Cohen Pleads Guilty to Lying to Congress About Trump Tower Moscow Project

Michael Cohen appeared to have been protecting Trump with his lies, which included covering up how long the Trump Tower Moscow project was discussed with Russians (deep into the general election season) and plans to have Trump travel to Russia to discuss the deal with Russian leaders. New York Times:

Donald J. Trump was more involved in discussions over a potential Russian business deal during the presidential campaign than previously known, his former lawyer Michael D. Cohen said Thursday in pleading guilty to lying to Congress. Mr. Trump’s associates pursued the project as the Kremlin was escalating its election sabotage effort meant to help him win the presidency.

Mr. Trump’s participation in discussions about building a grand skyscraper in Moscow showed how the interests of his business empire were enmeshed with his political ambitions as he was closing in on the Republican nomination for president. During the early months of 2016, when the business discussions were taking place, he was publicly pressing for warmer relations between the United States and Russia and an end to economic sanctions imposed by the Obama administration, policy positions that might have benefited his family business.

Court documents made public by the special counsel, Robert S. Mueller III, detailed new accusations against Mr. Cohen, the president’s former fixer, who already pleaded guilty this year to committing campaign finance violations and financial crimes. Mr. Cohen was the point person at Trump Organization for negotiating a deal for the Moscow project, and on Thursday he admitted lying to congressional investigators about the duration of the negotiations and the extent of the involvement of Mr. Trump — who is identified in the court documents as “Individual 1.”

Mr. Cohen said on Thursday that he discussed the status of the project with Mr. Trump on more than the three occasions he had previously acknowledged and briefed Mr. Trump’s family members about it. Mr. Trump and Mr. Cohen discussed Mr. Trump himself traveling to Russia after the Republican National Convention, though that trip never materialized.

You can read Michael Cohen’s unsealed plea agreement and (more interesting) the information against him here. The information charges that Cohen lied to Congress when he represented that the Trump Tower Moscow deal was over by January 2016 and that it was not discussed extensively with others in the Trump Organization. The information also alleges that Cohen lied when he said that he never agreed to travel to Russia to follow up on the project, and never considered asking Donald Trump (called “Individual 1” in the information) to travel for the project. The fact that Cohen has entered a plea agreement states that Cohen will agree to the truth of the allegations in the information as part of his cooperation.

Remember what I said here on March 29:

There’s really no scenario in which this plays out well for Cohen. We know that Robert Mueller is looking at some of Cohen’s involvement in Russia-related activities like Trump Tower Moscow. Mueller seems like a thorough guy, and if he runs across illegal activity by Cohen of any kind in the course of his investigation, he can at a minimum refer those matters to the Justice Department, and conceivably take them on himself.

Disbarment might be the least of Cohen’s worries at this point.

On August 29, I passed along the news that Michael Cohen had emailed Putin lieutenant and Kremlin press secretary Dmitry Peskov about Trump Tower Moscow. Peskov initially denied responding, but in a statement issued today he is telling a different story, and says the Russians did reply after all:

Oddly enough, and I feel weird saying this, but a BuzzFeed story from May 17, 2018 co-authored by (shudder) Jason Leopold appears to have gotten a lot of this right before anyone else did — in particular the extent to which Cohen had continued to push the Trump Tower Moscow deal months after January 2018, when (according to what Cohen had told Congress) the deal had supposedly been dead. Here is an interesting passage from that article:

[I]n a statement he released a week before he was scheduled to testify before the Senate Intelligence Committee last September, Cohen said the Trump Moscow effort “was terminated in January of 2016,” which Cohen noted was “before the Iowa caucus and months before the very first primary.”

But the venture did not end in January.

Sater told BuzzFeed News that he and Cohen had a conversation about setting up Cohen’s trip to Moscow to reignite the tower project. The next day, May 4 [2016], they discussed when in the presidential campaign Trump should take the extraordinary step of flying to a country at odds with the United States in order to negotiate a major business deal. Sater texted Cohen: “I had a chat with Moscow. ASSUMING the trip does happen the question is before or after the convention. I said I believe, but don’t know for sure, that it’s probably after the convention. Obviously the pre-meeting trip (only you) can happen anytime you want but the 2 big guys were the question.”

Cohen wrote back that day: “MY trip before Cleveland. Trump once he becomes the nominee after the convention.”

Sater: “Got it. I’m on it.”

The following day, Sater told Cohen that Peskov — the press officer whom Cohen had written to in January — “would like to invite you as his guest” to an economic forum in Russia. The country’s top government and finance officials would gather at the St. Petersburg International Economic Forum, Sater said, and Peskov “wants to meet there with you and possibly introduce you to either Putin or Medvedev.”

“The entire business class of Russia will be there as well. He said anything you want to discuss, including dates and subjects, are on the table.” He concluded, “Please confirm that works for you.”

“Works for me,” Cohen said.

