Blasey Ford Camp Outlines Conditions; GOP Working On Counter Offer (UPDATE: Blasey Ford Camp Responds To Committee Deadline)

Filed under: General — Dana @ 11:07 am

[guest post by Dana]

Yesterday, Christine Blasey Ford’s attorney, Debra Katz, outlined the conditions that must be met in order for Blasey Ford to testify before the Senate Judiciary Committee:

Ford will not appear any sooner than next Thursday*;

No questions to be asked at hearing by any outside counsel — only by Senators;

Mark Judge must be subpoenaed;

Kavanaugh would testify first, then Ford would testify, and Kavanaugh would have no opportunity to respond or rebut;

The Friday deadline for her to provide written statement before the hearing would be waived;

Provide adequate security;

Only one pool camera in hearing room;

Ford and Kavanaugh allotted the same amount of time to talk.

* Regarding a written statement by Friday is a “non-starter,” and testimony on Monday is a “dealbreaker” according to Katz:

…because “[i]t is simply not possible for her to prepare such testimony while at the same time trying to take appropriate security precautions in the face of the avalanche of threats she has been receiving.”

Obviously, the demand that Kavanaugh would testify first and have no opportunity for rebuttal is so problematic, it is unacceptable. As some have pointed out, yes, this isn’t a court of law, however:

Just this morning, CNN is reporting that the GOP is working on a response Blasey Ford’s demands:

Two sources say the Senate Judiciary Committee will likely send a proposal to Christine Blasey Ford’s lawyer proposing a Wednesday hearing, with Ford testifying first and Brett Kavanaugh second.

The proposal would have outside counsel asks the questions.

As noted:

Offer not final and not sent, per numerous GOP sources. Discussed on Judiciary R call this morning

We need to hear from both of them. Given that both sides of the aisle agree that a very serious allegation has been made, both the accuser and the accused should be provided a secure forum in which to which to be heard and be available for questioning and examination. In spite of various factions already assuming Kavanaugh’s dishonesty and Blasey Ford’s honesty and/or Kavanaugh’s honesty and Blasey Ford’s dishonesty, if the primary concern is rooting out the truth, then wouldn’t both sides of the political aisle want them to testify? And wouldn’t the individuals themselves want that opportunity as well? Ultimately, the public needs to hear from both to see if their claims stand up under scrutiny. If that hasn’t yet happened in full, how on earth has anyone already made a definitive call about guilt or innocence? Unless, of course, the real priority here isn’t really about any allegation and denial. And that, sadly, is where we find ourselves: If the voracious and insatiable appetite of partisan politics demands the exploitation of an individual’s alleged assault and the subsequent destruction of another individual – whether innocent or guilty, then so be it.

UPDATE: Earlier today, the Senate Judiciary Committee gave Ford a 10 p.m. Friday deadline to make her decision as to whether Christine Blasey Ford would testify on Wednesday:

The committee, led by chairman Chuck Grassley, R-Iowa, said Ford could testify Wednesday — a day earlier than she demanded, but also two days later than the day the committee had originally announced, Monday. The committee is also proposing that Ford testify before Kavanaugh, as opposed to after, and that outside counsel handle the questioning. According to a GOP committee aide, the exact language in the counter offer asks Ford, “Please respond by 5 p.m.”

Katz responded to the letter, which she made a point to note that it had been sent at 4:00 p.m.:

“I advised you that Dr. Ford had traveled to meet with the FBI for several hours about the death threats she had been receiving, and we would need until tomorrow to confer with her and to be able to provide you with a well-considered response,” Katz said in the letter. “Rather than allowing her the time she needs to respond to the take-it-or-leave-it demand you conveyed, you sent us an email at 5:47 p.m. – which you again gave to the media first – insisting that we accept your “invitation” for a Wednesday hearing by 10:00 p.m. tonight.”

She further claimed:

The 10:00 p.m. deadline is arbitrary. Its sole purpose is to bully Dr. Ford and deprive her of the ability to make a considered decision that has life-altering implications for her and her family. She has already been forced out of her home and continues to face harassment, hate mail, and death threats. Our modest request is that she be given an additional day to make her decision.

You can read the response in its entirety here.

As a reminder, the next term of the Supreme Court begins Oct. 1.

  1. It’s an ugly season in which we find ourselves.

    Dana (023079)

  2. And sadly, Dana, you will see that ugliness on this thread shortly. Sorry, Dustin, for being “repetitive.” But I hope I am not the only one who hopes for a lack of nastiness and namecalling among contributors here. We say we don’t like it when the Democrats do it. But I think we love it; we seem to value mudslinging and lies about others.

    I don’t. But that’s me.

    Simon Jester (975309)

  3. Simon … we’re all adults here … and the “working the refs” by you, and others, gets rather tiresome.

    bendover (8f3556)

  4. I strongly suspect the Dems will keep adding or changing demands and moving the goalposts.

They clearly don’t want her to testify, and I suspect the plan is to keep stringing things out until Grassley finally throws his hands up and says “that’s our final offer, take it or leave it”. And then they will reject the offer and whine about “unwillingness to compromise”. This is all theater.

The closer the two sides *appear* to be to an agreement, the harder it becomes for the GOP to say “no, that’s unacceptable” to any particular demand and just go ahead with a vote.

