What Does All This New Russia News Mean?

Two big stories out on Russia in the past day. Let’s recap and briefly analyze.

First, as Caleb Howe discussed here, Robert Mueller has filed his first charges. Behind Door #1: Paul Manafort. Behind Door #2: Michael Flynn. Behind Door #3: A goat. (Scapegoat?) If a door is opened and it does not contain the indicted person or animal, should you switch your guess? I don’t know, since Monty is no longer here to tell us. I do know that Adam Steinbaugh had the Tweet of the Day with this:

Second story: what many of us strongly suspected is now crystal clear: Natalia Veselnitskaya was acting as a Kremlin cutout when she met with Donald Trump Jr., Jared Kushner, and The Man Behind Door Number 1. Susan Wright discussed this yesterday, and the article can be found in the #FAKENEWSNEWYORKTIMES!!1!:

Natalia V. Veselnitskaya arrived at a meeting at Trump Tower in June 2016 hoping to interest top Trump campaign officials in the contents of a memo she believed contained information damaging to the Democratic Party and, by extension, Hillary Clinton. The material was the fruit of her research as a private lawyer, she has repeatedly said, and any suggestion that she was acting at the Kremlin’s behest that day is anti-Russia “hysteria.”

But interviews and records show that in the months before the meeting, Ms. Veselnitskaya had discussed the allegations with one of Russia’s most powerful officials, the prosecutor general, Yuri Y. Chaika. And the memo she brought with her closely followed a document that Mr. Chaika’s office had given to an American congressman two months earlier, incorporating some paragraphs verbatim.

The coordination between the Trump Tower visitor and the Russian prosecutor general undercuts Ms. Veselnitskaya’s account that she was a purely independent actor when she sat down with Donald Trump Jr., Jared Kushner, the president’s son-in-law, and Paul J. Manafort, then the Trump campaign chairman.

It also suggests that emails from an intermediary to the younger Mr. Trump promising that Ms. Veselnitskaya would arrive with information from Russian prosecutors were rooted at least partly in fact — not mere “puffery,” as the president’s son later said.

If you didn’t care that Trump Jr. was going to the meeting explicitly to get dirt on Hillary that he believed to be sourced from a high-level Russian prosecutor, then you won’t care that the dirt was indeed coming from the Kremlin.

Also, you’re probably a partisan hack who would have screamed to high heaven if Hillary’s troops had done the same.

What does it all mean? That partisans are gonna partisan.

Have we gotten to coordination yet, as to Hillary or Trump? No. Do we have utterly nasty politics being played, by the Hillary side and the Trump side? Yes. Will Democrats care about only one half of this? Yes. Will Republicans care only about the other half? Yes.

    Hillary’s campaign paid for a dossier that contained information obtained by Steele sourced to Russian intelligence. This is suggestive of collusion, just as top Trump campaign officials meeting with a Kremlin cutout to obtain information about the opposing candidate is suggestive of collusion. But neither situation yet rises to conclusive proof of cooperation between the campaign and the Russian government. If you want to make that case, you have to explain, lay out your argument, and do more than say “Hillary paid for the dossier!” If that’s all you say, I can retort with “Trump’s campaign manager met with a Kremlin cutout expressly for the purpose of getting information about Hillary sourced to the Kremlin!” Yelling and conclusionary partisan statements don’t get us anywhere. Why not wait and see what comes of all this?

  9. We’re confidently told by partisans that the only crimes committed here were by Hillary people. Yet there appears to be a sealed indictment, and the name in that indictment is probably not Clinton or Podesta or someone connected to them, but Manafort or Flynn or someone connected to them.

    Don’t get me wrong: I would love for what I just said to be wrong. But I don’t think it is.

About halfway through The Chickenshit Club on the recommendation of Ed from SFV, on pause in The Gulag Archipegago about 1/3 of the way through. Keep getting distracted with audio lectures about Bach and listening to podcasts about foreign affairs, a topic I have not paid much attention to, until the past several weeks. Also very very busy at work, which cuts into reading time.

