New York Times: FBI Investigated Whether Trump Worked for Russia

Filed under: General — Patterico @ 12:57 pm

I guess it makes sense now that Rosenstein appointed a special counsel, huh?

In the days after President Trump fired James B. Comey as F.B.I. director, law enforcement officials became so concerned by the president’s behavior that they began investigating whether he had been working on behalf of Russia against American interests, according to former law enforcement officials and others familiar with the investigation.

The inquiry carried explosive implications. Counterintelligence investigators had to consider whether the president’s own actions constituted a possible threat to national security. Agents also sought to determine whether Mr. Trump was knowingly working for Russia or had unwittingly fallen under Moscow’s influence.

The investigation the F.B.I. opened into Mr. Trump also had a criminal aspect, which has long been publicly known: whether his firing of Mr. Comey constituted obstruction of justice.

Agents and senior F.B.I. officials had grown suspicious of Mr. Trump’s ties to Russia during the 2016 campaign but held off on opening an investigation into him, the people said, in part because they were uncertain how to proceed with an inquiry of such sensitivity and magnitude. But the president’s activities before and after Mr. Comey’s firing in May 2017, particularly two instances in which Mr. Trump tied the Comey dismissal to the Russia investigation, helped prompt the counterintelligence aspect of the inquiry, the people said.

The special counsel, Robert S. Mueller III, took over the inquiry into Mr. Trump when he was appointed, days after F.B.I. officials opened it. That inquiry is part of Mr. Mueller’s broader examination of how Russian operatives interfered in the 2016 election and whether any Trump associates conspired with them. It is unclear whether Mr. Mueller is still pursuing the counterintelligence matter, and some former law enforcement officials outside the investigation have questioned whether agents overstepped in opening it.

Of course, it’s absurd to think that Trump was in contact with the Kremlin, and no evidence has emerged of that. In fact, not a scrap of evidence has come out that anyone even connected to Trump was in secret contact with Kremlin officials, with the following small exceptions I typed from off the top of my head:

  • Trump’s campaign manager gave internal polling data to Konstantin Kilimnik, whom Mueller has described as someone who has “ties to a Russian intelligence service and had such ties in 2016.”
  • Trump’s campaign manager, son-in-law, and so met with a Russian operative to get dirt on Hillary Clinton. That operative has since been indicted for obstruction of justice, for her secret collaboration with the Russian prosecutor general, Yuri Y. Chaika, on behalf of a ompany run by a Putin-connected Russian oligarch.
  • Trump’s personal lawyer and fixer contacted “Russian Official 1” (Dmitry Peskov, Putin’s Press Secretary) regarding a Trump Tower Moscow proposal.

With the exception of these contacts, and probably a few dozen others that are not occurring to me off the top of my head, there is no reason to think that Trump’s people had anything to do with Russia. And anyway, Trump himself says so:

And Donald Trump is a fearless truth-teller.

The Deep State strikes again. They are the true enemy of the American people.

Yep, sure does. Nobody should go without insurance.

“You and I both know the odds are nothing. If I thought it was likely I’d be there no question. I hesitate in part because of my gut sense and concern there’s no big there there,” Peter Strzok, who then served as deputy chief of FBI counterintelligence, wrote to FBI lawyer Lisa Page on May 18, 2017.

  11. The NY Times piece feels more like a long recap than a big revelation. I’m sure the FBI was alarmed when Trump sacked Comey “because of Russia”. Also, the concept that “obstruction is the collusion” doesn’t make sense to this non-lawyer brain.
It’s regrettable that this was reported by Soros-funded hacks, but the 101 contacts between the Trump orbit and Putineers are both suspicious and unsettling. I doubt that any other country, not even China, had more contacts with Trumpeteers over the same period. Also unsettling is that Trump has still not said one critical thing of Putin exclusively.

Though exactly what law was broken is curiously left out, I can tell such contacts provoke deep concern and disquiet — evidenced by the repeated mention of the golden showers dossier in the same breath, and all the hand wringing about that. LOL

The investigation goes on and on, really for one reason: So that when congressional committees want to probe, “sorry, there’s an ongoing investigation” serves as the perfect rebuff — used to great effect by Comey, Stzrok, Page, etc. And altNeverTrump swallows it whole.

Neither is good is a good look…

You’d think we’d see the traitorous smoking gun by now…as, I don’t think you’d have Mueller do his 2yr investigation while holding such smoking gun.

