My Two Cents on the Decertification of the Iran Deal

Filed under: General — Patterico @ 9:56 pm

President Trump had a good day today. First there was the end of illegal “cost-sharing reduction” payments (subsidies) to insurers under ObamaCare — a laudable end to a totally extraconstitutional executive action by Obama. Hooray! Then Trump went even further and decertified the Iran deal. Double hooray!

Now. Let’s take a second and talk about the Iran deal. I for one have become sick of partisan knee-jerk reactions to every policy issue under the sun. So let’s avoid that sort of thing, and ask ourselves: why is the Iran deal bad, after all? Is it because Obama did it therefore it’s bad? Is it because Tougher Is Always Better in every situation, no matter what?

No and no. There are actual reasons, and I think it’s worth taking a step back and discussing them for a second.

After all, there is a halfway valid counter-view of this. We are not the only signatories to this deal. It’s a multi-party deal involving many of our closest allies (and a couple of countries that, um, aren’t). Many people across the world seem to think it’s our best chance to avoid Iran getting the bomb. And heck, even Gen. Mattis testified that he thought it was in our best interest to continue to honor the deal! And people are saying that America generally, and Trump in particular, will lose credibility when a deal that we negotiate is broken, simply because of a change in the person occupying the Oval Office.

Let me quickly deal with that last point first, before addressing the key shortcomings of the deal. This deal is in the nature of a treaty. The subject matter, the extent of the promises made, and everything else about it scream: TREATY. But it was not ratified by the U.S. Senate. It is not a treaty. And other countries have no business expecting us to treat this as a binding agreement in the nature of a treaty, when they know full well that the agreement has not gone through the treaty process.

On to what is bad about the deal. I’ll try to be less long-winded than usual and sum it up in two concepts: it’s a) too nebulous and b) not effective for its stated purpose.

The agreement appears to encompass secret side deals that Obama never made public. The delivery of cash to the Iranians in apparent exchange for hostages, our seeming promise to be less aggressive in Syria as a trade-off . . . these are things that don’t seem to be written down anywhere where we, the public, can review the terms. Yet it all appears to be part of whatever deal Obama struck. The bottom line is, nobody truly understands what all the terms of the deal actually are. Iran portrays some of the terms differently than Obama does, and there is no single comprehensive document that can settle the matter. This does not work.

And the deal is also ineffective, because Iran can still potentially develop nuclear weapons on military bases that are not truly covered by the inspections regime. In another of the numerous “side agreements” that Obama made, Iran can “inspect itself” when it comes the Parchin military site — which has been suspected of being a nuclear weapons production facility, but which isn’t if you trust the U.N., which I don’t. If the inspectors seek access, that access can be delayed or denied so as to make it ineffective if indeed it happens at all. That is not a good inspection regime, folks.

I’m not sure how much of this Donald Trump understands, but I have no doubt that many of the people around him understand it. Why Gen. Mattis is not disturbed enough by the lack of access to military bases to scrap the deal, I don’t know — but I think Trump is right that it is a one-sided deal (to the extent we know what’s actually in the deal), and needs to be renegotiated at a minimum.

There are more reasons the deal is bad, having to do with ballistic missiles, the lack of provisions dealing with Iran’s sponsorship of terror and other meddling in the Middle East, and so forth. But these are the main issues: the lack of clarity of the deal, and its total ineffectiveness.

So I applaud Trump’s move today. Not out of partisanship, but because I think it’s the right thing for America.

  1. The problem with getting rid of those (illegal) payments is that the insurance companies are still required to offer the subsidies those payments were to cover. To make that up they are jacking up all the premiums, and then the premium subsidies rise to match.

OF course, if you are one of these self-employed people who had a nice simple policy before all these subsidized chums barged it, you only get the giant premium increases.

Next year, in out early 60’s, my wife and I will pay $20,000 for a Bronze HSA plan which basically doesn’t pay anything at all until we’ve spent and addition $13,000. This includes drugs. So, it’s $20K for a catastrophic plan and hello Canadian pharmacies.