    Antifa is calling for a peaceful protest every day starting November 4th, but others are saying online that Antifa is calling for an all-out violent war in the streets. Still others are saying plainly that Antifa is planning to instigate a civil war in order to remove Trump from the White House.

    An anti-Trump group, Refuse Fascism, is calling for a protest a day starting November 4th across the United States. Organizers are asking protesters to come out every day until the Trump administration is no longer in power.

    Dailycaller.com reports: Antifa websites like Going Down, Sub.Media, and Insurrection News have been promoting the group, which calls itself the Revolutionary Abolitionist Movement (RAM). The press release the group published is filled with far-fetched claims about how “mosques are being ruthlessly bombed” and how “LGBTQ are being battered.” RAM cites, with pride, cop killers like Mumia Abu Jamal who shot and killed a police officer in Philadelphia in 1981 and Russell Shoats who shot a police officer in the back five times in 1970.

    RAM is calling for the abolition of gender and the expropriation of private property to begin the revolutionary process. Far Left Watch notes that RAM has been hosting anti-police workshops, a class on anarchism, and a class called ‘Our Enemies in Blue’.

    The Party Formerly Known as Democrat has gone full-blown commie/Nazi.

  26. The lawyer already represented herself as a “prosecutor of the crown” to the Trump campaign. No one who attended the meeting thought she was an independent investigator. They thought an official from the Russian government was about to give them information on how they illegally colluded with the Clinton campaign.

    Which doesn’t make sense, because Russia would never admit to wrongdoing on their part (taking illegal cash payments from Clinton) JUST to help Trump. That info would give the POTUS tremendous amount of leverage. But who wouldn’t want to obtain this kind of “dirt” if they offered it? Don Jr says he would contacted his attorney if he ever got such intel. We don’t know that for sure, but that would have been the right move.

    The lawyer apparently said a lot of nonsense that no one in the meeting found interesting. Kushner left early. The Russians probably wanted to see if they could influence Don Jr and purposely laid out sweet sounding gibberish to gauge his interest. She relied on some sort of a document that was also given to another American politican, per NYT.

  56. Gary Kasparov’s colleague at the Human Rights Foundation, Thor Halvorssen, seems to be competing with Fusion GPS for mindshare with the media with their respective news-for-hire operations.

    In addition to their involvement with the Kremlin, Fusion GPS was hired by Derwick Associates, a Venezuelan firm of five young guys with no background in the energy business. Derwick proceeded to skim billions off of rigged (no bid) contracts with Hugo Chavez’ regime. (Chavez had brought in Gazprom and Gazprombank to help run Venezuela’s nationalized oil company after Chavez fired 20,000 of its employees.)

    Fusion GPS was used to kill a Wall Street Journal investigative reporter’s story about this corruption.

    All of the above was related by Alek Boyd, who was described as a “Venezuelan investigative reporter” to Lee Smith, a senior editor with the Weekly Standard and a senior fellow at the Hudson Institute that has written extensively about Fusion GPS for Tablet. But Boyd also worked for Halvorssen at the Human Rights Foundation. And Halvorssen’s family was a part of the pre-Chavez oligarchy in Venezuela.

    Interesting, no? But it gets better.

    Bill Browder, whom our host wrote of in his 6 part series on the Russian kleptocracy, testified to the Senate Judiciary Committee that Fusion GPS was hired by the Russian femme fatale Veselnitskaya in order to smear Browder and Alek Boyd, the latter claiming that Fusion GPS branded him a pedophile, sexual deviant, and drug addict.

    So, you’ve got Fusion GPS, the Russkies, and the Dems in one corrupt camp, and those that are exposing their misdeeds: Browder, Lee Smith (you can’t get any more right-wing establishmentarian than Lee), Halvorssen, and Boyd in the other. Both sides are using the press to their own ends.

    Halvorssen is a shady character….he was probably motivated by his familial ties rather than any allegiance to Browder or the right-wingers.

