Transgender people should be able to use whatever bathroom they want, Donald Trump said Thursday.

“Oh, I had a feeling that question was going to come up, I will tell you. North Carolina did something that was very strong. And they’re paying a big price. There’s a lot of problems,” the Republican presidential candidate said during a town hall event on NBC’s “Today.”

Referring to comments from an unnamed commentator who on Wednesday said North Carolina should “leave it the way it is right now,” Trump said he agreed.

“Leave it the way it is. North Carolina, what they’re going through with all the business that’s leaving, all of the strife — and this is on both sides. Leave it the way it is,” he said, referring to companies that have canceled plans to move or expand businesses in the state as a result of the law, which bans transgender individuals from using a bathroom that does not match their gender at birth.

“There have been very few complaints the way it is. People go. They use the bathroom that they feel is appropriate,” Trump said. “There has been so little trouble. And the problem with what happened in North Carolina is the strife and the economic — I mean, the economic punishment that they’re taking.”

It’s nice to see Bruce Springsteen and Donald Trump on the same page, isn’t it? Unity!

    A nominal male and a nominal female happen to be in the same bathroom at the same time. The nominal female declares the nominal male to have “sexually assaulted” “her”, possibly by looking at “her” the wrong way. Or maybe a third party decides some sort of action took place that can be labeled “sexual assault” under the modern, generous definitions.

    Given how various authorities, especially college administrators, have handled accusations of sexual misconduct, will any male dare to enter any bathroom with more than one stall/urinal?

    Reported as fact, as an aside. The law does no such thing. It says that school districts and state agencies must allow people to use those multiple-occupancy facilities, and only those multiple-occupancy facilities, matching the gender listed on their birth certificate: and for people who have had sex changes that gender on their birth certificate has been changed. It is not what they were born with.

    Furthermore, no business is banned from accommodating transgendered people in any way they wish.

    There was an incident (I read there was, anyway) where some young adult male used the women’s locker room in some facility in Washington state after a new law, at least one woman complained, and the guy said, “Hey, it’s the new law”, and proceeded along his merry way.

    And nobody else, except for a school district, or a state agency that either employs or deals with the same people a lot, would know what is on a person’s birth certificate.

    This can only have applicability where you are dealing with repeated use. Or does the law deal with the possibility of an after the fact investigation?

    which fact is not getting into the stories. Nor is it getting into the stories that sports stadiums or racetracks are free to have any policy they want. In most places that have bathrooms it is one person in a bathroom at a time. You only get multiple use bathrooms where there are large numbers of people in a building at a time.

Last week, I tweeted to whiny Apple CEO Tim Cook the news that the People’s Republic of China threw out a court challenge to the nation’s firm stance against same-sex marriage. “Guess iPhones can’t be made there anymore!” I wrote. But GOP governors haven’t even mastered that simple act, as we’ve learned from Asa Hutchinson and Nathan Deal. In 2015, I was hoping that a conservative supposedly as solid and articulate as Mike (Heavens, No!) Pence would verbally carve up the hypocritical C-levels (such as pompou$ Salesforce CEO Marc Benioff) who have no compunction about dealing with oil-rich nations that still imprison LGBT people (much less allow them to order a same-sex wedding cake) while they, at the same time, take steps to injure the economy of American states that still recognize the right not to be compelled into speech that violates your sincere religious beliefs.

    In their cases — to be charitable — it’s a combination of cowardice and taking the path of least resistance. If you’re really cynical, you might think that they felt that they had to make a pretense of addressing the issue, knowing they would be forced to back down by outraged business interests. Then, come re-election time, they can tell the true believers in religious liberty “I did the best I could, but…”

    Trump, OTOH, doesn’t even have a clue. He apparently thinks he won’t have to get one until he wins the top job through the sheer force of his gargantuan personality, and even then he can borrow others’ competence and stamp it with his gold lame “T.”