    Dave (445e97)

  5. What serious person — specifically what licensed attorney — would demand that Ms. Ford be allowed to make her allegations, but Kavanaugh not be given a chance to rebut them in a public forum? I hope Sen. Grassley lets the Ford Team know that is entirely unacceptable. I would imagine that committee Democrats will stage a dramatic walkout once Kavanaugh begins his rebuttal anyway.

    JVW (42615e)

  6. Unless, of course, the real priority here isn’t really about any allegation and denial.

Yeah, that’s where we are. I think the folks here underestimate the titanic pressure Ford has got to be under right now. It’s not only the Supreme Court but control of the Senate that could be at play. Her side wants the visuals of Orrin Hatch asking inept offensive questions. God, the amount of promises and threats her allies are making…

Frankly, this should be done in private or public with no cameras or recorders, with maybe one tape to be made available after the election. If you want truth, the cameras and recorders shouldn’t matter. And if this is just partisan nonsense, well, shame on you.

    Appalled (1a17de)

  7. Dave, your assessment is probably correct. I think the next step the attorneys for Ms. Ford will make – is to make a statement to the Maryland police to bring Kavanaugh up on charges – then the media will parrot the meme “how can the Republicans vote for a SC candidate who’s under investigation of sexual assault” ???

    bendover (8f3556)

  8. Based on the childishness I see daily—the juvenile nicknames, casual accusations of felonies like child molestation, and the fake macho tough guy attitude—I would argue, bendover, that not everyone is terribly grown up around here.

Notice I said “hope.” My opinion matters too. Not just the folks who are quite literally the mirror image of the people they claim to hate.

    YMMV

    Simon Jester (975309)

  9. That said, I hope and pray that Kavanaugh receives the consideration that anyone accused of a crime gets.

Or the consideration that Keith Ellison is currently receiving.

This is so clearly partisan that I am hoping it will backfire. But we shall see.

    Simon Jester (975309)

  10. Since when does an accuser get to dictate the format of an investigation? It seems that Ford wants her own Star Chamber.

    Chuck Bartowski (bc1c71)

  11. Simon, some of the juvenile stuff is funny, some I just roll my eyes and move on. I suspect that you’re referencing Happyfeet when you talk about “ugliness” – I view Happyfeet as a reincarnation of Andy Kaufman. Sometimes inappropriate, sometimes outrageously on point.

    But as you say, YMMV

  14. I would subpoena Brenda Katz. She’s the one who knows the whole story.

No, there is no attorney-client privilege in Congress.

But there is one in an FBI investigation. (Hint, hint.)

    nk (dbc370)

  15. I agree, Anonymous. And I believe that some of the, um, flexible approaches to this kind of thing need to be out front and center. If we believe all accusers, and need to do whatever they wish or we are heartless trash…what about the Keith Ellison case?

The best I have seen is to argue that Kavanaugh will have a lifetime appointment. And already some Democrats are claiming that they will try to impeach him.

Sadly, I don’t think this has a darned thing to do with a purported sexual assault, or #MeToo. It is purely a “the ends justify the means” scorched earth war.

And most Americans, honestly, prefer fairness. So I think putting the light on two related cases and how they are handled, is very appropriate.

If the Democrats want to oppose Kavanaugh on professional grounds, they should. But I don’t believe they can. So here we are.

    Simon Jester (975309)

  16. nk, I think I know what they are hiding (besides the obvious “no evidence” and such). I think that there is information about the good doctor that doesn’t fit the narrative. You saw the yearbook business, I presume?

In any event, I very much like your proposal. And agree about your hint.

    Simon Jester (975309)

  17. The only actual evidence seems to be the expurgated pages from Manchester prep, which the times sheepishly concedes exists.

So actual criminal information vs imagination inflation.

    Narciso (c31c88)

  18. I’m skeptical that this hearing will tell us anything we don’t already know. Dr. Fort (the appellation she insists on) has been unable to recall exactly when the alleged assault took place, or even whose house the party was at. Will she suddenly begin to recall more details? It will still come down to “she said he said,” and there will be no more clarity than before.

  20. This is probably worth an update. Since Ms. Ford’s lawyers are negotiating her appearance in public, the Senate GOP is doing the same with their counter, and this should be take it or leave it.

“We’ll do it on Wednesday, we expect the accuser before the accused, and we do intend to have the counsel do the questioning,” the senator said, summing up the Republicans’ stance.
The party is assenting to two of the terms Ford’s lawyers laid out in a Thursday evening call with staff from both parties, the senator said: limiting the hearing to one camera and ensuring that Kavanaugh is not in the same room as her.

Sounds reasonable to me. The Dems rationale that she can’t appear before Thursday is ridiculous.

The GOP has been told that Ford does not want to fly from her California home to Washington, according to the Republican senator, which means she may need to drive across the country to make the hearing.

  21. “[i]t is simply not possible for her to prepare such testimony while at the same time trying to take appropriate security precautions in the face of the avalanche of threats she has been receiving.”

  23. The GOP has been told that Ford does not want to fly from her California home to Washington, according to the Republican senator, which means she may need to drive across the country to make the hearing.

This person is changing the course of the highest court in the land but she can’t fly across the country? Really? We ask a whole lot more of a whole lot of victims of crimes. In fact I believe our society often asks victims to be in the courtroom and identify the perpetrator. Exceptions make sense in extreme scenarios, but Dr. Ford is an adult, this crime was 35+ years ago, and I don’t really agree with those saying it’s reasonable they not be in the room together.

