Obama Administration Will Sue Arizona

Filed under: Immigration — DRJ @ 2:58 pm

[Guest post by DRJ]

Hillary Clinton was right. President Obama’s Justice Department announced it will sue to overturn Arizona’s new immigration law:

“Administration officials initially would not confirm Clinton’s statement. But an official told Fox News on Friday that while the review is still underway, the decision has already been made that a Department of Justice suit will be filed. The administration at this point is just building its case.”

I’d wager the Obama Administration made the decision to sue on the day the Arizona immigration law was signed into law.

  1. He’s gotta be counting on voter fraud with illegal immigrants, otherwise he’s just baiting the conservatives to run to the polls in droves.

I hear the thunder of little feet hurrying through the rain forest now.

  3. It just blows my mind that Arizona is being so steadfast and strong in the face of this, yet the best man they could find for the past eon to represent them was John Mccain.

The impression I get is that these nutcases were in the Clinton administration too, but someone shut them down before they did something insane, at least half the time. No leader in the current admin will do that.

  4. Parts of Arizona are off-limits to US citizens because armed and hostile foreign nationals occupy the land, and he’s going to sure Arizona?!?!

I think by definition that’s an impeachable offense, and one on which he should be found guilty.

I wouldn’t be surprised if there is an injunction against Arizona’s law, on some technicality that avoids the main issue.

I wonder if the founders ever thought there could be a president so derelict in his duties but also above impeachment because of party loyalty. I thought stuff like this happened only in societies where all the officials were bought off crooks, then again…

  5. Perhaps Arizona should counter sue the federal government for failing to secure the border. Seems to me Arizona would have the stronger case.

  6. Ironically, the more the President pushes back against Arizona, the more fiercely determined Governor Brewer becomes. His shameful decisions are bringing out the best in her.

  7. The Constitution requires the federal government to protect states from foriegn invasion.
Instead they close US territory to US citizens because it is too dangerous because they refuse to take on illegals.

  8. AZ should pull a Nye County, and send their State Police, and County Sheriffs into Federal areas to enforce the State & Federal Immigration Law,
and when confronted by Federal officials, place those officials under arrest for interfering with an officer in the performance of his duties.
Then, confine them in one of Sheriff Joe’s Tent Cities – after issuing them the requisite pink skivvies.

  9. This is SOP for that SOB, Barry. The only solution to any problem is to send in the lawyers. He knows no other way to proceed. A smart Prez, especially one seeking a second term with the dire approval rating of Teh Won, would have seized the day. In response to the AZ law, a smart man would have placed many thousands of armed guards or troops on the border. It is what 70% of the country demands. However, he is hell bent on running this country in to the ditch. As I often say, from Barry’s perspective, this is all go to plan and quite swimmingly so.

It is always about outcomes with progressives/socialists/liberals. The hell with the means or facts.

  12. Ed Morrisey has some optimism,

Governor Jan Brewer blasted Obama and his administration for their handling of this policy direction. I agree, but perhaps she can take comfort in it. After all, an administration this inept is unlikely to successfully walk and chew gum at the same time, let alone challenge the validity of their new immigration-enforcement law. Meanwhile, Obama will continue to pursue a policy that is even less popular than his ObamaCare bill, just in time for the midterm referendum on his first two years in office.

  13. Since Holder could not explain the Arizona law when asked, I don’t see much chance of success unless they can get it tried in San Francisco by the Prop 8 judge.

  14. You know, if the governor were to use state money to explain things to the people of Arizona – and in particular to put in nicely persuasive ways (like that contrast of AZ citizens being unable to go to some areas because of alien invasion) it would turn AZ into an even deeper red state, and would bleed over into other parts of the country. It would be a real freebie for conservatives – just like the dems are constantly doing – and there would be nothing wrong with it since it would simply be upholding AZ law.

  15. John King said his CNN sources said the DoJ has to wait for the law to go into effect and “examples”. What do you think they are planning? If they’ve already let it be known they’ll sue, they have to make sure there are stories, right?

And yeah- there’s no reason our Secretary of State needed to know the DoJ was planning to sue. They would have told her specifically, possibly so she would spread the word to our Southern neighbors.

  19. Just a thought:
If they find one, and make any material promises to that plaintiff, would they be guilty of the same crime that sent Mel Weiss and Bill Larach to the Federal slam?

  20. The Obama regime refuses to take any action against the New Black Panther Party for its obvious voter intimidation but it immediately attacks Arizona for protecting its citizen from a foreign invasion. This is the most racist administration since Wilson.

  21. OF COURSE they made the decision to do this on Day 1. It isn’t like they bothered to stop and read the thing first, ya know.

Oh, and what a SCHOCKA to discover that Obama has no respect for states rights.

I also wonder if they’ve ever read the First Rule of Holes.

  25. I agree with Geraghty on this one. The people who will be angry about sueing Arizona are already energized and will oppose Obama and the Dems. This will not significantly add to that anger or effort.
This is throwing raw meat to his own base in an effort to get them engaged.