Now the same reporters have a story today claiming that the Trump Organization planned to give Putin a pricey condo in the tower:

President Donald Trump’s company planned to give a $50 million penthouse at Trump Tower Moscow to Russian President Vladimir Putin as the company negotiated the luxury real estate development during the 2016 campaign, according to four people, one of them the originator of the plan.

Two US law enforcement officials told BuzzFeed News that Michael Cohen, Trump’s personal lawyer at the time, discussed the idea with a representative of Dmitry Peskov, Putin’s press secretary.

I find it very difficult to believe that Donald Trump did not know that Michael Cohen lied to Congress about all of this. Ken White, writing in The Atlantic, agrees:

The third remarkable thing about Cohen’s plea was its substance. The president of the United States’ personal lawyer admitted to lying to Congress about the president’s business activities with a hostile foreign power, in order to support the president’s story. In any rational era, that would be earthshaking. Now it’s barely a blip. Over the past two years, we’ve become accustomed to headlines like “President’s Campaign Manager Convicted of Fraud” and “President’s Personal Lawyer Paid for Adult Actress’s Silence.” We’re numb to it all. But these are the sorts of developments that would, under normal circumstances, end a presidency.

They still might. Cohen admitted that he lied to Congress to support President Trump’s version of events. He notably did not claim that he did so at Trump’s request, or that Trump knew he would do it. But if Cohen’s telling the truth this time, then this conclusion, at least, is inescapable: The president, who has followed this drama obsessively, knew that his personal lawyer was lying to Congress about his business activities, and stood by while it happened.

Meanwhile:

If they truly delve into Trump’s business or his taxes, I suspect they will find criminality.

A source told the Sun-Times the raids were in response to new allegations, and not prompted by any past controversies that have swirled around Burke. The FBI raided Burke’s Aldermanic offices, not his law offices. https://chicago.suntimes.com/news/ed-burke-fbi-federal-agents-city-hall-council/ Nothing to indicate that it has anything to do with Trump or any other client of his law office. It’s not the first time Burke has been under criminal investigation for his activities as Alderman.

They united to oppose Harold Washington, but they split up when Vrdolyak opposed Little Ritchie Daley, Burke’s “political cousin”.

    “The president said there was a proposal, it was discussed with Cohen, there was a nonbinding letter of intent and it didn’t go beyond that,” said Rudolph W. Giuliani, one of Mr. Trump’s lawyers, who with others negotiated the president’s responses to Mr. Mueller’s questions for nearly a year. He said prosecutors did not raise certain details that Mr. Cohen now says he misled Congress about — including how long the hotel project stayed alive — and that the president did not volunteer those details.

    Trump withheld material information about his business interests in Russia from the American people at a critical time during the campaign.
    As questions swirled around candidate Trump, his campaign associates and their potential connections to the Russian government, the Trump Organization concealed its outreach to the Kremlin on the Moscow Project. In July 2016, Trump told CBS News, “I have nothing to do with Russia. I don’t have any jobs in Russia. I’m all over the world but we’re not involved in Russia.” In January 2017, Trump said at his first major press conference as president-elect, “I have no dealings with Russia … I have no deals that could happen in Russia because we’ve stayed away.” He added, “We could make deals in Russia very easily if we wanted to, I just don’t want to because I think that would be a conflict.”
    Of course, even without the Trump Organization’s pursuit of a Trump Tower Moscow in 2016, Trump’s statements were easily disproved. “Trump repeatedly sought business in Russia as far back as 1987,” the New York Times reported. And more recently, Trump and his children had repeatedly sought Russian business partners to build a Trump Tower in Moscow.

    Concealing these efforts is not that different from paying off a porn star and Playboy model so that they would shut up prior to election day. Unpatriotic and un-American on Trump’s part, prioritizing his personal enrichment over the welfare of these United States.

    Does it register with you Trump supporters that Candidate Trump was smart enough* to know that people would question his business dealings with a kleptocratic regime which maintains a historical hostility to the US, but not smart enough to understand that there was good reason for people to question such dealings and not smart enough to understand that candidates for POTUS should use the Ceasar’s wife principle.

  14. Trump may not have lied to Mueller with his answers so that they match Cohens, but he has been lying to the American people for a couple of years. I can’t tell if he’s mad at Cohen for making that lie public or just for not being “loyal”.

    Also, which lies of Cohen’s did he match, the first lies to Congress, or the new lie (according to Donnie today) that he lied about lying the first time. Trump lies so much, his attorneys and he can’t keep the story straight minute by minute.

    Suborning perjury is the likeliest, meaning a charge that Trump encouraged or incentivized Cohen to lie to Congress. And there is no evidence publicly available that would provide actual evidence that he did so.
    Collusion per se would probably involve people not named Trump, meaning Stone, Corsi, etc. Trump’s personal criminality is likely limited to money laundering and fraudulent dealings previous to 2016.

