President Obama and Speaker Boehner: ‘Let Her Rip’
[guest post by Dana]
Today in Austin, the president “let her rip” taking aim at Republicans pushing impeachment or threatening to sue him. According to the president, because he isn’t running for office again he can pretty much say whatever is on his mind:
“‘Sue him! Impeach him!’ Really? For what? You’re going to sue me for doing my job?” Obama said. “I mean think about that — you’re going to use taxpayer money to sue me for doing my job, while you don’t do your job? Huh.”
Coincidentally, Speaker Boehner announced today that after the House of Representatives passes a resolution giving itself authorization to sue President Obama, it will then “file suit against the president over his delay of the implementation of the Affordable Care Act’s employer mandate”.
In 2013, the president changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it. That’s not the way our system of government was designed to work. No president should have the power to make laws on his or her own.
As I’ve said, this isn’t about Republicans versus Democrats; it’s about the Legislative Branch versus the Executive Branch, and above all protecting the Constitution. The Constitution states that the president must faithfully execute the laws, and spells out that only the Legislative Branch has the power to legislate. The current president believes he has the power to make his own laws – at times even boasting about it. He has said that if Congress won’t make the laws he wants, he’ll go ahead and make them himself, and in the case of the employer mandate in his health care law, that’s exactly what he did.
Boehner said the lawsuit was “borne of an obligation to stand up for the Legislative Branch.”
The current president believes he has the power to make his own laws — at times even boasting about it. He has said that if Congress won’t make the laws he wants, he’ll go ahead and make them himself, and in the case of the employer mandate in his health care law, that’s exactly what he did. If this president can get away with making his own laws, future presidents will have the ability to as well.
The White House called this a “political stunt” and a waste of taxpayer dollars. No comment, however, about any other seeming political stunt and waste of tax payer dollars.

dan (b4bbe4) — 7/10/2014 @ 6:26 pmGovernors should exercise the same authority as obama and refuse to accept the ruling of federal judges that over rule the vote of their state citizens. If it is ok for obama to ignore law it should certainly be ok for states to ignore federal courts.

Without control of the Senate, I do not know how the House Republican majority can unfund anything which has already been appropriated and passed by both Houses …
Going forward, the House can decide not to fund specific programs – and what is likely to be the result of that ?
If the Senate changes hands in November, then the House can more reasonably work through the defunding of specific things, by having that explicit wording in future Budget Bills – and, once passed by both House and Senate, Pres’ent Obama is then forced to sign or veto as I understand it …
Prior to regaining control of the Senate, what can usefully be done by the House Republicans ?
