Still More Lack of Corroboration for Christine Blasey Ford

It doesn’t mean she’s lying, but you can add it to the growing list of potential corroborating facts that aren’t panning out:

CNN has learned that the committee has reached out to a longtime friend of Ford named Leland Ingham Keyser.

“I understand that you have been identified as an individual who was in attendance at a party that occurred circa 1982 described in a recent Washington Post article,” a committee staffer wrote Keyser earlier this week.

On Saturday night, her lawyer, Howard Walsh, released a statement to CNN and the Senate Judiciary Committee.

“Simply put,” Walsh said, “Ms. Keyser does not know Mr. Kavanaugh and she has no recollection of ever being at a party or gathering where he was present, with, or without, Dr. Ford.”

It’s still not clear to me where the suggestion originated that Ford claims Keyser was at the party. The CNN report attributes it to a staffer but I don’t know where the staffer got that information. (Keep in mind that, to my knowledge, Sen. Grassley and other Republican senators still don’t have an unredacted copy of Ford’s letter sent to Feinstein.)

Meanwhile, what to make of this? The Washington Post interviewed Ford and quoted her as claiming that she was worried when Trump was elected because Kavanaugh had been mentioned as a possible replacement for Scalia. Here’s the beginning of their piece:

When Donald Trump won his upset presidential victory in 2016, Christine Blasey Ford’s thoughts quickly turned to a name most Americans had never heard of but one that had unsettled her for years: Brett M. Kavanaugh.

Kavanaugh — a judge on the prestigious U.S. Court of Appeals for the District of Columbia Circuit — was among those mentioned as a possible replacement for Supreme Court Justice Antonin Scalia, who died in 2016. When Trump nominated Neil M. Gorsuch, Ford was relieved but still uneasy.

Just one problem: as Alex Pappas notes, Kavanaugh was not on Trump’s list when he was elected. The original list of names released in September 2016 included only these 11 people: Keith Blackwell, Charles Canady, Steven Colloton, Allison Eid, Neil Gorsuch, Raymond Gruender, Thomas Hardiman, Raymond Kethledge, Joan Larsen, Mike Lee, and Thomas Lee. Gorsuch was picked from the list and was confirmed in April 2017. In November 2017, more a year after the election, five more names were added: Amy Coney Barrett, Britt Grant, Brett Kavanaugh, Kevin Newsom, and Patrick Wyrick.

None of this means that it’s impossible that Kavanaugh was mentioned as a dark horse replacement option for Scalia somewhere. But if his name came up it was more likely to be as a discussion of why he wasn’t on the list. Take this Wall Street Journal article as an example:

That scrutiny may have doomed the chances of once-rising members of that conservative class, such as Sixth Circuit Judge Jeffrey Sutton and Judge Brett Kavanaugh of the District of Columbia Circuit, both omitted from the initial Trump lists.

This is not a silver bullet in the heart of Ford’s story, but it is another thing that makes you go “hmmmm.”

UPDATE: Actually, the list of 11 was generated in May 2016 and expanded to 21 names in September 2016. Kavanaugh’s name was not among the 21. Beldar collected the details here. The point about Ford’s memory stands with this correction. If anything, the point is even stronger.

  5. One of the developments in our society which angers me to no end is when prominent folks, like athletes, insist that absent a criminal conviction, they must not be removed from their positions. And the media always backs this garbage. Never mind that those who enjoy public status as a privilege. The “accused” demand judgment be made utilizing the criminal standard of all reasonable doubt removed.

    But, when a conservative is the accused, it’s all about “the seriousness of the charge.” The accused must prove innocence beyond all reasonable doubt. The presumption is guilt.

    Just how does such a society expect to retain any modicum of liberty?

    True, it does not prove she is lying, if every person she names as being there when it happened says they have no such recollection.

    What people take from this is another matter. If Kavanaugh said he and Judge were in Gstaad on the night of the party (assuming arguendo that we even knew what year the party happened much less the night), and that Kelsey was there too, and then Kelsey responded with she had no recollection of that and had never met Judge with or without Kavanaugh on any occasion, that would not prove Kavanaugh was lying.

    However, it would be presented in the media as a serious problem with Kavanaugh’s story.

    The trend lately had been, the less detail the accuser provides, the more detail the accused is required to prove. The more detail the accused delivers, the more detail is demanded. The accuser’s lack of detail is treated as strong evidence, because “everyone knows” or “studies show” that sexual assault survivors don’t remember every detail and sometimes give inconsistent accounts–as though that weren’t true for every human being, victim of any sort of crime whatever or not.

    As a society we are not going to like these new rules. I am afraid we will have to learn the hard way, just as we did about the satanic abuse scares. There are still people in prison over that one.