As for the repeated demand that he testify before she makes her accusation… what? How? Why would a lawyer ever think that’s reasonable?

But the worst part of this is that she claimed she was sexually assaulted, asked to remain anonymous, and was completely exposed. The person who did this needs to be identified and face consequences.

And yet it wouldn’t surprise me one bit if they accept this demand at the last minute. Therefore, it’s not really all that unreasonable is it? When you’re dealing with people who are already caving in, who repeatedly shown no backbone, and you are shameless enough to not give a rat’s about your reputation because past experience has shown you have been very, very successful at dictating what the new rules are, nothing is unreasonable.

I suspect we’ve had scandals in politics prior to Donald Trump being criticized. In fact, I do not think criticism of Donald Trump is the root of really any evil at all. However, I do think Trump’s sexual scandals are a major aspect in the movement on the left to fuel this issue. Trump did, after all, brag about how his star power enabled him to grab women wherever he wanted, and actually I guess he’s done a lot worse than that.

I think many of Trump’s supporters really like that he’s so anti-PC because they hoped it would just defuse the whole PC climate entirely. Just laugh it away. I actually saw some appeal to this, but it’s definitely not working.

“In other words, what Democrats have sought is delay. What Republicans are allowing them to have is delay. The contemptuous stall strategy is being rewarded.”

“Bluntly, Democrats do not care about Dr. Ford. If she were lodging a similar complaint against, say, Congressman Keith Ellison (D., Minn.) she would not be heard, and the media would be pretending she did not exist. Democrats are exploiting Dr. Ford (or perhaps capitalizing with her willful complicity) because they believe they might win enough seats in the November midterms to take control of the Senate and, with a committee majority, degeat Kavanaugh’s nomination.”

The squawking senators, the tweeting president, the TeeVee pundits and print partisans, and long letters w/character references aren’t going to change anything one way or another; The best help they can offer now is to just zip it for a short time and let the teams involved work out the particulars.

They’ve been running old TeeVee news packages from 1987 reporting the revelation that Reagan SCOTUS candidate Doug Ginsberg smoked Mary Jane at law school which forced his withdrawal as a nom. That seems like a very reasonable way to handle this.

I realize Lany is joking, but the problem here is that I don’t think there’s probable cause for charges.

I recall a really bad Lubbock rape conviction years ago, based entirely on eyewitness testimony of a credible woman. The convicted, innocent man, Timothy Cole, was later acquitted thanks to DNA evidence, but he had died in prison. Eyewitnesses can be wrong. I can’t even imagine how much more horrible the raped woman’s experience was because of how her testimony was mishandled.

To me, 35 year old eyewitness testimony, with little detail, and little corroboration, is not probable cause. And that doesn’t mean the poor woman, Dr. Ford, is some evil witch as some commenters on this blog believe her to be.

Shame on the people who leaked this whole issue without investigating it.

No freakin’ way. This is insane. This is what I mean about losing. Keep giving in and giving in and giving in, giving them even more time to manufacture whatever they ultimately will manufacture. 44. Yesterday, Christine Blasey Ford’s attorney, Debra Katz, outlined the conditions that must be met in order for Blasey Ford to testify before the Senate Judiciary Committee:

    Ford will not appear any sooner than next Thursday*;

    Is this her condition?

That one actually seems to be a Senate rule. Committee meetings are not supposed to be scheduled less than a week in advance, so when that was proposed yesterday it couldn’t be scheduled for earlier than next Thursday. That’s why the invitation was originally scheduled for last Monday (September 17) Because the invitation was made on September 10. Now they are saying the following Monday (October 1)

    No questions to be asked at hearing by any outside counsel — only by Senators;

    I can guess why.

The better for her not to get caught in a lie or discrepancy.

Senator Susan Collins proposed that a lawyer for Brett Kavanaugh be allowed to question Christine Blasey, and a lawyer for Christine Blasey be allowed to question Brett Kavanaugh. (with Senators asking questions later) Now Blasey’s lawyer captor, knows that her client’s prisoner’s story would be destroyed by that.

    She knows.

    That explains all of this.

Another proposal I read would be to have two former Supreme Court clerks, one Democrat, one Republican do the questioning. Not quite as good. But one could be a former Kavanaugh clerk.

    Mark Judge must be subpoenaed;

He apparently doesn’t want to make public statements. Not sure whether it’s because he doesn’t want to be vilified and worse, or because he would have to admit alcoholic blackouts, or perhaps a different incident.

He is on record as denying it, but that statenment was made before this all became public.

The committee is probably willing to hear Mark Judge but not to subpoena him. His testimony would be extremely useful of course.

    Kavanaugh would testify first, then Ford would testify, and Kavanaugh would have no opportunity to respond or rebut;

A totally nonsensical and unfair procedure.

Have they forgotten every thing they ever heard or knew about due process and civil liberties? I don’t think even the Star Chamber worked that way.

    The Friday deadline for her to provide written statement before the hearing would be waived;

That one would be fair – except for the problem of fact checking.

    Provide adequate security

Everyone seems to agree with that in principle, but talking about that presents many opportunities for obstruction and stalling, while not being openly unco-operative.