Meanwhile, other folks are getting better-than-platinum, $3 co-pay coverage for $115/month.

The government’s not paying it, I am. About $6,000 up this year, mostly to account for the loss of the illegal treasury payments.

I wish I could share the joy that principle has won and the Constitution is restored, but I kinda feel like I’ve been taken hostage.

First, the president must determine whether Iran is “transparently, verifiably, and fully implementing the agreement”; is not in “material breach with respect to the agreement”; and has not acted to “significantly advance its nuclear weapons program.” Second, the president must also make more general determinations about the worth of deal: whether the suspension of sanctions is “appropriate and proportionate” to Iranian conduct and “vital to the national security interests of the United States.”

  30. iranian_nuclear_deal_is_a_breakthrough_why_the_agreement_is_the_best_option.html

The main reason is that it is a profoundly good deal; there has never been a nuclear deal, with any country, that is so comprehensively restrictive. Israeli Prime Minister Benjamin Netanyahu urged the U.S. Congress to demand “a better deal,” but his definition of such a deal—one that bans uranium enrichment, dismantles all its facilities, and insists on a drastic change in Iran’s foreign policy—is unattainable, and, more to the point, he knows it.

Yes, this deal wouldn’t keep Iran from being a menace in Middle East politics, or from repressing its own people. But no arms control deal can aspire to do that. The U.S.-Soviet strategic arms treaties, signed throughout the Cold War, didn’t require the Soviet Union to disavow communism, end its support of Third World insurgencies, or institute Jeffersonian democracy—but the deals were still very useful. They capped, and in the later years reversed, the nuclear arms race; and they provided a forum for diplomacy, a cooling-off of the distrust and hatred, at a time when no other issues could have done so.

We should blockade their ports, destroy their off-shore oil assets, and quarantine their entire country. Yes, we damn well can interdict any land-border crossings bigger than a donkey, or close enough that their economy would collapse in weeks.

Then we can accept their surrender and impose a just but firm peace as part of which every last centrifuge, every last bit of nuclear technology, is rooted out of that country, as verified on a continuing basis by American and international inspectors on a continuing basis for the next century.

  45. Greetings:

Back in the early ’80s, I was working as a staffer for an organization that was in its “acquisitions and mergers” phase. The fundamental lesson I was taught went, “Can he make the deal ??? Can he keep the deal ???”. The head-wrapped mullahs can obviously make a deal. They had made a previous one in this regard. But can they keep a deal, well, no would seem to be the answer to that part.

The other bit of ideological idiocy that keeps popping up is “The USofA” will find itself “isolated” as if enough true sophomores say something so sophomoric some sophomoric snophlakes somewhere their dream may actually come true. Growing up in the Bronx of the ’50s and ’60s, there was an expression that went, “If he were a girl, he’d always be pregnant”. The USofA has been continually impregnated over the last fifty or so diversely multicultural years as our rulers have too often and too long let the less productive of our world sup at our table. The largest economy and military it the world is in exactly zero probability of being isolated. These blood-suckers don’t cut the nose off their own faces. They cut your nose off your face.

Ever since the fall of the USSR and the birth of the “Unipower” idiocy, I have thought that ridiculous. MY teaching tool in that regard comes from one of those nature films in which a male lion, the proverbial King of the Jungle, is defending his kill from a pack of non-laughing hyenas looking to benefit from the fruit of his labor while the rest of the pride mills about considering whether to joy the fray or protect the next generation, or just enjoy the show. That’s the world we live in.

Former President Obama pointed out that doctors like cutting people’s feet off because they get $17,000. And maybe we cut people open to take out their appendix because that’s what Americans have always done since we learned how. But maybe it’s a lot cheaper, before the bowel is perforated, to treat with antibiotics. Although if your appendicitis coincides with a Wu-Tang Clan release your antibiotics may be more expensive.

I would now like to transition over to the ME since it coincides so well with the bowels.