If the FBI opened a counter intelligence investigation after Comey’s firing…without any elected official/appointed oversight. We’re going to have fundamental issues in trusting our government, moreso than the usual “never talk to FBI!!” screed.

  32. I’m waiting on Mueller’s report. Obviously there are things out in public that are a concern, but legal situations tend to be more complex than what would seem obvious on the surface.

The thing that always makes me side-eye though is that I remember the response when Mueller was first appointed. Based on his life-long history, everyone. EVERYONE. pretty much agreed he was the right guy, though some of the more liberal people were somewhat concerned about his status as a Republican. Then, when he didn’t immediately dismiss the concerns, some of the more, um, fervent of Trump’s supporters started to vilify him. This does not lead me to believe that he isn’t a good investigator, it leads me to believe that some people don’t want a real investigation.

  38. “Eight years after its informant uncovered criminal wrongdoing inside Russia’s nuclear industry, the FBI has identified 37 pages of documents that might reveal what agents told the Obama administration, then-Secretary of State Hillary Clinton and others about the controversial Uranium One deal.

There’s just one problem: The FBI claims it must keep the memos secret from the public.

Their excuses for the veil of nondisclosure range from protecting national security and law enforcement techniques to guarding the privacy of individual Americans and the ability of agencies to communicate with each other.

    Sound familiar?

It’s a lot like the initial reasons the bureau was reluctant to turn over documents in the Russia collusion investigation, such as former FBI agent Peter Strzok’s “stop Trump” texts or the revelation that Clinton and the Democrats funded the Steele dossier.

The FBI’s declaration and list of withheld documents – entitled simply “Uranium One Transaction” – were posted recently inside its Freedom of Information Act (FOIA) online vault.

The bureau actually released a handful of documents, but it wasn’t a big stretch of either freedom or information. It actually just released already public letters from members of Congress demanding answers in the Uranium One case.

I was the reporter who first disclosed last fall that a globetrotting American businessman, William Douglas Campbell, managed to burrow his way inside Russian President Vladimir Putin’s nuclear giant, Rosatom, in 2009 posing as a consultant while working as an FBI informant.

Campbell gathered extensive evidence for his FBI counterintelligence handlers by early 2010 that Rosatom’s main executive in the United States, Vadim Mikerin, orchestrated a racketeering plot involving kickbacks, bribes and extortion that corrupted the main uranium trucking company in the United States. That is a serious national security compromise by any measure.

The evidence was compiled as Secretary Clinton courted Russia for better relations, as her husband former President Clinton collected a $500,000 speech payday in Moscow, and as the Obama administration approved the sale of a U.S. mining company, Uranium One, to Rosatom

The sale – made famous years later by author Peter Schweizer and an epic New York Times exposé in 2015 – turned over a large swath of America’s untapped uranium deposits to Russia.

Mikerin was charged and convicted, along with some American officials, but not until many years later. Ironically, the case was brought by none other than current Deputy Attorney General Rod Rosenstein – a magnet for controversy, it turns out.

But the years-long delay in prosecution mean that no one in the public, or in Congress, was aware that the FBI knew through Campbell about the Russian bribery plot as early as 2009 – well before the Obama-led Committee on Foreign Investment in the United States (CFIUS) approved Uranium One in fall 2010.”

  54. The leadership of the DOJ wrote memos recommending that Comey be fired.

That’s not the full story. Trump asked Rosenstein to write a memo regarding Comey’s conduct, not that he be fired, and Trump then used the memo as a phony pretense to sack Comey. Trump had already decided to fire Comey regardless of any memo. Like with many who have done things for Trump, Rosy felt “used” (link). I’ll bet Cohen gets it.

  155. It’s all so obvious. After the collapse of the Soviet Union, Russia became a kleptocracy, governed by ruling oligarchs who laundered their money through corrupt banks and fraudulent real estate deals.

After numerous business failings, multiple bankruptcies, and hundreds of lawsuits (all settled, of course), Trump couldn’t find an American bank to loan him any money. So he turned to the one bank that would, Deustche, which not coincidentally had been convicted and fined hundreds of millions for . . . yep, you guessed it, laundering money for corrupt Russian oligarchs and kleptocrats.

Those same oligarchs and kleptocrats had been laundering money through casinos and making fraudulent real estate deals for years. Trump was their mark. He is not the conman everyone assumes him to be; he is the mark. The first rule of sitting at a poker table with sharks is, if you can’t identify the mark, you are the mark. It’s the famous line from Rounders–“You don’t see piranhas eating each other.”