    Only one pool camera in hearing room;

Could be a problem if the camera operator is too friendly to her or unfriendly to Kavanaugh. But basically not a problem. It’s just another obstacle where disagreement could derail the hearing.

Ford and Kavanaugh allotted the same amount of time to talk.

Equal time is the sort of thing that sounds fair, but it’s not.

It takes less time to make an accusation than to rebut it, especially if some aspects of the accusation involve prejudices of the public, which need to be argued against. And the public also could be prepped for her testimony so that she could deliver it in a kind of shorthand.

I think “equal time” can be very unfair. It’s invoked far too often. If you ever eheard radio debates you can see how that does not work.

And who gets to decide how much time she gets. She uses as much as she wants (or she won’t co-operate) but he could be limited.

You’re right! And just to back up your excellent point, there was that guy who bashed Cruz’s wife personally. And that guy who implied Cruz was not eligible to be president. And that other guy who implied Cruz’s father was a murderer. One guy compared Carson to a child molester. Someone attacked Hillary for being unable to “satisfy her husband.” A guy attacked Meghan Kelly for “blood coming out of her whatever”and a guy attacked Justice Sotomayor for being diabetic, and Ginsburg for her weight. Some weirdo claimed Obama’s birth certificate would show Obama is a Muslim and therefore he could not have changed his religion to Christian. A guy even made a lot of issues out of the size of his penis during a presidential debate.

I’m really glad we have Trump and his fans out there, ever watchful for whoever it was who lowered the bar on evidence free hoax scandals.

Ideally her name isn’t leaked. This is investigated in private. No big grand inquisition until they corroborate or resolve this as best as they can.

    But this isn’t the ideal.

So second to that, yes, get her to DC and she can testify and be confronted and that is that. I somehow don’t think a bunch of Republicans cross examining Dr. ford is going to play well, but whatever.

Third option, yeah, sure send a lawyer to her to give her a proper cross examination on video. I see no real problem with that.

All of these are better than delaying the confirmation process for a long time as she treks across the country and we negotiate the terms of the testimony.

Most of your comment doesn’t pertain to what I said though. What about sending someone to talk to her makes you think I believe her?

The Trump movement cheered a presidential candidate bashing women because their husband cheated on them. Now the movement is crying about an unfair attack. That’s pretty funny.

There’s a reason so many people are ready to believe that someone associated with Trump is a degenerate. Do the same people laughing about any below the belt attack on ‘nevertrumpers’ or Hillary really think they have any credibility outside their bubble?

This is called politics. Trump use of extremely unfair or extremely dishonest attacks, with sexual innuendo, lowered the bar to the ground. And while many Trump fans pretend you care about Kavanaugh, if these same attacks were levelled against John Mccain I think they would be saying they were terrific and be munching on popcorn.

I’m not supposed to criticize other commenters here, but how many times has Happyfeet accused Mitt Romney of being a pedophile? Has he provided anywhere near the evidence that exists against Kavanaugh (An accuser)? Oh but that’s different!

    https://www.nytimes.com/2018/09/05/opinion/trump-white-house-anonymous-resistance.html

Given the instability many witnessed, there were early whispers within the cabinet of invoking the 25th Amendment, which would start a complex process for removing the president. But no one wanted to precipitate a constitutional crisis.

Except that Andrew G. McCabe and Rod J. Rosenstein weren’t members of the Cabinet.

    But he disputes this story.

    And now we have this:

A Justice Department spokeswoman also provided a statement from a person who was present when Mr. Rosenstein proposed wearing a wire. The person, who would not be named, acknowledged the remark but said Mr. Rosenstein made it sarcastically.

But according to the others who described his comments, Mr. Rosenstein not only confirmed that he was serious about the idea but also followed up by suggesting that other F.B.I. officials who were interviewing to be the bureau’s director could also secretly record Mr. Trump.

What would thsi be? Evidence to convince some member of the Cabinet? Or Mike Pence, who saw him every day? This story could be concocted.

Do you think anyone is going to change vote from (D) to (R) over an unfair attack after the bajillion times Trump lied about someone? The GOP is led by a degenerate so the bar is naturally lowered to the ground.

Matador, I suspect she cares a great deal about her name being leaked. Millions of people automatically hate her intensely now. No one can really be prepared for that, or be happy about that.

Have you seen or heard, from Crazy Chrissy or any of her posse, any expression of outrage over the leak?

I believe the words she used were “anguish” and “terror” actually. She said “Why suffer through the annihilation if it’s not going to matter?” She scrubbed all her social media. Clearly she anticipated this happening, but she also wanted to minimize the exposure. She cares that someone leaked her name. She might not believe it was a democrat (though I do).

Now, it’s easy for partisans to dehumanize the other side’s partisans. Perhaps you really think this “Crazy Chrissy” is an evil woman trying to harm an innocent person. I suspect she believes what she’s saying, but things have gotten out of control. Even people making false accusations, or exaggerated ones, can believe all or most of their account.

Truth is we weren’t there. It was a really long time ago. It’s not going to be possible to get to the truth of the matter. That’s part of what’s so terrible about leaking the accusation. Both parties will be hated by millions of people anyway.

    https://www.nationalreview.com/the-morning-jolt/the-brett-kavanaugh-doppleganger-theory/

Ed Whelan, president of the Ethics and Public Policy Center and longtime friend of NRO, laid out a theory in a series of tweets that suggested that someone else attacked Christine Blasey Ford back in 1982. He contended that one of the four boys was the likely host of the party, pointed to a particular house that matched Ford’s description, and named a former classmate of Brett Kavanaugh’s who resembles him, both then and now, as a potential alternative suspect.