Both of his mentors were crooks: Robert Maxwell, who stole $750M from his companies’ pension funds, and Edmond Safra, the owner of The National Republic Bank of New York which was laundering billions of dollars which Robert Friedman’s piece “Money Plane”reports as:

    “a startling account of regular deliveries of crisp new $100.00 bills flown by the planeload from JFK International Airport nonstop to Moscow, five nights a week, where the money allegedly becomes part of the Russian mob’s vast international crime syndicate in a money-laundering operation of mind-boggling proportions. According to Mr. Friedman, principals in this operation – aside from its eventual recipients – are the National Republic Bank of New York and the United States Federal Reserve. Rarely less than $100 Million – allegedly – and sometimes more than $1 Billion, these regular-as-clockwork infusions of laundered moola are said to total more than $40 Billion since 1994, over two of the most Dante-esque and tormented years in Russia’s history. Put in perspective, that amount far exceeds the value of all rubles in circulation at the time.”

    Safra, of course, was Browder’s partner in Hermitage Capital. This doesn’t make Browder guilty of anything more unscrupulous than your average hedgie, but for balance, here’s a great source for an alternative viewpoint from authors without spittle at the corners of their mouths:

    Another interesting aspect is Browder’s attempted censorship of Andrei Nekrasov’s documentary “The Magnitsky Act”. Why? Forget the First Amendment….why would Browder care? Maybe it’s because Nekrasov, who has been critical of the Russian government and Putin in particular, documents how he went from trusting Browder’s word to disbelieving it. The director says he began to doubt the hedge fund manager after reading the actual police reports in Russian. For example, Nekrasov argues that Magnitsky’s first contact with the police was not a voluntary act of whistleblowing, as Browder maintains, but a record of the police questioning him as a key witness in a tax evasion investigation.

    As with a babushka doll, perhaps someday we’ll get to the bottom of this.

    Manafort has made it known that he was told he was a target of the investigation, so that would be why he would be the number one guess.

    New Jersey Governor Chris Christie said on Face the Nation that, depending on who leaked this, it could be criminal.. But I think it would be more criminal if the name or names were leaked, so maybe that’s why this didn’t happen. He also said there are (legitimate) reasons for sealed indictments – to get preparations ready (but that would not explain sealing it and then leaking it, I think.)

    Now, it was obvious there was some grand jury activity on Friday because there were prosecutors there, so that’s a little bit of confirmtion.

    It could be a coincidence that the indictment(s) came now, or, I have to think, it could be to distract attention of the news media from other stories (another possible motive: a way for Mueller to protect is job.)

    Leaking the fact that there was an indictment could also be an attempt to give it better play, or maybe it’s that reporters were told to get ready for a perp walk on Monday.

    None of this explains why those gaps exist or what the oddness in reports 94 and 095 stem from. But it is a real reason to question the provenance of the copy BuzzFeed got.

    Once they have voted, the doors are opened and they tell the prosecutor the result. The GJ Foreperson then calls the Court Clerk, and states they have returned an indictment. At that point the proceedings become open to the public — the doors have to be open, and there must be a route by which members of the public can find their way to the GJ room.

    The judge comes in, calls court into session, and the Foreman reports to the Court its work — if the case is sealed by request of the prosecutor and order of the Court, the Foreperson will simply announce to the Court that it has returned an indictment which is sealed.

    Wait. If the indictment is sealed, are the proceedings open to the public?

    So the correct way to describe what happened yesterday — to the extent known — is that Mueller and his staff recommended an indictment be returned, but it was the GJ that voted to return the indictment. The Court accepted the indictment for filing under seal. Its likely that arrests warrants were issued — which is overkill — because there really is no other purpose for sealing an indictment unless you are going to arrest someone.

    And either

    1) for some reason, you can’t, or

    2) you don’t want to make it known that an informant has been indicted.

    Is that right?

    It may be that they plan to conduct searches on Monday too, so they don’t want whoever is the subject of the indictment to know they are the subject of the indictment and risk that the person might attempt to destroy evidence between now and when the searches are completed.

    But when an indictment is sealed, isn’t the fact that an sealed indictmentexists also sealed?

    But there is nothing that prevents them from doing searches tomorrow.