  9. I am also troubled by the increasingly common locution “credibly accused”. It seems to mean “it’s not an obvious impossibility”. For example, there’s no date given, so there’s no way to establish that Kavanaugh was somewhere completely different, with witnesses or contemporaneous evidence such as plane tickets or some such. And no physical impossibilities were claimed, such as flying on broomsticks (as was testified to in some of the satanic day care cases).

    With this standard there is no one who cannot be “credibly accused”. Even where they watched every minute by witnesses, those witnesses may belong to a race or gender or social group that allows their evidence to be discounted out of hand.

    If Ford believes that things happened as she recounts them she is not lying, regardless of whether things actually happened that way. If it’s a recovered memory situation, for example.

    Credibly Accused’ Is the New ‘Gravitas’

    Despite having been called out repeatedly over the years for appearing to all be reading from the same scripted talking points, the media are arguably even worse about doing so in the current era of President Donald Trump. They just got caught blatantly doing so with regard to the vague and formerly anonymous allegations of sexual misconduct lodged against Supreme Court nominee Judge Brett Kavanaugh.

    The key phrase this time — spotted by independent journalist Mike Cernovich — is “credibly accused,” as in Kavanaugh has been “credibly accused” of a sexual assault 35 years ago and therefore should be disqualified from being a Supreme Court justice.

    Cernovich tweeted screenshots from a number of liberal media and political figures who all just so happened to use the exact same phrase in describing the vague and impossible-to-prove-or-disprove accusation against Kavanaugh.

    Indeed, in several instances the “credibly accused” phrase was applied to Trump as well, in reference to the many unproven and evidence-free accusations of sexual misconduct thrown unsuccessfully at him during the 2016 campaign.

    Nor was it just those handful of tweets captured by Cernovich that used the “credibly accused” phrase with regard to Kavanaugh, as a search of the phrase on Twitter brought back innumerable examples of tweets that were all written slightly differently but nevertheless used those key words.

    Now would probably be a good time to note that the word “credibly” is generally defined as “easy to believe on the basis of available evidence,” which in this case is an inappropriate use of the word, as there is virtually no “available evidence” upon which to make the vague accusations against Kavanaugh “easily believable.”

    The avalanche of liberals all using the exact same phrase to describe the allegations against Kavanaugh, aside from seemingly confirming that liberal media figedures all read off the same sheet of distributed talking points, is akin to the theory that if something is repeated often and forcibly enough, it will become accepted and believed by the general public.”

    Don’t have a cite for you, but I recall (or think I do) that someone (probably wapo or nyt) reported recently that as of at least this past Thursday the Committee did have a copy of the “Feinstein letter”. Also, fwiw (again, no cite quickly at hand – sorry), within the last day there was a report (probably ditto) that the earlier reporting that Feinstein’d redacted the letter before forwarding it to the FBI was in error, and that the letter was actually forwarded intact, and redacted by the FBI, after which it was placed into the judge’s file. (I do not vouch for these reports, obviously, and heck, I don’t swear I’ve remembered accurately, though I think I have.)

Interesting point re: Saturday’s wapo article that you c̶i̶t̶e̶ quote from re: Kavanaugh as prospect, and the Ford account of her first-rising concern as recounted by the wapo reporters in that story. There’s clearly been some imperfect reporting in this saga (kinda like life, eh?), and possibly more than kinda sloppy-imperfect reporting -slash- recounting from memory. But, yeah, things that make you go hmmm?

    One of the reasons for the delay is that enough people believe something like this had to have happened that they only need to make space and time for the truth to come out. This is why she went to the wapo.

    But given the amount of anti-conservative money in play and the stakes I’m surprised this was the best that could be done.

  20. The New York times today says there were five persons at the party (if it took place that is, of course) which would make it 3 boys and 2 girls. So there go the 4 boys from the therapists 2012 notes. Nobody tried to correct that aspect of the record till now./

    I also heard today on the Sunday interview shows that all 4 people mentioned have no claimed no knowledge of any such party.

    I think we have to understand that Christine Blasey Ford mentioned these names some time ago.

    This is not quite yet a done deal. It may depend upon also if Blasey’s lawyer may face ethics charges for putting her up to testify – I don’t know if that’s possible. If so, her lawyer has somehow got to avoid having her testify, hopefully in a way that doesn’t damage her credibility.

    Anyway, Senator Lindsey Graham said she made 10 demands of which 6 were granted, and he cited one or two that could not be. One is that she be permitted to select who can question her, and the other is what witnesses will appear.

