Rehnquist Not Retiring

Rehnquist says that he is staying as long as his health holds out.

Part of me says: Good for him! Another part of me says: Just make sure you retire well before Bush leaves, Chief. I’m not sure we’re getting a Republican next time.

  4. Part of me says, “Mr. Rehnquist is deliberately doing a lot of people a favor here, by ensuring that SDO’s replacement is nominated, and probably confirmed, before he retires.”

    Just not sure if he’s doing this on Bush’s request, or on his own.

  6. I don’t think it’s in Rehnquist’s power to stay on that long. I also don’t think this is a particularly good idea, as the chance that the court is 4-4 on important issues next term increases. Where that has to do with overturning certain precedent (e.g. partial birth), which the lower courts will have followed, it will be unfortunate.

  7. Actually, it benefits a change to a conservative court if Rehnquist holds on for a while.