    The Frankfurt headquarters of Deutsche Bank, which agreed to loan Trump as much as $640 million for the renovation of Chicago Trump Tower, was raided on Thursday. At a time when most U.S. banks refused to loan money to Trump due to his string of bankruptcies, that loan was signed off by former Supreme Court Justice Anthony Kennedy’s son, who loaned Trump more than $1 billion for various real estate projects before the elder Kennedy suddenly retired from the bench earlier this year. Both Deutsche Bank and prosecutors said the raid is related to the Panama Papers, and so far the president’s name has not been mentioned — except by way of speculation. According to a BBC report, the current investigation began in August and “focuses on activities between 2013 and the start of 2018.”

When the financial crisis landed in 2008 and imperiled that development, Trump sued Deutsche to avoid paying the $40 million he had guaranteed (claiming, in part, that Deutsche was responsible for the global economic distress unleashed by the crisis).   47. Although Trump lies pretty much all the time about pretty much everything, to me this was a brief moment of candor:

    “I decided not to do” the project,” Trump insisted, saying, “The primary reason: I was focused on running for President.” But he added, “There would be nothing wrong if I did do it. I was running my business while I was campaigning. There was a good chance I would not have won, in which case I would have gone back into the business,” asking rhetorically why he should have been penalized financially while campaigning.

    The Trump Tower Moscow project was abandoned right after Wikileaks did their thing and it had nothing to do with his “focus”, IMO. Trump didn’t think he was going to win, so he was he was still trying to make a buck while running for Leader of the Free World and, through Agent Cohen, was willing to bribe a hostile foreign leader in order to make this deal happen, conflict of interest be damned, until the political heat became too much.
    Trump was never really serious about the job of president. If he were, he would learned his issues instead of never going beyond shallow platitudes and factually-deficient tweets and garden-variety insults and repeated lies. No, to him, it was about making more lucrative deals, and running for president was a way to do it. I could swear, moments before his victory speech, he had a facial expression of, “Oh s**t, I won. WTF do I do now.” This is where we’re at. He was never equipped for the job in the first place, and now we’re dealing with one drama to the next and, as I see it, he doesn’t have the maturity or the brains to do anything different.

    Encased and unloaded, and not a prohibited person. If you’re fixing to stay, you must get an FOID within 60 days of establishing residence. Encased and unloaded without an FOID won’t carry the day for residents after the grace period.

    If you’re coming to hunt or engage in a shooting competition, the Illinois Department of Natural Resources or the sponsor of your event, will advise you in better detail when and where you may possess the gun uncased and loaded.

    As for counties, Cook County does have restrictions on some kinds of guns (No! Don’t tell us!), but neighboring DuPage has cops who will pull you over for going one mile over the limit or having a splash of mud which “conceals” your out of state license plate. IYKWIMAITYD So watch yourself everywhere, you don’t need the hassle.

  78. nk, if all their after is “FBI investigatory methods,” then that’s a poor excuse. The Senate should be finding out more about why and how Russia interfered with our election. But they don’t care about that.
    It’s telling that all Republicans want to know is how the information is gathered, and not interested in what has indeed been gathered. “The dirt is bad, so let’s resort to questioning the methods of obtaining that dirt.” Pffft!

  81. The President lies. All. the. time. We have a man who’d rather lie than tell the truth, he’d rather lie than eat big macs or bang porn actresses. It’s like Tom chasing Jerry, it’s what he knows to do, and so he does it. In case you hadn’t noticed, he has a problem. It’s called a Pathology. He needs help, but instead of getting help he got the Presidency and a few million fans who eat up his every tweet.

    When the President and his associates lie about Russian contacts over, and over and over and over and over …. is it evidence they are/he is hiding something? Or just a spreading of his disease? Or both?

    Every one will draw his own conclusions, but in my experience, people who lie are hiding something. Multiple people lying about (or “misremembering”) *the same thing over and over* suggests they are all hiding the same thing.

    Good lord, I think I just witnessed a Trumpgasm.
    Mr. Gerson has a point about the people this serial-lying president picks has in his sphere. They’re bad people, just like their boss.

    Here is one fact beyond dispute. Look at the men whom Trump has traditionally surrounded himself with: Stone, Corsi, Paul Manafort, Cohen. These are some of the least reputable people in American politics. Trump’s inner circle has always been a cesspool.
    And there is a reason for this — a reason Trump has traditionally employed unethical people to serve his purposes. It is because he has unethical jobs for them to do, involving schemes to remove political threats and gain electoral advantage. And there is every reason to believe that Trump has fully participated in such schemes.

  88. There is no contradiction betwen thw two Peskov statements, provided the whole thing was not at the top of his mind.

    Peskov never responded to Michael Cohen’s email. He called him on the telephone and explained why he was not replying – why he was qsking this, and besides this was not the right address.

    That does not constitute a reponse to the email.