Iran is an inflamed appendix. Doctors that want to cut it out right away are neocons. Dr Beldar wants to treat it with antibiotics and observation. Dr Burn is a too gullible Christian Scientist. Israel doesn’t want to s*** in a bag.

“The goal was to try to change US public opinion and to manipulate America’s political establishment toward helping Britain in its fight against the Nazis. In 1940, this was no sure thing. Incumbent Franklin D. Roosevelt wanted to help the UK but faced an uphill battle to overcome isolationist and “America First” views.

World War II began in Europe in September 1939. By June 1940, Britain was fighting alone against Nazi Germany. All its allies had been crushed and occupied by Hitler’s Germany. Britain was fighting for its life.

Both London and Berlin knew that only US intervention could change the course of the war in the UK’s favor. So both nations set out to influence the US election. Churchill had just become prime minister in May 1940, and he hired freelance agent William Stephenson to head up the new North American operation. Stephenson was a Canadian, a war hero, a brilliant inventor and a wealthy and well-connected industrialist. He set up shop on June 21, 1940, at Rockefeller Center in New York City. Room 3603 became headquarters of an organization he christened “British Security Coordination.”

Within days, Stephenson scored a major victory at the Republican Party convention in Philadelphia.

The Brits obviously liked FDR, since he was already campaigning to increase assistance to the UK. But just to hedge their bets, the Brits tried to get a like-minded individual in as the Republican nominee.

The only GOP candidate with a pro-British agenda was one Wendell Willkie, from Indiana. He went into the convention as a decided underdog.”

Churchill too liberal for US conservatives and the saw FDR as a whit Obama.

    DRJ (15874d) — 10/14/2017 @ 6:31 pm

Yes. I have a lot of frustration with Trump, and this is the main one. He’s not going to explain conservatism to people. He’s not going to respect his critics in our country enough to even try. He doesn’t really care for the concept in the first place.

Ted Cruz had a zeal for engaging people who disagree with him and would have tried to explain why his policies are better for the country. He would take his criticism as an opportunity. No, it won’t work on 90% of the left, but it worked sometimes.

Also, the conservative movement itself is very weak. We as individuals are often very eager to get our share of the trough of entitlements, and when that is threatened we get pretty mad about it instead of recognizing what we have that future generations will not have. You can see this in particular with boomers and their social security and healthcare. Haven’t they left enormous, crushing debt and a fiscal disaster to the future taxpayers? And if the solution is to give them the entitlements they’ve earned (not what they were promised), isn’t that right? I think it is.

  144. I readily admit to being a fair-weather MLB fan, but it is the very fairest of weather for Astros fans this year, and I’ve been watching them quite regularly since about mid-season, by which time it was already obvious that this was a memorable and yes, adorable team, perhaps a team of destiny.

What can you say about Altuve this year, and this post-season? That he made a rare and consequence-free error in Game 1 only shows he’s mortal; otherwise one would suspect him of having been to that laboratory where they gave Deadpool his superpowers.

But Verlander’s complete-game win today, nine full innings of one-run baseball, just dominating some really good hitters throughout, and obviously living inside their heads, tickling their doubtiest places — that was a throwback to the golden era of pitching of the late 1960s. I was very much reminded while watching him today of this terrific 2015 book by Hall of Famer Bob Gibson, sometimes nicknamed “Hoot”: Pitch by Pitch: My View of One Unforgettable Game, written about his 17-K 5-hits/no runs full-game performance for the St. Louis Cardinals in Game 1 of the 1968 World Series against the Detroit Tigers. I highly recommend this book even to baseball novices for its crackling prose and deep insights on matters including, but by no means limited to, pitching and baseball. Verlander’s not pitching — yet — in a World Series, but the way he dominated for nine full innings today, the attitude and focus he displayed, very much reminded me of Mr. Gibson, whom I very much hope is still in good health (and I read that he was at Cardinals’ spring training this year, so that seems likely) — in which case he was probably watching today’s game appreciatively.