    I opposed the Houston ordinance because it was basically an expanded version of the Civil Rights Act of 1964, which would create just as big a change in the legal landscape, but at a municipal level via a newly created set of bureaucrats and administrative law judges. The protected classes were so amorphous — including but not limited to gender self-identification issues — that it would have been very hard to find a Houstonian who didn’t at least arguably fit into one of them. (I would have been a “beneficiary,” for example, of sweeping new age-discrimination rights in my employment and housing. I’m also a lawyer, and lawyers were going to make out like bandits, at the expense of both the city taxpayers and the small businesses who were going to end up as defendants.

    I’m a federalist, though, so I’d leave it to states and their political subdivisions (counties, cities) to decide on whether to enact such law. As a Texan, frankly I’m thrilled for cities in New York and California to pass municipal-level sweeping legislation like this: It makes Texas, by contrast, a wonderful relocation destination for businesses and individuals fleeing the nanny states.

I couldn’t disagree more strongly, because nothing would better play into Trump’s hands as he continues his demagoguery. Priebus and the rest of the RNC officers and staffers must be purer than Caesar’s wife, and, like she, they must also be seen as such.

    Today’s result confirms that regardless of their merits, all sorts of existing rules, traditions, and procedures — as they’ve historically been observed at prior Republican national conventions dating back to the first one in 1856 — have now acquired a thick patina of legitimacy and about 100 times more inertia than in a normal convention year. The Romney Campaign’s decision to up the nomination threshold in Rule 40(b) from five to eight in 2012 got virtually no public attention outside of the Ron Paulbot camp; and that was entirely appropriate, because it was essentially a cosmetic change, one designed to better manage the convention’s primetime schedule by denying Ron Paul a nomination speech and the resulting hoo-haa that would have eaten up other time better spent. (By Clint Eastwood and his clair, for example.)

    But with this contested convention coming up, the spotlight is tightening lots of official sphincters — with the practical effect that it was essentially impossible for Kasich or other white-knight possibilities to use this RNC spring meeting to make the playing field more favorable for them at the convention.

    Re dildos: The Georgia dildo possession statute was upheld by the Eleventh Circuit in 2007, a year before the Fifth Circuit ruled on the Texas dildo statute. When the Fifth Circuit, relying on Lawrence v. Texas and its vile substantive due process doctrine, struck down the Texas statute, that ruling created a “split between the circuits,” as the Fifth Circuit panel directly acknowledged.

    If you’re trying to persuade the SCOTUS to grant a petition for certiorari, one of the most powerful arguments is that SCOTUS clarification is essential to resolve such a split. Thus, Cruz and his boss, then-Attorney General (now-Gov.) Greg Abbott, knew that they had an excellent chance to get another chance at upholding the Texas statute. But they made a deliberate decision not to seek SCOTUS review.

    Why? Because Ted Cruz could count heads and read opinions — and he realized that in the long run, the Constitution would be better served by minimizing the chances that Anthony Kennedy has to expand substantive due process. Yes, Texas could have probably gotten the SCOTUS to take the case — but then, as ended up happening on SSM over a decade later — Kennedy’s swing vote would have inevitably ended up in the split being resolved by overruling the Eleventh Circuit and affirming the Fifth Circuit decision striking down the statute.

    Keep in mind that the Texas dildo statute only criminalized possession with intent to sell, such intent being rebuttably presumed from possession of six or more dildos by one person. Except for sex toy store proprietors, most Texans were well enough satisfied with five or fewer, but there just wasn’t a great public outcry to criminalize dildos, not even by the dozen. Simply put, fighting to uphold this statute just wasn’t worth the greater risk to the Constitution by handing another case like this to Justice Kennedy.

    This is another example of how Ted Cruz was fighting in the SCOTUS for your constitutional rights more than a decade before anyone in the general public (outside Texas, and mostly even within) even knew his name. This is another example of why I am so confident that I can predict how he would behave as president.

    PS: You can still, to this good day, go to jail for dildo crimes in Georgia, where that Eleventh Circuit decision is still ostensibly good law. (Or at least as “good” as Lawrence and Obergfell.)

    PPS: Under then- and current policy and tradition within the Texas AG’s office, there’s a near absolute requirement to defend any Texas statute against constitutional challenge in the federal courts at least through an opinion on the merits at the U.S. District Court level, and it would be rare not to appeal adverse decisions at least to the court of appeals level — regardless of whether the AG’s office or its lawyers believe the statute is “wise” or “prudent.” But there’s no obligation to ask for SCOTUS review, and there are many, many precedents of state AGs exercising their discretion in deciding not to seek further review — albeit few in cases where there’s a split between the circuits.

