I would be doing the same if I had to hear that case. I predict a $420 fine with no jail time.

  3. I agree with NK. When I graduated from law school, drug use was a serious obstacle to getting a bar license. Now judges smoke pot in the park.

  5. Being the sick individual that I am, I speculated on just how the officers “field-tested” the cigarette for marijuana.

    But it seems to me that we have lost, lost, lost the war on drugs, if a sitting judge can think the offense so unserious that he’s be sitting under a tree in a public park, burning one, and that the cops treat the violation as seriously (or less so) than a traffic violation.

  6. Dana: this depends on the state. I have no idea what the seriousness of the offense is in Florida, but in California, it’s an infraction (eg, less serious than a misdemeanor).