We have recently learned how to prophetically speak truth to power but have lost the nerve to speak prophetically to ourselves. The problem is always out there, in an unjust institution or a careless or evil person.

We avoid repentance because we remain addicted to the drug of self-justification. “I don’t need to repent because I’m the one righteously calling out the social and personal sins of others.” Or “If I say I am complicit, it will give my political and social enemies leverage against me and my cause.” Or even more to the point, “If I were to really look at and then acknowledge how much self-centeredness and pride infects even my most righteous actions, I would have to admit I’m a hypocrite and a moral failure.”

Has it occurred to anyone that he timed it, so as to have the loss, if any, if Congress does not appropriate the funds, come out of the insurance companies?

It’s past the deadline for setting rates for 2018. Now some states let insurance companies file alternate rates, but some other states, like Maryland, insisted that rates had to be based on the payments continuing.

Of course making the insurance companies take the hit is good only for one year, and if they go bankrupt, it doesn’t benefit anybody. Of course those which couldn’t risk a loss, or miscalculated already, are no longer on the Obamacare exchanges,

  158. This deal is in the nature of a treaty. The subject matter, the extent of the promises made, and everything else about it scream: TREATY. But it was not ratified by the U.S. Senate.

It’s not a treaty, and it was Iran especially, that didn’t want it to be a treaty. It’s a “Plan of Action:”

If the nations do this, Iran does that. If Iran does this, the U,.S> and other countries do that. There is no moral opprobium to pulling out of it.

Iran actually claimed, it is in the agreement, that if the U.S. took action of failed to take action (in the form of restrictions on others that prevent or deter investment or deals with Iran, or maybe other sanctions)so as to nullify the value of the lifting of the sanctions, Iran would consider the deal abrogated. The United States disagreed. This was specifically on;y a claim by Iran.

Iran insists the deal is binding, not because it is treaty , but because it is a United Nations Security Council resolution, which the United States even sponsored. But the resolution only removed United Nations imposed sanctions – it did not prohibit any country from putting on their own sanctions..

  159. http://www.politico.com/magazine/story/2017/10/14/trump-evangelical-nationalist-alliance-215713

Others, however, are taking a more direct approach. The biggest draw of the weekend event, other than the president himself, was Roy Moore, the Alabama Senate candidate and former chief justice of the state’s Supreme Court. Moore was removed from office twice: once for refusing to remove a Ten Commandments monument from courthouse grounds, and 14 years later, having reclaimed the position, for directing state judges to ignore the federal government’s legalization of same-sex marriages. To Moore and his admirers, these incidents were evidence of American turning its back on God—tribulations that have been used to rally the faithful in his deeply religious state as he went from a quixotic Senate hopeful to the favorite.

When Moore spoke to a Friday luncheon sponsored by the American Family Association, he was introduced unapologetically as someone who would put Christianity ahead of the Constitution. When a video played detailing the Ten Commandments saga in Alabama, the room of several hundred retirement-age attendees shook their heads in disgust. And when he took the stage, he stirred the crowd. “It was never about the Ten Commandments; it was about the God who gave the Ten Commandments,” Moore said. “We forget that what they really want to do in this land is remove the knowledge of God. That won’t happen, as far as I can see, because I think the people of God are rising up in this land today. In 2016 we were given a new lease, a new reason, and it’s upon us now.”

Seated at the rear of the room, John and Jill Stabley nodded along. The older married couple from Delaware have attended the Values Voter Summit seven previous times, but this year feels different. “Suddenly hopeful,” Jill says. “We grew up in an era where people were thinking of others, and trying to do the right thing—.” John interrupts: “And walking with Christ.” He pauses. “There’s no going back. All these outside people are coming in and tearing us apart.”

The cash was not in exchange for hostages. It was to keep Iran from backing out of the deal. Which the Obama Administration didn’t really want to say very loudly.

