  2. Principals are ultimately responsible for the safety of the students and faculty – whatever decision he or she was going to make – itd going to be extremely unpopular

  4. If I understand right, CA law says that the American flag has to be flown outside all schools there. So, clearly the administration owes the Hispanic students yet another apology for the outrageously racist nature of the lack of an exception in the law for Cinco de Mayo.

    To defend himself, the principal will have to insist it was reasonable.

It’s one of the oldest principles in First Amendment jurisprudence, most often seen in Nazi and Klan march cases: You don’t deprive somebody of his freedom of speech for fear of violence against him from a second party. You protect him from that second party. The Court, in the Bong Hits for Jesus case, declined to adopt Thomas’s in loco parentis view, which is the only other possible legal justification for the principal’s actions. And the American flag, in America, is I hope not disruptive and counter-educational like Bong Hits for Jesus arguably is.

  8. It is funny, in a sad way, that these students think Mexico would be so loving of them.

    The truth is, very few of them would be allowed in a Mexican high school. While education is ‘free’ in Mexico, you must have a uniform (which is precise to the types of socks you wear) to wear daily, your own supplies for school (which is determined by the school, generally) and proper respect for ‘el profesor’ (which for the most part is completely arbitrary). With the usual exceptions for the Kennedy-like aristocracy, the vast majority of students that do go to school in Mexico have to work HARD to stay there.

    The Mexican students don’t have a problem. Did you see any of them inconvenienced?
    We have the Mexican students and, if the prinicipal is right, we have the problem.
    So this is going to be tricky–for the principal.
    He has to slag the Mexican students in order to defend himself. His defenders–who will probably be mostly liberals–will implicitly sign on to the slagging in order to promote their real objective–discrediting the American flag. Tangled web and all that.
    I think there’s a pretty high probability all of the clown shoe posse involved in this is wishing it would go away. They have no good answers.

  13. It reminds me of how, just after 9-11, some students were told they were not allowed to wear anti-bin-Laden shirts on the theory that it might offend muslims. And part of the response was, “why do you assume that muslims would sympathize with bin Laden?” In other words, that assumption was bigoted in and of itself.

    Why shouldn’t Cinco be called an American holiday? They are always saying that we benefitted from the victory.

    I say if anyone is offended by an American flag, we should immediately demand proof of citizenship and deport them as appropriate.. its possible to be an American citizen and profess to hate the country that keeps you safe and free, but it raises a reasonable suspicion.

  15. Get real. Mexican gangs are the worst of the worst and they dominate all campus life wherever they are. If you insult a Mexican (Hispanic ha ha ho ho) expect an armed response by at least six of his friends. And EVERYTHING insults them when they choose to be insulted. Provocation? Those are Mexican kids not Hispanic; their loyalty is to Mexico City and not Washington D.C., they hate us and want this to be Mexico with U.S. living standards. I’d have pulled those kids aside too and told them to get rid of the flags or probably be killed in a few days. That’s life among the Mexicans.

  17. Howard, I lived in Anaheim. I had Samoan neighbors who went back to back at the Jr. High School on Ball Ave to beat the crap out of a Mexican gang. The gang tried to intimidate the family, but the family ignored them and I and a few neighbors confronting them with shotguns changed their minds.

    about 20 years ago, the supreme court said you had a right to burn the flag. now apparently you can’t wear it. How could that possibly be the rule?

    And on the other hand, over 20 years ago, your tax dollars went to subsidize the Piss Christ. And liberals thought that was freedom of speech. But comedy central is bullied into censoring the mere image of mohammed–not a disrespectful image, mind you, just the image. And too many of the same people who supported the piss christ at taxpayer expense, don’t care about this real supporession.

    as for the kids punished for patriotism, yeah, let’s see what happens when a jury gets a hold of this one. i am not big on suing people, but this is definitely an exception. They should be sued for violations of the students’ civil rights.

  20. I have never liked our flag, anyway. Kind of kitsch if you know what I mean. All those stars, all that red. What’s wrong with a little puce and teal? Those primary colors are an anti-gay statement as far as I’m concerned.

  21. What this tells the students is they have a right to get violent if they are offended, and their adult superiors must make certain any offense is squashed so they don’t get out of control, and beat the crap out of their fellow students.
    It also tells the students that whatever the powers that be determine is offensive and may reasonably cause agression, is to be banned or punished.
    I think a good lesson would be anyone who attacks another because of their t-shirt gets booted.