The problem is, if we don’t like Ford making this accusation against Kavanaugh with such a dearth of evidence . . . how fair is it to make this accusation against a former classmate with such circumstantial evidence? In the series of tweets, Ed acknowledged that he doesn’t know what happened in 1982 and says at one point in his series of tweets that he doesn’t want to “state, imply or insinuate that [the classmate] or anyone else committed the sexual assault.” Except . . . the series of tweets do just that, don’t they? How else are we supposed to interpret this information?

But if you don’t explain this, how can the reputation of Brett Kavanaugh and.or Christine Blasey Ford be salvaged?

The explanation must at least be right.

It’s probably not all that simple, anyway.

  91. I think it absolutely matters who leaked her name. What we know is that Blasey Ford asked for confidentiality, was assured of it by Feinstein, yet ended up completely exposed. That immediately brings into question why someone would want to do the very thing Fors Blakey requested not be done. And that naturally leads us, reasonably and without partisan bias, to assume an ulterior motive was at play. Given the nature of the case and the nomination of a new SCJ, without reaching, it points directly to politics. So the question becomes, who would benefit most from setting this in motion before the public? Who has the most to gain?

I believe that, whether Ford Blasey is telling the truth or not, or has misremembered the event/persons involved, she is being skillfully used by Democrats well-practiced in the art of deception to accomplish their ultimate goal: to make sure Kavanaugh is not seated. In essence, Ford Blakey has been used at least one time for certain, and possibly twice by those whom she trusted.

I do think there’s some merit to your point of view actually. This is a very strange way to handle this sort of accusation, and the timing is obviously completely political. I just think there’s no use in dehumanizing her. Starting from a position of respect, where you treat Kavanaugh as though he is innocent, and Ford as though she is making her accusation sincerely and honestly, is a better way to handle whatever information we get as this drags along.

She’s in a box now, one she willingly – imho – jumped inside.

I guess on this part we disagree. I don’t think she intended to have her name known. I think her side stabbed her in the back. To those who believe she is an evil liar, that’s fine. She’s merely taking responsibility for her claims. But there’s a bigger picture here. There are a lot of women who are actually sexually assaulted who rely on a promise of anonymity. How can they believe it if the most powerful people in the highest offices can break that promise with no accountability? There needs to be an investigation of this aspect.

I already explained earlier that a credible eyewitness account on its own doesn’t rise to probable cause, and I gave an example of a man who was wrongfully convicted of rape on that evidence, died in prison, and then was exonerated thanks to DNA confirming a different rapist. Still, it’s worth investigating as best as we can.

The shame here isn’t that it’s being investigated, but that it’s being investigated from the angle of politics, on both sides. Both the people who are furious at Ford, insisting she must be lying and some witch etc etc, and the people insisting Kavanaugh is guilty. It should have been investigated in private, and resolved. She should have testified, under oath, lawyers all around, but in complete confidentiality.

  122. This can’t be a draw, Dustin. If you treat Kavanaugh like he’s innocent, there is but one view that can be held of his accuser based on what’s out there at this point. What credibility has she established?

One view of the accuser, that is, until she brings something more than “I don’t know where, when, how, who else… and now you are going to create a brand new set of rules for me or you’re just out to get me…

She was going to be the one person who would never be outed, right? Using pols to advance her objective, right?

She started this. It is incumbent upon her to finish it. Testify, no preconditions, no victim card.

  124. This can’t be a draw, Dustin. If you treat Kavanaugh like he’s innocent, there is but one view that can be held of his accuser based on what’s out there at this point. What credibility has she established?

I agree she lacks credibility, but I also think some aspects of that are understandable. I wouldn’t remember all the details she doesn’t remember about something crazy that happened 30+ years ago. Of course, it’s also possible (and indeed has happened) that eyewitnesses point to the wrong perpetrator, but where being completely honest.

In other words, yes, it can be a draw. That is one possibility.

But treating someone like they are innocent doesn’t really force us to insist the accuser is an evil witch liar demon monster etc etc. We can actually allow for the very real possibility of human error. Of honest error.

She was going to be the one person who would never be outed, right? Using pols to advance her objective, right?

She started this. It is incumbent upon her to finish it. Testify, no preconditions, no victim card.

Now, off for black garlic pizza and porter.

That pizza sounds great. However, I think the principle of guarding the anonymity of a sexual assault outcry is a bigger issue than Ford vs Cavanaugh (or more honestly, Republican vs Democrat). She was entitled to that anonymity. It wasn’t just some trick. Whoever betrayed that anonymity should be exposed.

Just vote for his confirmation on Monday and be done with it.

    Dejectedhead (32d547) — 9/21/2018 @ 3:48 pm

The more I think about it, the more sense this makes. The GOP has no chance of handling this matter in a professional manner, and it elevates people who grope women against their will to the oval office. There’s no political benefit, and there’s an almost zero chance of actually learning anything, so might as well just dispense with the farce that any congressional hearing is a legitimate quest for knowledge or justice. I’m not being sarcastic. This party is a joke and we might as well hand the democrats the victory.