However, two things: First, the Obama Administration would not release the money unless the hostages were also released and they made sure they were before putting the cash aboard the plane in Switzerland; and second the way they got the authority to give them the money was by making this a settlement of claims dating from 1979.

Secretary of State John Kerry claimed it was a good deal because Iran got a lot less interest than it was demanding.

our seeming promise to be less aggressive in Syria as a trade-off . .

I don’t think that happened actually. The problem in Syria anyway, was Russia, plus the idea that maybe there wasn’t a legal basis for the U.S. to get involved in fightting the government of Syria. Israel was tougher with Russia in Syria.

  164. The big things wrong with the deal are:

    1. It doesn’t deal with anything else that Iran is doing – and might seem to prohibit sanctions for non-nuclear purposes (here there is maybe a disagreement between the U.S. and Iran.)

1a/ In particular it doesn’t deal with missiles, which are almost as important, or maybe even more important, than the nuclear bombs themselves.

    2. It expires. After which Iran could soon have even 100 nuclear bombs, according to Israeli Prime Minister Benjamin Netanyahu. He said on Face the Nation today that what he said about the agreement before is that it’s a bigger problem if Iran keeps the agreement than if it doesn’t. And it really doesn’t matter if it does or if it doesn’t (i.e., there’s a serious problem that needs to be dealt with either way.)

He says that Iran doesn’t want to have a nuclear bomb right now anyway because of what other nations would do. It’s a red line they haven’t crossed, and they didn’t cross it before the agreement. He says he is grateful to President Trump for not kicking this can down the road.

More important, they can develop them in the territory of North Korea. <block

Why Gen. Mattis is not disturbed enough by the lack of access to military bases to scrap the deal, I don’t know

    Sammy Finkelman (9f1a19)

  168. So far no request has been denied, but anyway Iran is probably not relying on that loophole.

Gen Mattis possibly overvalues U.S. intelligence

There was another hint today (missed maybe by some) that an attack on North Korea is a real possibility not too far in the future. Secretary if State rex Tollerson says he is prepared to negotiate until the first bomb drops.

I think he’s talking about an American (non-nuclear) bomb.

Well, I can see that Tillerson is speaking nonsense, although it is kind of true that “the U.S. will see if it can address the flaws in the Iran nuclear deal by staying within the agreement and working with the country’s friends and allies….That may come in a secondary agreement as well.”

There’s no reason for this secondary agreement to happen.

Now with arms control treaties with the Soviet Union, an agreement didn’t mean there would be no further ones, but the problem with that here is that nothing but sanctions or the threat of military action can reasonably be supposed to push Iran to agree to more and without more the situation gets more dangerous after 7 to 8 years.

It can argued that ripping up the first agreement doesn’t do anything unless the first agreement is interpreted as meaning the U.S. will ask for no more. It may sort of preclude nuclear based sanctions.

So all that Tillerson is doing is temporizing – postponing the moment of truth – – making compromises with reality.

He’s new to Houston, and us to him, but if there ever were a baseball love at first pitch, we’ve got it going with her sweetie, and she’ll come around, or not; she’s welcome either way.

I agree with that in general and re this specific example. Good cop/crazy cop, a la the whole “Lethal Weapons” franchise, with Trump as crazy cop. It’s a thin silver lining prone to tarnish, but one can hope that Tillerson et al. are exploiting the chaos for its in terrorem effects anyway.

Sorry. Won’t wash. The Paula Jones suit established clear precedent. The Republicans who gleefully seized upon that suit as an excuse to rummage through Bill Clinton’s entire sexual history cannot now complain. Anyone old enough to remember who Lucianne Goldberg or Linda Tripp were will cackle at the following:

I’m sorry happyfeet and Sammy but I think you’re both wrong. I think Chelsea will be groomed for power. She may not be the sociopathic liar her mom is nor the sexual deviant pervert her dad is YET, but she can, and will be trained.

I think they are TRYING to train her, but it won’t be successful. They kept her ignorant and honest too long.

