inherent to either extreme.     In fact, I think most of us are actually much more concerned with the well being of the individual child and others involved than most of the people making a fuss and trying to impose this point of view. Many people are more concerned with an issue that the people involved.

    Prior to this recent movement over transgender rights, there have been doctors and others working with these people for years.     The left always needs a prototypical victim — somewhere, someway, somehow — to shed tears for. Now that racial and ethnic minorities are old news, a new minority group has to be dredged up to ping the consciousness of liberals.

    All this idiocy about the need for unisex bathrooms and locker rooms occurs on the heels (stilettos?) of the former Bruce Jenner reportedly having doubts about his/her transformation, and members within the US military (already Nidal-Hasan-ized), in order to express solidarity with women’s rights over the past few years, having male recruits demonstrate on college campuses by walking around in high-heel shoes.

    There are ongoing reports of various school districts in the US starting to frown upon teachers referring to their male and female students as “boys and girls.”

    The lunacy of political correctness will not end well.
