Second Amendment and Putin-Ordered Murders

I wanted to write about the John Paul Stevens op-ed recommending that we repeal the Second Amendment. For example, the way he butchers the facts:

But some other RedState writer got to that first. I’d save it for tonight, using her post as a springboard to do a think piece, but I’ll be watching Mahler’s 5th instead at Disney Hall.

So instead you get this post about a BuzzFeed article alleging that Putin had a Russia media czar murdered in D.C.

    Primis: The Second Amendment had effectively been judicially repealed until the Heller decision in 2008. All of the gun rights, and they were just about the same we have now, were by legislative action. In Congress and in the states. Remember this, because
    Secundis: In order for an Amendment to be repealed you need two-thirds of Congress and two-thirds of the states. Well, you ain’t got them. There are maybe ten states that are not RKBA friendly.

    How do you say “pipe dream” in Latin? That’s what Stevens is indulging in. But the price of liberty is eternal vigilance. We need to fight constantly to keep gun grabbers out of government.

    Secundis: In order for an Amendment to be repealed you need two-thirds of Congress and two-thirds of the states.

    Not two-thirds but three-quarters of the states. 38 states out of 50, not 34. (When the result is a fraction, you go to the next higher number.

    On the other hand, states probably cannot retract their ratification, and the process can go on for over 200 years (case in point – teh 27th amendment) unless the amendment itself sets atime limit and in the early 20th century Congress sent amendments with a 7-year time limit written inside.

    For the Equal Rights amendment, they put it in the legislation, but later on, Congress extendxed the term, and it was held that if it not in the text of the amendment it doesn’t mean anything. Which probably theEqual Rights amenbdment is still out there needing only a feew more ratifications.

  15. As for the second amendment, the Supreme Court has spoken nonsense. The Heller decision I think talked about weapons in common use. This completely begs the question.

    What is that? And why should that limitation exist? And can it change?

    Clearly if it means anything at all, if the second amendment is meant to facilitate the possibility of rebellion in casxe of a coup, it must include the right to possess anti aircraft guns or all the weapons we did not give (in time) to the Syrian rebels. The Kurds had guns but would not have held out aaginst Saddam Hussein between 1991 and 2003 without U.S. air support.

    Not to mention gadget guns (outlawed since the 1930s – every gun looks like a gun and not like something in a James Bond movie) and even nuclear biological and chemical weapons.

    If nuclear biologoical and chenmical weapons can be excluded I see no principple by which AR-15s or any guns at all cannot be excluded.

    Then there is the definiton of militia, which is nto every male older than 18. That’s a lie told by the National Guard Association that they got Coongress to opass in 1903 (its Second Amendment propaganda was taken over by the National Rifle Association in the 1930s.)

    I think you can do a lot with the idea of insurance against crime and the necessity of a gun pwnewr having support of others, which is what would be needed in a militia.

This op ed was almost assuredly written by one of two Justice Stevens’ two current law clerks, either Donald L.R. Goodson (JD NYU 2013) or Sarah Hartman Sloan (JD Columbia 2016).

    Fortunately, the US Men’s National Team had the wisdom and foresight to lose to Trinidad and Tobago (a great brand of cigars) so as to save the Trump Administration from making a hard call in that regard.

    Seriously, if you could get a solid contingent of the West on board with actually boycotting the tournament, and not sending their teams, that would be about as big a geopolitical “punch in the gut” as the ejection of 100 Russian spies.

    The only problem with such a strategy is that the soccer fans in the boycotting countries would toss all the governments out of office in protest.

  21. Saturday, I went to counter-demonstrate at the San Diego “march for our lives” anti-gun demonstration.

    I talked to about 10 of those marchers. I wanted to get unfiltered information on what they really wanted and what they really thought. Almost needless to say, they lived down to my expectations.

    Those marchers are supremely ignorant about our gun-control laws. Yet they want stronger gun control laws nonetheless. If you ask them what the penalty should be (how many years in prison?) for violating that stronger law, they get very very squirrelly. They blanch when confronting the real world consequences of the policies they prefer.

    In essence, they have a Southpark “underpants gnome” philosophy about gun-control: Step 1, Pass Gun-Control Law! Step 2, ?? Step 3, Peace!

    The march was an Orwellian event of outer-party-member types mouthing party-line platitudes, absent of thought, no consideration of tradeoffs, no consideration of costs. And with an Orwellian style focus on demonizing an enemy, in this case the NRA. Among the many anti-NRA signs I saw non-hand-made signs printed with “NRA is a terrorist organization”.

