Daily Kos Strikes A Small Blow For Freedom In America

Yes, you heard that right. Little Green Footballs concurs. A broken clock is right twice a day….yadda yadda yadda.

I witnessed the same nonsense first hand about three years ago. Can’t we get damages from those who file frivolous FEC complaints in order to harass political opponents?

    The time between ‘initial ruling’ and ‘overturned by state Supremes’ happened to include the actual month of the election. Such that I912 failed. (Polling showed it going south at essentially the same time their plug was pulled.)

  3. I don’t think the charge was frivolous. How hard would it be for dKos to separate its political organizing/activism out from its editorializing/newsgathering?

    It would be easy for the court to tell dKos, you have two options:
    1: full disclosure in compliance with our (unconstitutional) campaign finance reform laws; OR
    2: stop posting materials encouraging meet-ups/protests/gatherings at specific locations. Stop posting material asking people to sign up to volunteer for or give money to specific candidates.

    I think the CFR laws are unconstitutional, but why should we accept that the FEC only enforces them half-assed? That just means they are enforcing them selectively, and at any time they could enforce them to their full extent against anyone. If we let the FEC half-enforce these laws, we’re giving it the power to discriminate.

    The only good solution is for Congress to repeal or the Supreme Court to strike down these unconstitutional laws.