I saw the way she looked on TV in 1992 at the Democratic National Convention when she was 12 when her father was saying he balanced “11 budgets in a row” The camera shot to her and her face looked so bad.

I was one of the few people who knew it was a lie. I had read Diane D. Blair’s book “Arkansas Politics and Government”.

Al Gore repeated that lie twice for emphasis.

It wasn’t just misleading and you might think not even worth pointing out – but it is – misleading that is, because he had no choice but to balance the budget, and because if the previous budget is balanced it is ot so difficult to do that with the next budget.

    It was an OUTRIGHT LIE.

Arkansas had a two year budget cycle. (Bob Dole wanted the federal government to go that by the way, but the idea seems to have been forgotten.) And when there was a budget shortfall, the Arkansas legislature would pass temporary taxes ((usually sales taxes on selected lists of items.)

What’s more, Governor Clinton hadn’t even been Governor for 11 years in a row. He’d been elected as Governor first, in 1978, lost in 1980 and was elected again in 1982, and in 1984, and in 1986 (at which point he had secured an Arkansas constitutional amendment extending the Governor’s term to 4 years) so he was elected again in 1990, promising to serve out his full term by the way.

And there are stories you could tell how Jim Guy Tucker came in third and didn’t make the runoff in the first primary in 1982 – the murder plotter Mary Lee Orsini claimed that she had been having an affair with him – and in 1984 when when Bill Clintons backers got behind the candidacy if Orval Faubus – yes, that Orval Faubus, and I don’t think they had really turned against Clinton.

OK, Chelsea. They did bring her up not to judge close family. But they also, I think, kept her a little bit stupid. Made sure she wasn’t aware of things.

And then later on they started to corrupt her. But they didn’t get her involved in lying – they kept her from the press.

They only began to corrupt her when she was in her 20s, get her used to money, and she only began to get involved in campaigns in 2008 and I don’t think even began to lie till close to the 2016 campaign. Maybe about 2015. They brought her into the Clinton Foundation – they had her try to mislead people about Bernie Sanders.

She won’t be good at lying. She was asked over the weekend about Howard Weinstein’s contributions to the Clinton Foundation – you know the question is, at least whether the money would be returned – no that’s not god – but like Senator Schumer and Governor Andrew Cuomo – would it be donated to some sort of women’s charities – maybe anti-sexual harassment or women victimized by men charities.

The best Chelsea could do was to say nothing.

Just like they train ninjas they’ll train her to be invisible in the art of political deception.

Theyll have other people counsel her. But she can’t be in charge. As I said, the best they could be able to do is get her into the House of Representatives. Not the Senate, although after Kirsten Gillebrand, who can say?

Then Hillary? will turn over the list of hit men she uses so her “friends” commit suicide properly.

First of all, any such list is in the custody of Bill Clinton and it is not so simple. And any such thing would be custom made. Like with the Branch Davidians in Waco.

I don’t think the Clintons will really fall until the full truth about what started the fire becomes known. It was CS tear gas, of course, and they didn’t use it till just before the fire. It diffused to the proper concentration and approached the kerosense lanterns. It was perfectly predictable, but officially that fact about CS tear gas wasn’t acknowledged.

Charles Schumer (then iin the House of Representatives) helped cover it up in a Congressional hearing, a real low point for him. He was getting witnesses to say everyone agreed the Davidians started the fire. One thing every survivor denied. Plus denying that they’d fired any weapons on April 19.

But what Clinton didn’t have on retainer was fire experts, rather he had people who knew who was corrupt, and so on. That’s who supplied him with the names etc. There’s a certain person I’m suspicious of because he could have known all the fire experts in the country, and later on, that November, after the New Jersey gubernatorial election, he acted in a way that only makes sense if he was being blackmailed by Bill Clinton, and he’d also previously seemed to help Bill Clinton in 1992 with Perot.

Bill Clinton, I think, had an encyclopedic knowledge of corruption and lawyers who got people off and so on.
