The Jury Talks Back


Recall the Fresno County Registrar.

Apparently Fresno County printed the wrong ballot title and summaryfor Proposition 23.

(The summary had been changed by court order, but the Fresno County registrar wasn’t keeping track of it, apparently, and so the ballots went out with a title and summary that a state court had ordered off the ballot).

“Fresno County is a county of significant size in California and in a close election, its vote, now tainted by this serious error, could call into question the state results and possibly give rise to an election contest and require a new statewide election on Proposition 23.” So says an attorney for the Yes-on-23 campaign. And she’s right: if state law requires a particular title and summary and a different one was provided on the ballot, it’s not even clear that the election results are valid.

I’m pretty forgiving of most human errors. But this one is inexcusable.

    And red has a point too… this is a serious matter and someone is trying to play a cute game with an election.

    It may not seem like much to some Cali Progressives to change “source of emissions” to “polluters”, but we’re a nation of laws and the law spoke on this. And it’s actually pretty obvious that the terms describe somewhat different things. Whether CO2 is pollution is under debate… whether it’s an emission is not.

    It’s bad news for proponents and detractors of Prop 23. I like Prop 23’s idea of associating environmentalism with your economy, but I’m an even bigger fan of following the rules on election day.

  3. Dustin – I’m voting against Prop. 23, but I’m also outraged by this, and if the margin of victory (for whichever side wins) isn’t larger than the voting population of Fresno County, there will be lawsuits.

    According to they got Prop. 22 wrong, too.


    Basically it seems like they just ignored the courts when the courts rewrote the AG’s ballot descriptions.
