Frankly, It Would Be Surprising If This Wasn’t Happening In California

With Gov. Jerry Brown’s approval, California’s Democratic state Sen. Scott Weiner’s recent bills put the Golden State’s nuttery on full display. As if we needed more proof.

First:

Gov. Jerry Brown signed a bill Friday that lowers from a felony to a misdemeanor the crime of knowingly exposing a sexual partner to HIV without disclosing the infection.

The measure also applies to those who give blood without telling the blood bank that they are HIV-positive.

Modern medicine allows those with HIV to live longer lives and nearly eliminates the possibility of transmission, according to state Sen. Scott Wiener (D-San Francisco) and Assemblyman Todd Gloria (D-San Diego), authors of the bill.

“Today California took a major step toward treating HIV as a public health issue, instead of treating people living with HIV as criminals,” Wiener said in a statement. “HIV should be treated like all other serious infectious diseases, and that’s what SB 239 does.”

Opponents to the bill expressed their concerns:

Republican lawmakers including Sen. Joel Anderson of Alpine voted against the bill, arguing it puts the public at risk.

“I’m of the mind that if you purposefully inflict another with a disease that alters their lifestyle the rest of their life, puts them on a regimen of medications to maintain any kind of normalcy, it should be a felony,” Anderson said during the floor debate. “It’s absolutely crazy to me that we should go light on this.”

Weiner is also defending his bill that would “allow for penalties of up to one year in jail for health care workers who “willfully and repeatedly” use the “wrong” pronouns to refer to a senior transgender patient“:

Weiner has also dismissed concerns about religious freedom regarding the criminal punishments for health care workers who don’t use transgender pronouns.

“Everyone is entitled to their religious view,” he said. “But when you enter the public space, when you are running an institution, you are in a workplace, you are in a civil setting, and you have to follow the law.”

Opponents to this bill also expressed their concerns:

“How can you believe in free speech, but think the government can compel people to use certain pronouns when talking to others?” Greg Burt of the California Family Council testified in July.

“This is not tolerance. This is not love. This is not mutual respect. True tolerance tolerates people with different views. We need to treat each other with respect, but respect is a two-way street. It is not respectful to threaten people with punishment for having sincerely held beliefs that differ from your own.”

Misgendering gets a person jail time, but knowingly exposing individuals to HIV in the Golden State isn’t that big of a deal.

It’s downright funny to read the transcript of Ronald Reagan’s taped announcement on his candidacy for California Governor from 1966. What a distant memory.

    Two considerations, NK:
    1) I have a real fear that my Second Amendment rights are not respected there. I would just be trading one bad circumstance for another.
    2) My health issues are almost as serious as the Rev’s. At least here my doctors know me, and vis-versa.

    Otherwise, Chitown would be an excellent change of scenery. I never worried about the soda tax anyway- poison of choice is iced tea, no sweetener, no lemon, no frou-frou flavoring, and strong enough to melt your socks.

    Let me try to break this down a little for you. It might surprise you that SoCal once tyou get south of LA is relatively conservative. Much of the central and northern portions of the state lean conservative. Where you find the majority liberals are in the Los Angeles Basin, San Francisco Bay Area, and Sacramento and it’s environs.

    You see, the problem comes with population. San Diego, even with it’s relatively large minority population is a fairly conservative city. If you need proof, you need look no further than our last Mayoral election, and the reason for it. Not perfect by any means, but still a hell of a lot more conservative than, say, Villaraigosa of LA.

    The problem is we here in the south are completely outvoted. Lots more people in LA than SD.

    So, no, I don’t deserve what’s coming my way. And if your suggestion is sell the house and move, in my physical and financial condition, just not practical.

  44. The problem with the pronoun law is that it’s a law. A business exists to serve its customers. If those customers expect to be addressed a certain way, the business can choose to require its employees to do so or simply state that that “service” is not offered and the customer can go elsewhere to find services tgat are more in line with their values. The state has no business being involved in any of this. But lawyers gotta law and stuff, so drinks all around.

    Isn’t that just gentrification, kishnevi? In Philly the hipsters moved in to the Northern Liberties section and a new redeveloped high-end neighborhood was born. They literally drove out the blacks and Hispanics with high rents, high priced eateries and places like Whole Foods instead of Aldi’s or the dollar store. Plus now they have police patrolling all over the place. The former residents up and moved to a South Philly area and reestablished their crime ridden ghetto down there. It took a few years but the transition was a wonder to behold. And area that was a ghetto turned into a first class urban center and a South Philly neighborhood formerly of Polish/Jewish/Italians was devolved into one of the worst areas in Philly.

    You on;y heard or witnessed the part about neighborhoods getting bad then. It moved north in the Bronx at a rate of about 400 feet a year. I think things stablized in the 1980s, aided nbby new immigrants.

    Gentrification didn’t happen till at least the 1990s.

    Of course, incumbent politicians don’t like gentrification, and theer are other losers from a reduction in the crime rate.

Weiner is my state Senator, and I voted for him in the general election because *on the issue of housing*, he is substantially more supportive of housing construction than his opponent in the general election, who is one of those San Franciscans who believes that if we force all construction to be ‘affordable housing’, and don’t build anything new in neighborhoods that object to new housing construction, the problem will solve itself.

    That said, I disagree with both of these bills.

    I would handle the senior transgender patient issue by allowing patients to sue the health care provider for pain and suffering caused by misgendering, and by allowing punitive damages in cases of patterns of wilfull repetition; this would make it a *civil* issue between the patient and their health care provider (rather than a criminal one), would provide some sort of redress for the vulnerable elderly, and would use economic pressure to get employers to make their employees treat people well.

    I think that the change to the law regarding transmission of AIDS is *wrong*.

    When I’ve argued that latter point online with people who support the change, the answer I got is that the *stigma* against being HIV+ is now more harmful to the lives of those with HIV than the disease, which is treatable as a chronic illness is.

    I acknowledge that the stigma is a problem, but … it’s a fatal disease. Honestly I think that *deliberately* spreading it should be treated as attempted murder.

  87. Hoagie, under current California law, for *health care workers* to use a pronoun other than the pronoun requested by the patient is now a criminal offense. I don’t think it should be. And I’m aware of and sympathetic to the concern — imagine a trans* man who is in a nursing home where everyone keeps referring to him as *her*. Pyschologically, for him, that is extremely damaging — but I would prefer to resolve the problem using civil actions; this isn’t the sort of thing that criminal law should attach to.