I believe I related here, in comments somewhere around the end of February, the story about Ted Cruz which was told to me by the spouse of a former colleague of mine, over dinner at another friend/colleague’s birthday party. All of these folks are life-long Democrats whose hearts were for Bernie but who’ll bite the bitter pill and vote for Hillary, but we argue politics with passionate respect, which is part of why their all dear friends. For convenience, I’ll call my friends Agnes and Larry for purposes of this re-told tale.

    Agnes & Larry have a very bright, accomplished, and politically conscious daughter who’s a sophomore at an eastern (non-Ivy, but good) university. But when she was a senior in high school, she was their town’s representative at Girl’s Nation in Washington, as part of which the students get to meet and shake hands and get photographed with the POTUS (Bill Clinton got his photo with JFK that way), and they also get to meet their home-state Senators and home-district Congressmen. Cruz had just come to the Senate, so Agnes & Larry’s daughter, whom I’ll call Zoe, was part of the group waiting to meet & greet Sen. Cruz in some Capitol conference room.

    But Cruz was already something of a celebrity on the Hill, and so there were also a lot of other Girl’s Nation delegates from other states who’d come to meet Cruz. And in the press of the crowd, Zoe never quite got close enough to speak to Cruz, and (sez Agnes, relaying Zoe’s story) Cruz, trailing staff, was literally walking out the door to his next appointment when Zoe piped up: “Hey, I’m from Texas, and I didn’t get to meet you, Sen. Cruz!” Whereupon Cruz executed a sharp about-face and went directly to Zoe, and then sat down across from her. He gave her 15 minutes of his undivided attention. Zoe said they agreed on nothing of substance, but she was nevertheless extremely taken with how focused he was, what a good listener he was, how what he was saying to her responded to what she’d said to him (rather than being a campaign speech).

    “It terrifies me to think he might win,” Agnes told me, “But it’s impossible to hate him when he’s been that magnificent to your little girl.”

    Now, Cruz no longer has the luxury to spend a quarter hour with a constituent like that. But he can personalize a pitch brilliantly as part of a conversation. Zoe was a tougher audience than anyone he likely met today in Hollywood, FL.

    BTW, when I observe certain Republicans saying that Trump will be worse than Hillary, which, in effect, means they think Hillary will be better than Donald, I’m never quite sure if what’s fueling that sentiment is their being more liberal than they let on or are willing to admit. Kasich-type Republicans immediately come to mind—or their grimacing not at Trump’s squishiness but at what most people probably deem as generally conservative impulses. His rhetoric on immigration, nationalism and national defense (whether sincere or not) is definitely not associated with left-leaning sentiments.

    By contrast, a disdain of Trump because of a suspicion he’s a closeted liberal is a perfectly valid reaction.

    Trump had nothing to say about paying down the debt. He instead wants to talk about which bathroom you can use.

    Texas is big on balancing its budget, because of our Texas values. For millenia this issue hasn’t been an issue until folks like Trump decided it was good for getting a little attention (let’s not pretend it’s for any other purpose).

    You aren’t a football fan. If you were, you’d know that the “Lucy and the football” metaphor doesn’t work if your intent is for the team to win.

    A better way to use football to make a point about Donald Trump: Nominating him would be the equivalent of drafting Johnny Manziel.

    That “old biddy” – Phyllis Schlafly – is a true American heroine. Unfortunately, she’s lost her marbles in her waning years, and not only has endorsed Trump, she’s gone on a truly ridiculous rant about Major League Baseball teams giving American jobs to foreign players. It’s this society becoming so liberal and so increasingly desensitized (or dumbed down) over what would have disturbed — or shocked — the average American years ago, that nothing seems too absurd (or as much of a traditional slur) anymore. It’s gotten to the point where calling someone gay or transgendered (and using the forms of those words in order to repudiate) has lost quite a bit of its original impact and meaning. The same thing has happened to the words “racist” or “racism,” but in a different way.