    Today that is, Sunday. reporters have apparently bene told to await arrests or maybe JUST the unsealing of the indictment(s) probably on Monday.

    In fact, having a warrant issued, and then allowing the person who is subject to that warrant just walk around for 48 or 72 hours until you choose to arrest them, violates DOJ policy. When someone has a warrant, and you (a federal law enforcement officer) knows where they, you have a duty to go get them — the warrant is a Court order to bring the person before the judge. Law enforcement agents aren’t allowed to pick a later date than the date on the warrant when its more convenient to them.

    Unless maybe it is sealed, of course.

    Steele’s company first began working with Fusion back in 2010, according to what he told the court. In 2016, he began work on Fusion’s Trump opposition-research project, producing 16 memos for Fusion prior to the November election. Steele briefed reporters from select outlets (The New York Times, The Washington Post, CNN, The New Yorker, Yahoo, and Mother Jones) on the contents of the memos but did not “provide any of the pre-election memoranda to media organizations or journalists, [nor] authorize anyone to do so.”

Manafort was called second (or it is so reported) The indictment is still sealed, and will probably be made public at the arraignment, which could be minutes or hours from now.

    They were thinking there could be more, but as time goes on and there’s no more news, it looks like that’s it.

    Others will speculate about Mueller’s strategy. (like get him to plead guilty and turn staet’s evidence)

    When they find out what the indictment is about, most headlines and first paragraphs will describe the type of law allegedly violated, and anything that gets past the third or fourth paragraph will attempt to describe the alleged illegal acts.

    The real mystery here is how did someone – and it’s more than one person – whom Russia probably knew was corrupt or suspected could be corrupted, or at least appoint others who were, get into such high positions in the Trump campaign?

    Not, I think, because Trump was knowingly taking orders or advice from Vladimir Putin, which is what partisan Democrats would want us to say..

    He ran it for a short time. But the charges have nothing to do with Trump, and involve what he did earlier.

    The only relevance is how somebody whom Russia would have reason to know, or at least suspect, could be bought by them, wound up in the position he did.

    Not I think, because Trump was knowingly taking orders or advice from Vladimir Putin. The on;y way you can make any such claim is to say that Trump had a longstanding corrupt relationship with Russia – that he and Manafort were part of the same corruption, like some of Christopher Steele’s sources tried to tell him. But that is manifestly not so.

    Trump simply had very little dealings in or with Russia, and most of his attempts to get any failed – probably because he wouldn’t make any kickbacks. I would say he never took the hint(s).

    Off the topic — Andy McCarthy has a GREAT article today from the perspective of a former federal prosecutor about all the things that are odd about Mueller’s indictment of Manafort.

    Yesterday Mark Levin spoke about that

    One thing he said was that in charging Manafort tried to hide the fact he was a foreign agent, you had him committing a felony to protect a misdemeanor – a misdemeanor which is rarely if ever prosecuted – they just get foreign agents to register. Of course someone could do that; it’s not a big objection.

    The other thing I remember Levin saying is that Manafort was charged with money laundering, but not with evading taxes! (which was presumably the underlying motive or crime.)

    I think here maybe the prosecutors have competing theories as to what was going on. Maybe Manafort was hiding money for Russian government, or oligarchs, and it wasn’t all his. Maybe Manafort has so said.

    By the way, he probably could not be indicted for the tax year 2015 because it was all coming out before he had to file his 2015 tax returns on October 15, 2016 and so he probably filed it correctly and told the truth to his accountants and tax attorneys.

    Mueller has at least one more sealed indictment, probably of Mike Flynn and/or associates of Mike Flynn.

    The shortcomings of the indictment — especially the structuring a “scheme and artifice to defraud” predicate which is always present when you charge bank fraud, wire fraud or mail fraud, which is not followed by any fraud counts — will cause a lot of head scratching on the part of the district judge who gets this case.

    It always bothered me in the watergate case in which Haldeman and others were indicted, they were charged with covering things up, without the prosecutors having to say or prove what it is they were covering up. that sounds similar.