    The protesters I personally encountered ran the gamut of reasonableness, from the overtly malicious, to the honest yet authoritarian, to the good intentioned but ignorant. The most entertaining was one of the latter, as he did a double-take when I informed him that use of marijuana prohibited him under Federal law from legal ownership of any firearm (and that California legalization of marijuana was irrelevant to the Federal gun crime).

    Just finished re-reading Shattered Sword, the best book I’ve found on The Battle Of Midway. When Japanese survivors were plucked from the sea the Americans gave them food, water and blankets. The American survivors taken aboard by the Japanese were brutalized, interrogated and then thrown overboard weighted and bound. The officers who did that served under Yamamoto.

    Yesterday Mueller’s team filed documents in relation to the upcoming sentencing of Alexander van der Zwann, an attorney who is also married to the daughter of a Russian oligarch. Van der Zwann pled guilty to lying to the FBI about the timing of his last contacts with Gates and Manafort.

    Van der Zwann told the Special Counsel that Manafort and Gates were aware that the officer manager of Manafort’s office in the Ukraine was connected to the GRU, which is Russian Military Intelligence. The Special Counsel states that Gates has know acknowledged that he and Manafort knew the guy was with GRU.

    So this will be producing breathless headlines about how Trump campaign officials had continuing contacts with known members of Russian intelligence — while they were engaged in business in Ukraine over an extended period of time prior to the 2016 election.

    Like DRJ said, a lot of that thread was lawyers discussing/arguing about the ins and outs of criminal law/selective prosecution/etc. It had less to do with the particulars of the underlying fact pattern. I personally don’t care at all about the Stormy Daniels Affair, but I am interested in the underlying legal issues.

    The underlying legal issues here are pretty simple, and I try not to kvetch just for the sake of kvetching.

Donald Trump actually has a lot of respect for nuclear weapons – his uncle was a professor at MIT and a nuclear physicist (who examined Nikola Tesla’s papers after his death and reported that there was nothing valuable there) who spoke to him a number of times about teh destructiveness of nuclear weapons starting circa 1970.

    Overturning that decision via a constitutional amendment to get rid of the Second Amendment would be simple and would do more to weaken the N.R.A.’s ability to stymie legislative debate and block constructive gun control legislation than any other available option.

    Except Stevens is criminally insane. He authored the dissent in the 5-4 Heller decision. His factually deficient reasoning would’ve effectively nullified the 2nd Amendment.

    Frequently when posting here I forget that a large part of the audience are lawyers who take apart every word and work it to death. That’s why the law in America today is a damn mess that no one, not even lawyers can understand or agree on. Some folks see Trump as so deeply repugnant, that it seems to have altered their internals permanently, sitting like shingles on their irritated nerves. Eventually there will be a breakout, but the duration is uncertain.

    Trump Aversion Syndrome is often misdiagnosed as TCS but it’ll take 6.7 more years to determine what’s what and who even still cares. Recommend treating TDS and TAS survivors to be with kindness because nothing anyone says or does can ever change a thing

I don’t remember anyone complaining that Patterico “endlessly criticized” the LA Times or Obama or that he started the “Deport The Criminals First” series. (There are also examples where Patterico blogged positively about things Trump has done.) Did aphrael complain that everyone criticized Obama too much? No, he didn’t. If it bugged him, he probably just left for awhile, because he knew this is Patterico’s blog and his decision what to blog about.

    I listen to a Lifetime Movie breakdown podcast by Molly McAleer. She uses a reverse scale. 1 is a movie like The Godfather and 5 is like Mother May I Sleep with Danger. She has several subcategories she judges by, two of them being “Overreaction” and “Under-reaction”. So it’s like, did the character act like they were in The Godfather or like they were in a Lifetime Movie. I guess you just expect certain things from certain networks.

    I’m trying to figure out why companies who obviously see a benefit in sales by advertising on Ingram’s show or on FOX in general would listen to a bunch of idiots who never, ever watch Ingram’s show in the first place. The people complaining are not the people the companies are advertising to so why should they care? However, by acquiescing to the infantile demands of leftist nobodies these same companies are now losing customers that like Ingram and/or FOX by insulting them. Plus, they are losing customers like me who don’t like the idea of conservatives being targeted for censored speech by companies in cahoots with leftists. I see that almost as I would the government doing it because historically the way the left works next they will be trying to get the government to do it.

    What theses leftists are doing is two fold. First they want to see how far they can push the free speech envelope and second how far the media and corporate shills will back them before the next elections. They are planning a new paradigm for advertising and commercial warfare on conservatives and Republicans.