    Dustin (ba94b2)

How do you figure out there’s no proof if you drop the matter before the investigation?

Also, this isn’t a criminal trial. It’s more like a job interview. The burden of proof is different. I still agree with you as far as what evidence we have right now. But there’s another reason to vote now. Even if you get a video of Kavanaugh boasting that he boasting that he gropped Ford, similar to the video we have of Trump making that boast, the GOP will still vote in his favor.

The GOP doesn’t mind this kind of misconduct anymore. This is an accusation of conduct Trump brags about.

  130. 130. There is no burden of proof, which is the problem. There’s nothing to investigate, which is the problem.

We all know that the refusal to testify is so that the Democrats will have a message that they can run on in the midterms. They’ll unpack their vagina hats and march around town declaring that the GOP wouldn’t believe a woman victim of sexual assault. This whole obvious sham of an event was designed to do exactly that. Feinstein had the letter for 6 weeks prior to the judicial hearings and waited for them to end to bring it up because it is intended to be a delay tactic.

    Dejectedhead (32d547)

  131. Clear now the Dems don’t care about The Doctor nor what ever did or did not happen in Maryland house in the 1980s. It’s simply a way to cast Republicans as misogynistic beasts hellbent on outlawing abortion right before the midterms. Senator Grassley has bent over backward two times and it still won’t be enough for them. It’s all sham marketing.

And also to see that like Justice Clarence Thomas, despite a sterling reputation and a stellar and scholarly legal career, the second sentence of Justice Kavanaugh’s obituary will be this fiasco.

    Bugg (8aed21)

  132. . There’s nothing to investigate, which is the problem.

True. As far as I know, there really isn’t anything to do to learn what happened except for listen to Ford say what she remembered.

The other problem, and I’m dead serious here, is that the GOP doesn’t care even if the groping happened. Trump is in the white house last time I checked, and he did do this kind of stuff. If it’s just a matter of looking like the GOP doesn’t care about this kind of incident… well it doesn’t.

    Dustin (ba94b2)

  133. If a lawyer can’t determine how to defend a client accused of a more than 3 decades-old allegation of sexual assault with no physical evidence, zero corroborating witnesses, and gaping holes in the accuser’s story, that lawyer is obviously incompetent and he or she should run for Congress.

I didn’t vote for a Bush that was bragging that he got away with using cocaine. In fact, I voted for a sober man who repented his mistakes.

Granted I also didn’t vote for a unrepentant degenerate Trump that was bragging about groping women, but a lot of Republicans did exactly that. And of course that’s only half the issue. Trump also made a hell of a show of lying about people, making baseless and personal accusations, and that takes a lot of steam out of the righteous indignation that the democrats are offering this accusation today.

    Dustin (ba94b2)

  136. “But there’s another reason to vote now. Even if you get a video of Kavanaugh boasting that he boasting that he gropped Ford, similar to the video we have of Trump making that boast, the GOP will still vote in his favor.”

    Colonel Haiku (2601c0)

  140. #127

I haven’t noticed a lot of people who want to ignore it. I think everyone has listened and some have just been quicker to decide on it. There aren’t even that many who say even if it happened it’s not a big deal. Although there are some and it’s easy to hear one person say it and think it’s a more common view.

On the other hand, we know a lot about those clinton assaults. Isn’t there an alleged rape in there someplace?

  142. There’s nothing to investigate, which is the problem.

True. As far as I know, there really isn’t anything to do to learn what happened except for listen to Ford say what she remembered.

This is precisely why I think she should testify because then it becomes extremely clear that there is nothing to investigate, that there is no case to be made, and that she cannot substantiate her claims. Also, if Kavanagh‘s team is going to approach this as less about defending him (if he wasn’t there and didn’t do this per his statement under oath) then by putting her on the defensive by pointing out the holes in her story, then it becomes all the more important to hear her recount the alleged event.

It’s not even a serious allegation.

I disagree. Any allegation of sexual assault is serious and should be taken seriously. That does not mean that something like this allegation which is missing so much meat on the bone as to be absurd, should not be examined and assessed and come up wanting. It also doesn’t mean that a false accuser should be allowed to get away with it. Both things can be simultaneously true.

The other reason it’s a serious allegation to make is because of the unspeakable damage it does to the accused and his family, as well as the complete upheaval of his life. And if it is true, then her life has already been turned upside down.

My belief that three of those four are far more credible than Ford is supported by the record: Clinton abused his position, leveraged a subordinate for extra marital sexual gratification. The only difference between what Clinton did to Monica Lewinsky and what is alleged by Broaddrick, Willey and Jones is that Monica said yes.

In a state w/t drinking age at 21, an under-age college fraternity bro who drank like a fish [we had a 24 hour beer tap so we were all guilty of it] passed out in public [we got SX-70pictures, too] did drugs, bought and sold nickel bags, did hash, but graduated, got into a law school, became a successful attorney in New Jersey and later a judge and family man. At reunions in the 80’s and 90’s we’d sometimes talk about what we were doing, the stupid stunts we got away with then inevitably we’d ask, so how he’d square it w/himself if making a judgment on a drug case knowing what he’d done in school? He’d shrug and say the usual, ‘that was then, this is now.’ Hey, it was his and Jersey’s thing to deal w/anyway. But if he was up for the SCOTUS gig and the FBI came around to ask some routine background questions, would likely have related the stories of the college experiences as delicately as possible for their profile. OTOH, the campus drug dealer is now a highly regarded college professor teaching kids at the University of Pittsburgh. ‘Life is unfair.’