Trump is a total fraud and a failure, deeply in debt. Some say “follow the money,” but it’s not about the money now; it’s about the debt. Trump owes serious money to dangerous characters. So does Manafort.

So, if you look at it, bankrupt Trump goes deeply in debt with a money-laundering bank, and hires as his campaign manager (for free) a man who is deeply in debt with the dangerous characters laundering money through the only bank that would give Trump a loan.

There are red (pun intended) flags popping up everywhere, all over this relationship. Follow the debt, the money owed by Trump, Manafort, Flynn, and who knows who else, to corrupt kleptocrats and the banks that launder their money, at casinos and in fraudulent real estate transactions.

    OK, how about 18 U.S. Code § 1114:

Whoever kills or attempts to kill any officer or employee of the United States or of any agency in any branch of the United States Government (including any member of the uniformed services) while such officer or employee is engaged in or on account of the performance of official duties, or any person assisting such an officer or employee in the performance of such duties or on account of that assistance, shall be punished—
    (1)in the case of murder, as provided under section 1111;
(2)in the case of manslaughter, as provided under section 1112; or
(3)in the case of attempted murder or manslaughter, as provided in section 1113.

Assuming you get over that hurdle, the short answer is that what you describe would be a manifest abuse of the Presidential office and impeachable as such.

If using the military to corruptly impede the investigation is a crime, then firing him to corruptly impede the investigation is surely also a crime.

But an Article III court must not entertain a criminal prosecution for that. To hold otherwise would be a grave Constitutional breach, IMO.

Which “penumbra” or “emanation” or similar argle-bargle (as Scalia would have called it…) makes the president immune from prosecution?

So the better inquiry is what is the threat to the Constitutional order that requires impeachment? Certainly not minor policy disagreements or minor military strikes. But impeachments have gone on throughout our history and they did not always include a crime: Judge Pickering was impeached for being intoxicated on the bench. Many such impeachment efforts have been prompted by behavior inconsistent with the responsibility or reputation of the office.

That’s why if Trump got himself seriously compromised by the Russians….through some backdoor financial dealings that he did not reveal to the American electorate….or some information quid pro quo that would have made him look bad….I would think it would be heading in the direction of impeachment. I would still think there would need to be another shoe that dropped….that the compromised position led to other ethically questionable decisions. Pat makes the headline TRUMP WORKED FOR RUSSIA, while the extremely fake and ghey strawman content is TRUMP WAS IN CONTACT WITH RUSSIA, the ol’ reliable Fake News Headline Inflation in the absence of actual news and evidence strikes again.

“Yeah, the FBI was in the tank for Hillary – that’s why their October surprise torpedoed her, while they kept all the dirt on Trump under wraps before the election.”

And by blaming nefarious right-wingers at the FBI rather than Hillary’s manifest laziness in assuming that every problem with her testimony would be taken care of internally rather than blowing up when covering it up started threatening careers, Dave puts the lie to any notion that he’s a Republican in a previous life rather than a Democrat operating under Democrat talking points while pretending at having been a Republican.

I’m not sure there is a distinction, but let’s suppose there is.

According to you, Comey, McCabe and friends engaged in a months-long conspiracy which included lying under oath to judges and falsifying warrant applications to collect dirt on Donald Trump…but they drew the line at anonymously leaking the information gathered to sympathetic journalists?

    LOL.

If they were too afraid to publicize the information so that it could, you know, actually have a chance of damaging Trump’s prospects…what was the point of breaking all the other laws they supposedly broke to collect it?

When the Constitution wants to grant immunity, as it does, for instance, in the case of Congress, it says so explicitly.

No one said the President is immune from prosecution. The issue is whether the exercise of presidential authority can be criminalized based on a court’s inference of the president’s “intent.”

The president had an absolute right to fire Comey if he believed he was incompetent, or thought someone else would do a better job, or for any other reason — even if everyone else in the country thinks otherwise. That is inherent in being in charge of the Executive branch. To allow a court to examine his motives and say, no, his real motivation was avoiding an investigation would open the door to criminalizing every presidential decision.

How about selling out your country so you can get the Nobel prize. Is that a corrupt intent that is subject to criminialization? Will courts now examination foreign policy decisions?

