  37. And I’m guessing it has to do with his undisclosed representation of Turkey, and his failure to disclose that when he did his paperwork to be National Security Advisor.

    But the timing of this is VERY troubling.

    Chuck Grassley said on a national radio show today that he thinks Mueller ought to recuse himself, and that Rosenstein should play no further role in the Trump-Russia investigation because of their connection to the Clinton/Obama/Russia matters surrounding Uranium One.

    Also, its likely to become public next week the amount Mueller’s investigation has cost during the first six months, and I’m guessing its going to be over $10 million. This is going to draw howls of protest from Trump and Congress. There will be major pressure brought after the disclosure to limit the scope of the investigation, or to put it on a definitive timeline.

    This indictment coming late on a Friday and kept under seal FOR NO GOOD REASON, smacks of trying to create an appearance of momentum to hold off the pressure that is going to build to shut the thing down.

  94. Daily Caller has a very interesting story about the undisclosed close connections between some of its reporting staff and the folks at Fusion GPS, which are mostly former WSJ reporters.

    It makes reference to a Facebook posting by Glenn Simpson’s wife — Simpson is a former WSJ reporter who was one of the founders of Fusion — that raved about how Simpson was responsible for exposing the ways Putin has control over Trump. You can probably bet that with that kind of language on Facebook, that’s the kind of talk that takes place around their dinner table.

    The article goes over the fact that one of the main CNN correspondents on the Russia investigation and Trump dossier is former WSJ reporter Evan Perez who regularly co-authored articles with Simpson, and that Perez has in his reporting generally credited the dossier as being accurate — while never disclosing his close association with Simpson while at the WSJ.

    The article also pulls photos off Perez’s Facebook page showing him socializing with various folks now at Fusion GPS.

    Their former employer the WSJ, ran an editorial on Oct. 15 that is supposedly very critical of its former employees, but its behind the paywall so I can’t see it.

And just for clarification on how the indictment process works and how it should be described — the fact that the “media” has never collectively understood the process enough to be able to describe it accurately through a “style book” entry, should in some ways caution readers against believing everything the media reports.

    I read a couple places yesterday, and heard talking heads on CNN say the “Grand jury would be recommending charges on Monday”. An NBC News report today says it has confirmed that Mueller would be “handing up” an indictment on Monday.

    None of that is an accurate description — whatever is meant by those members of the media making those claims.

    The correct description of the procedure is that the the Prosecutor — whether the US Attorney or DOJ trial attorneys — drafts a proposed indictment that includes all the necessary language for each count, and the factual allegations that support each count. Those facts are drawn from the testimony and evidence that has been presented to the grand jury. This presentation of evidence can happen over the course of many grand jury sessions.

    At various points along the way the prosecutor has probably given the GJ some instruction on the laws with respect to the charges that are being anticipated.

    On indictment day — which the Prosecutor, not the GJ, chooses — the Prosecutor presents the draft indictment for the GJ’s consideration. The GJ do not generally change or add to the proposed indictment. Their role is to consider what the prosecutor is proposing, and then determine whether the evidence presented to them supports the allegations of the proposed indictment. On indictment day the Prosecutor will walk the grand jury through the language of the proposed indictment, having them recall testimony of particular witnesses, reminding them of documents they have seen — maybe even showing them the documents again — and then answering any questions they might have. Once the summary is done, and all questions are answered, the prosecutor leaves the room. The GJ then can discuss the case among themselvees or they can proceed straight to a vote. If after they start talking they have questions, they will invite the prosecutor back to answer their questions.

    Once they have voted, the doors are opened and they tell the prosecutor the result. The GJ Foreperson then calls the Court Clerk, and states they have returned an indictment. At that point the proceedings become open to the public — the doors have to be open, and there must be a route by which members of the public can find their way to the GJ room.

    The judge comes in, calls court into session, and the Foreman reports to the Court its work — if the case is sealed by request of the prosecutor and order of the Court, the Foreperson will simply announce to the Court that it has returned an indictment which is sealed.

    The judge looks over the paperwork, makes sure all the necessary signatures are in place, looks at the voting as recorded by the Foreperson to make sure the vote is sufficient as required by law, and then on behalf of the Court orders that the indictment be filed with the Clerk’s Office, and whether arrest warrants should be issued or “penal summonses” which are sent to the attorneys for the defendant requiring the defendant to appear on a specific date and time for arraignment.

    So the correct way to describe what happened yesterday — to the extent known — is that Mueller and his staff recommended an indictment be returned, but it was the GJ that voted to return the indictment. The Court accepted the indictment for filing under seal. Its likely that arrests warrants were issued — which is overkill — because there really is no other purpose for sealing an indictment unless you are going to arrest someone.

    It may be that they plan to conduct searches on Monday too, so they don’t want whoever is the subject of the indictment to know they are the subject of the indictment and risk that the person might attempt to destroy evidence between now and when the searches are completed.

    But there is nothing that prevents them from doing searches tomorrow. And when an arrest warrant is issued by the date, it doesn’t say “arrest on or after” a specified date.

    In fact, having a warrant issued, and then allowing the person who is subject to that warrant just walk around for 48 or 72 hours until you choose to arrest them, violates DOJ policy. When someone has a warrant, and you (a federal law enforcement officer) knows where they, you have a duty to go get them — the warrant is a Court order to bring the person before the judge. Law enforcement agents aren’t allowed to pick a later date than the date on the warrant when its more convenient to them.

    Here is the classical attempt to gin up a case on a he-said-she-said or something on the edge of technical that would never have been bothered with if it wasn’t political, but by overcharging and browbeating you might get something out of it.

    Of course the goal is to get the target to plead out and flip and provide information on someone higher up the line, but if they just go through the trial like Scooter Libby (most likely because they don’t have anything to flip on and the deal that’s offered is crap) they won’t come out with much and might get a pardon.

    And then it stops because there’s noplace else to go.