  160. I’ve updated the post with Grassley’s 10:00 pm deadline demand, and Katz’s response:

The link wasn’t about additional witnesses, maybe I screwed it up? It was to a story about Katz telling everyone who would listen that Ford would do “whatever it takes” to be heard. The only reference I see to additional witnesses is after the walkback began but before those witnesses came out as you say.

    Matador (39e0cd) — 9/21/2018 @ 9:25 pm

    Gotcha.

As far as I know, as far as everybody knows, she has no witnesses to the event that have corroborated her account.

None of us were there or can get into Dr. Ford’s head. I tend to give people the benefit of the doubt, particularly people who are going through a huge upheaval in their lives to claim someone did something wrong. I get that there is a huge political motive for lying, but still, I suspect Ford believes her story and that it’s probably distorted from decades of reliving the experience.

At this stage, Kevin is right and these folks are rehearsing questions with Ford, probably actually having literal dress rehearsals. She may not even be giving her own testimony, but rather something carefully crafted for whatever purposes political people have for this kind of thing.

A lot of people have pointed out how this highlights cynical choices on the left, but it’s not making the GOP look that great either. Why is there a rush for this judge, but replacing Scalia took a year? Just politics. That’s all any of this amounts to. Whether this woman was assaulted is just a card being played in a game.

  203. “rehearsing the lines”

As if that’s a bad thing. lol. Dunno if the Prof’s attorney is a good attorney or a bad attorney, but you bet your bottom dollar that any attorney worth his or her salt is going to do a lot of rehearsal with the client, before she’s thrown into the lion’s den.

And, of course, it is a lion’s den, half-way anyways; where these old-white guys wanna confirm K and are wholly disinclined not to do so (to say the least). He’s “their boy” after all, and as the captain of the team (the Turtle) has so forthrightly said – “In the very near future, Judge Kavanaugh will be on the United States Supreme Court … So my friends, keep the faith, don’t get rattled by all of this. We’re going to plow right through it and do our job.”

And, yeah, if the judge (who conveniently happens to be jury as well) won’t allow your client to call the other witness there; where the judge refuses to subpoena the third party (name of Judge, as well: how’s that for irony?) to an otherwise solely he-sez-she-sez get-together, you betcha you’re gonna rehearse your client, up and down. If you’ve got two or more neurons to rub together, you will. ‘Cause the deck’s just a tech stacked, already, and you sure should be able to question that Judge (such a bad, bad, boy he’s been (they’ve been?), and most prolific in the telling) in such a way which a good attorney really oughta be able to work to even out the deck a bit. But oh no, life’s not fair, and no Judge. The jury’s out on Judge – no judging him at all. Directly. (For no good reason.) So, unfair is life (alas! alack!), and you prepare, nonetheless. You rehearse. You plan and strategize as best you can. Honestly, if you’re a good attorney. But most definitely. ‘Cause she’s your client, and she deserves your very best. And she has an important story to tell — one that’s cost her not a little in the telling even thus far – much less what costs tomorrow may bring. And you calm her, and you comfort her, and you help her be the person that can make it through it, and be the woman who’ll be able to see and say she’s done her duty as best she could. So you rehearse.

    Narciso (fe7480)

  205. @211

    Ah well. I’m disappointed.

Corcept makes a drug called Korlym, which is mifepristone, which is indeed the drug in the abortion pill. However, it also has a non-abortion use. According to their product page, Korlym is FDA approved as “oral therapy for the treatment of patients with endogenous Cushing’s syndrome.”

    http://www.corcept.com/korlym.html

Danco laboratories makes Mifeprex, which is the FDA approved mifepristone abortion drug.

    https://www.earlyoptionpill.com/

Now here’s the thing. It is immediately obvious to anyone looking at the product pages for these drugs that these two companies are licensed for different purposes. Is it malice or incompetence that sees Natural News, WND, Gateway Pundit, and other wingnut fake news factories pushing this article.

    Davethulhu (41e784)

  206. In fact (and this should be even more embarrassing for you), the very first article written by Dr. Blasey in your link is “Mifepristone treatment of olanzapine-induced weight gain in healthy men.” Why would a company making abortion pills care about the effects of their pills on men?

    Tanny O’Haley (dba241)

  210. It would be helpful to provide a summary of why Carlson thinks that.

Regardless, senate rules are not set in stone, and the majority can change them with 50+VP votes and no debate by appealing a decision of the chair or the parliamentarian.

That’s how Dirty Harry Reid nuked the filibuster for non-Supreme judges, and how McConnell nuked it for Gorsuch.

  219. @221. There’s nothing in the Constitution about a ‘senate judicial committee’ either- the Senate created it themselves in 1816 to assume the responsibility of screening judicial noms, but if the current octogenarians would prefer to nap and aren’t interested in doing any Q&A, why be on the committee at all. When the cameras are rolling they sure find courage for face time.

