The Teen Who Can’t Go Home, Goes Home

I posted last week on the 13-year-old boy who ran away to Mexico with his teacher but was unable to re-enter the US and go home to Nebraska because he is an illegal immigrant.

The US government announced the boy may be eligible for a new U Visa that lets victims of sex crimes and their families start a path to citizenship:

“A 13-year-old illegal immigrant who fled to his native Mexico amid a sex scandal with his schoolteacher could be eligible to return to the United States under a new visa the U.S. government started granting the week before he disappeared.

The visa helps illegal immigrants who are victims of sex crimes. If the boy, who spent most of his life in Nebraska, qualifies, he could stay legally in the United States for four years and eventually apply for permanent residency. It also would extend temporary residency to his parents and his unmarried siblings under 18, if they applied for it.

“It’s a win-win,” U.S. Citizenship and Immigration Services spokeswoman Marilu Cabrera said of the so-called “U” visa. “It helps us and law enforcement be able to solve a crime, and it certainly helps the individual who is a victim of a crime.”

The boy has said he is willing to return to the US to testify against Peterson. That should make an interesting cross-examination: What did you and your family gain from your testimony against my client?

  1. In this case, the facts are so clear it isn’t going to make a darn bit of difference. She should plea it out. The jury’s gonna hate her.

  2. I’m sure some will disagree with me but I think the U visa is a good thing. It is long overdue that we crack down on the sex trafficking trade and Bush has done that. The cases we see on 20/20 or other similar programs usually involve women brought here illegally. They have no place to return to with the stigma of their experience.

    I hope the boy is prepped to answer “Well after my family was enticed to come to America to work for sub minimum wages in order to beef up the profit margin of greedy American businesses I was molested by an American teacher. Once that happened my statement was taken and I was initially refused re-entry and my family was deported. Now I am being offered a legal avenue to become a US citizen and you are questioning my motives. Do you think I planned to be molested?

  4. The visa gives the happy couple the opportunity to become reunited. We could have a fairy tale ending a la Mary Kay LeTourneau. She gave birth to the first of Villi’s love children when he was 14, I believe, before being sentenced to seven years in the slammer.

  6. There are several saveguards built into the U-Visa and T-Visa programs. While the cases are being investigated the victims are offered only “public benefit parole” into the country and “continued presence” authorization. If a criminal case is filed and the victims are certified — a factual determination made not by the prosecutors but by a special office of ICE, based on factual submissions made by the prosecutors and the investigating agents — the victims then get either U or T-Visas, depending on the crime. All that gets them is a green card which allows them to work and remain in the country for 4 years. During that time they can apply for permanent resident alien status, but are evaluated on the same basis as any other applicant.
