When Depositions Go Bad (plus: Sodablogging IV!)

Many people choose a legal career out of some sort of personality defect that renders them unsuitable for civilized society. One of them appears to be billionaire trial lawyerJoe Jamail.

Think about all these unpleasant legal proceedings you could face the next time you open a can of Diet Coke, although if you enjoy that saccharine-tainted swill you probably deserve a pretty good caustic spritzing.

  1. It takes a special person to be willing to file a lawsuit that screams “I’m dumber than the average bear!”

    Oh, and the deposition is awesome. I love the 3rd grade nature of it: “I’ll do what I want!” “The hell you will!” Sweeet.

I only skimmed it, but as I read the opinion, they are saying the failure to warn came not from the potential for fizziness, but from the potential for eye damage based on the chemical composition of the soda. I.e., people expect to get Coke in their eyes; they don’t expect that Coke’s chemical composition is that dangerous.

  3. I have no respect for Joe Jemail since I read the book on the Texaco/Pennzoil “war” over Getty Oil. Then nicest thing ever said about Jamail is that he can only multiply by a third (to get his fee).

    I forget how close a relative of murdered Lebanonese Prime Minister Gemail Joe is but it was a close relation.