The Kremlin has long denied that it had anything to do with the infiltration of the NRA and the broader American conservative movement. A U.S. intelligence report reviewed by The Daily Beast tells a different story.
Alexander Torshin, the Russian central bank official who spent years aggressively courting NRA leaders, briefed the Kremlin on his efforts and recommended they participate, according to the report. Its existence and contents have not previously been reported.

So basically, there is no doubt that Putin tried to infiltrate and corrupt one of America’s most influential lobbying organizations, and the irony is that Vlad himself denies the right to bear arms for his own citizens.

The NRA leadership had no business going on junkets to Moscow. If there was a Putin-friendly lobbying organization to corrupt, the NRA would’ve been it. “(CNN)In the chaotic aftermath at the FBI following Director James Comey’s firing, a half-dozen senior FBI officials huddled to set in motion the momentous move to open an investigation into President Donald Trump that included trying to understand why he was acting in ways that seemed to benefit Russia.

They debated a range of possibilities, according to portions of transcripts of two FBI officials’ closed-door congressional interviews obtained by CNN. On one end was the idea that Trump fired Comey at the behest of Russia. On the other was the possibility that Trump didn’t have an improper relationship with the Kremlin and was acting within the bounds of his executive authority, the transcripts show.
James Baker, then-FBI general counsel, said the FBI officials were contemplating with regard to Russia whether Trump was “acting at the behest of and somehow following directions, somehow executing their will.”
“That was one extreme. The other extreme is that the President is completely innocent, and we discussed that too,” Baker told House investigators last year. “There’s a range of things this could possibly be. We need to investigate, because we don’t know whether, you know, the worst-case scenario is possibly true or the President is totally innocent and we need to get this thing over with — and so he can move forward with his agenda.”

Meanwhile, for normal people who’d occasionally like to see their will reflected through elections, the Stalinist tactics of “opening investigation, creating process crimes, and searching for technical but innocuous violations of abstruse laws” is far more concerning than the remote possibility of a President governing more like Abraham Lincoln and Andrew Jackson than Gerald Ford, even if it offends the foreign policy ‘consensus’ pushed by monied interests who have the most to lose from a more strongly nationalistic America.

  288. We can do just fine with only four other NATO members — Canada because they’re family, Poland as a tripwire, and Greece and Turkey for control of access to the Mediterranean. The rest can do an EU military alliance on their own dime.

  290. President Trump [yesterday] hosted the Clemson Tigers NCAA football championship team, and served them fast food in the Oval Office.

Trump said, the burgers were ‘piled up a mile high’… what does Politifact or the WaPo have to say, Paul?

  294. “what is this, 4th grade?”

Answer: “the Washington Post is swinging into “Zapruder-like analysis from The Post’s Philip Bump of all of the wire photos to determine just how many hamburgers were served at the event”

happyfact might say something like that, but happyfeet would’ve given Trump the benefit of the doubt on the burger-piling.

  296. Trump’s a genius. I will say that. The burger thing was terrific theater. He can say he loves saving the country money, no matter that his inauguration spent record amounts. Liberals will do their elitist jeering making them look mean and… elitist, and the regular kind of people who love fast food will say he’s one of them, and they are kinda right. Trump’s got that same populist appeal that Clinton and Obama had. The Clemson Tigers were apparently thrilled.

  300. Hopeless mainstream media left out the best part of the burger story.

According to stunned witnesses at the White House yesterday, President Trump somehow managed to feed an entire multitude with just five Quarter Pounders and two Filet-O-Fish sandwiches, miraculously multiplying the food until there was enough to go around for the entire Clemson football team.
Worried aides had rushed to Trump’s side and informed him there wasn’t enough food for the visiting national champions. “Go and ask if anyone packed a lunch,” Trump instructed them, but all they were able to find was a bag of week-old McDonald’s food in Trump’s desk.
Trump quietly knelt and thanked the Lord for the sack containing just five cheeseburgers and two fish sandwiches he’d stowed away in case he got hungry, blessed the food, and then told his aides to begin laying the food out on the table.
The White House staffers were shocked to find the sack continued to produce food, with more and more Quarter Pounders, Big Macs, fish sandwiches, fries, and McNuggets coming forth in a great bounty from on high.
“It’s a great miracle,” Trump told reporters. “The best. The old miracles in the Bible, they just had bread, no burgers.” He shrugged. “How do you eat bread without a fabulous McDonald’s patty and a little mayo? Sounds good, doesn’t work.”
At publishing time, sources had confirmed aides collected over 12 takeout bags of cheeseburgers, on which Trump quickly called “dibs.”