    Now it’s interesting. She demands that only Senators question her. Clearly she doesn’t want to be cross examined. Yet she’s asking for witnesses to be subpoenaed, and in particular Mark Judge, whom she knows will not back up her story!

    This demand can only be made because she – or her lawyer -knows (from sources on the committee probably) that that request will not honored. (or that if it were, Judge and/or others would fight the subpoena, throwing the nomination vote into the next Congress.)

    It’s a bluff. Hearing from other witnesses would be the worst thing that could happen to her.

    Whether the “denial stands” or not, the following excerpt from a wapo piece suggests that he might be a witness that a skilled examiner on or aligned with Team Ford might very much relish questioning:

    A lawyer for Judge said in a letter to the Senate Judiciary Committee that he has “no memory of this alleged incident.” Judge previously told the New York Times that such behavior would be wildly out of character for the Catholic-raised-and-educated boys who went to Georgetown Prep in the early ’80s.

    What Judge has written in his career as a journalist and author is another matter.

    In two memoirs, Judge depicted his high school as a nest of debauchery where students attended “masturbation class,” “lusted after girls” from nearby Catholic schools and drank themselves into stupors at parties. He has since renounced that lifestyle and refashioned himself as a conservative moralist — albeit one who has written about “the wonderful beauty of uncontrollable male passion.” [hyperlinks removed]

    The commentariat/media is replete with other pieces of fruit (“O’Kavenaugh”, “100 Keg Club”, etc., etc.) which seem to many to have the potential to paint Mark and his buddy Brett in a rather more prosaic (and questionable) light than His Honor might prefer; and heaven knows but that Mark Judge seems almost drawn-by-Hollywood-perfect, as a vehicle to advance such a narrative. And, that, is precisely why the majority (and [very] presumably Team Kavanaugh) is so resolute against compelling his appearance. (And why there is every reason to believe that Team Ford’s demand that he be subpoenaed and appear is wholly genuine and heart-felt, and in no sense a diversion.) This is not rocket science.

  41. People characterize it as a credible accusation, I presume, because Ford said it happened. Some people think it’s a conspiracy theory, I gather, because Ford is of liberal persuasion and therefore wants to torpedo Kavanaugh. It seems to me, however, that the fact she’s willing to endure the death threats and violent overtures that were entirely foreseeable as a result of coming forward after the leak–a wholly separate issue IMO–lends credibility. What does she have to gain by making it up?

    As a former prosecutor myself, the lack of corroboration is not dispositive. It’s just something that goes in the pot of stuff you look at in assessing credibility. From what I’ve read, she is not certain of the details of the party, so I’m not sure why people saying it definitively did not happen is treated as gospel. (If I’m mistaken and she has pinned down the exact date and party, then my opinion on this point might change).

    I’m of the view that anyone who thinks this matter is crystal clear in either direction is blinded by partisanship.

    I don’t understand what you’re driving at. He deserves the benefit of the doubt, but I’m not sure why that extends to sitting on the US Supreme Court.

    Seems to me this is the essence of a your mileage may vary thing. It might be unfair in some abstract sense for Kavanaugh to not get appointed based on something that by its very nature cannot be proven (nor disproven), but I think that attaches too much emphasis to the timing of the revelation. Put it this way: I am quite confident that Kavanaugh would NEVER be nominated if the powers-that-be had knowledge of this precise accusation. They’d pick someone else. There’s no right to be nominated to the Court, and there are plenty of other conservative Justices that I’d be happy to see on the Court.

    I agree with this assessment. I think the primary goal is use the nomination to get out the vote to help secure the House.

    If three women are willing to swear under oath that Kavanaugh sexually assaulted them, that’s powerful evidence. It doesn’t mean Kavanaugh did anything, but it’s probably going to change the results of several congressional elections.

    Well, you could frame it like that, but the truth is that Trump defeated BOTH parties. He took apart the entire range of the GOP as it existed in late 2015. From Santorum to Kasich to Cruz he bested them.

    And he did it primarily though policy differences. He championed the people that the GOP had forgotten — the working stiff who could not compete with overseas competitors operating under different rules. Overseas competitors that were preferred and in many cases advantaged by GOP policies. And it wasn’t just a resentment; employment and marriage statistics were terrible compared to 50 years earlier.

    They were mad as hell and weren’t going to take it anymore and long comes Howard Beale Donald Trump.

    Then he destroyed the Democrats’ establishment candidate in detail, taking states she should have won going away.

    This wasn’t partisanship — this was a realignment. You can kiss off the return of GOP or Democrat globalism. The parties will react differently, of course, but they will need to embrace the folks who abandoned them for Trump.

    This will oddly be harder for the Democrats as their entire open borders thing is in conflict.