Staff write the letters, staff answers phones, staff quills their speeches, staff runs errands, staff does the research, staff does their scheduling, interns remind them to zip up after a pee and not to swear on TeeVee. Staff does everything for these old lard butts. Besides the occasional ‘yea and nay,’ what the hell else are they being paid to do- go off on “fact-finding junkets”– raise re-election funds, ride the little Capitol subway and tweet out snark? It’s their job, a responsibility they’ve assumed and it’s long past time all those ol’swamp creatures had a fire lit under their asses and got ’em in gear.

  236. BREAKING: Montgomery MD PD Chief Tom Manger confirms will investigate sexual allegations against Brett Kavanaugh if a complaint is filed.

Fair enough. I want to investigate whether Montgomery MD PD Chief Tom Manger committed a sexual assault against some person at some pool party at some house at Montgomery Md some time in the summer of 1985, but I have not found a victim or a witness willing to say so. Which is understandable. Many victims of sexual assault are unwilling to come forward because they don’t want to put themselves through all the stress, questioning, scrutiny and stigma of a sexual assault investigation; and witnesses simply don’t remember, don’t want to get involved, or have much the same trepidations as the victim.

‘…The imposition of aggressive and artificial deadlines regarding the date and conditions of any hearing has created tremendous and unwarranted stress on Dr. Ford. Your cavalier treatment of a sexual assault survivor who has been doing her best to cooperate with the committee is completely inappropriate…

The 10 PM deadline is arbitrary. Its sole purpose is to bully Dr. Ford and deprive her of the ability to make a considered decision that has life-altering implications for her and her family. She has already been forced out of her home, and continues to be subjected to harassment, hate mail, and death threats. Our modest request is that she be given an additional day to make her decision.’

Note the words that echo the idea of big strong men hurting the little woman: the deadline itself is “aggressive” and the purpose is to “bully” her. Christina Ford (“Dr.” to you) is no longer 15 years old, but the letter implies that that’s her approximate mental and emotional age.

There’s no acknowledgment, of course, of the fact that Ford set this entire thing in motion, that she has had nearly two months (or more) to prepare and 36 years before that, that she is the one who blindsided Kavanaugh and the Republicans in the Senate rather than the other way around, that they have already given her many extensions, and that Kavanaugh’s family has also experienced incredible stress and death threats as a result of her accusations.

Most of us have had the experience of arguing with a person like this. Give an inch? They take a mile. Make concessions? They want more. They are the poor suffering victims. They don’t like your tone of voice. They don’t like the expression on your face. If you try to be calm, you’re cold. If you try to be sympathetic, you’re condescending. Nothing you do is okay, and everything they do is okay.”

I agree that is true now, after several efforts were made, but it wasn’t true in the beginning. They had to make the effort to listen, even if it was unlikely to work out. I think more Republicans will decide it isn’t worth the effort in the future. To the extent he makes concessions that don’t endanger Kavanaugh’s chances of confirmation, Grassley is being smart, and he may be saving his party’s tenuous hold on the Senate in the process.

    Dave (445e97)

  284. DRJ–

With respect I disagree. This is a purely political attack, aimed at driving the nominee to withdraw and putting the confirmation in the hands of a Democrat Senate (which will confirm no one until 2021).

I don’t believe the first word here, not even that something happened to her at someone else’s hands. Too much vagueness, too long unmentioned, too many “helpful” liars, too much orchestrated support by people informed solely by political preference. It’s an Anita Hill do-ever, planned and gamed for years, that found a willing participant.

Why would she do this? We don’t know what she’s been promised but at the very least I’d expect a professorship somewhere nice like Smith. Maybe a stipend from a foundation.

    Kevin M (e9a4b1)

  285. And who heads demand justice, none other than Brian fallon, formerly? Of the Clinton foundation

    Narciso (bce9d9)

  286. Shorter: What values?

    Kevin M (e9a4b1)

  287. Also, people blame Feinstein. Not really accurate as this whole thing was discussed and gamed out with the Minority leadership some time ago. Feinstein is just the figurehead, chosen because she has the least to lose (at worst a different Democrat takes her seat).

    Kevin M (e9a4b1)

  288. Dividing between the secular/political and the moral worlds is an important step. The Democrats haven taken that step, and now the Republicans have to decide if they will, too.

It’s certainly easier to fight battles using the same ground rules, but Republicans used to believe in different values. Those different values absolutely make the fight and their lives harder.

    DRJ (15874d)

  289. In this case values like giving Blasey Ford an opportunity for a hearing. The Thomas-Hill hearing process was chaotic, too. But there are limits and it seems to me that she has had an opportunity to come forward. I hope Grassley holds the vote Monday if they can’t agree on terms.

    DRJ (15874d)

  290. I see one of Grassley’s aides has stepped down because of previous sexual allegations.

these are just more evidence-free Mitt Romney-style allegations though

    happyfeet (28a91b)

  291. I fear that the public will pick the Democrats if each side has the same tactics/values. The Democrats are the party of giving people things.

    DRJ (15874d)

  292. In this case values like giving Blasey Ford an opportunity for a hearing.

this loony-tunes never-been-raped cumquat doesn’t need an “opportunity for a hearing”

nothing’s stopping her from going on the tv with one of the CNN poofter boys and farting out every jot and tittle of what she would say to congress

what the Senate is offering her is an opportunity to have her story examined

and that’s like garlic to a vampire with these fake rape drama chicks

    happyfeet (28a91b)

  293. […] You can do whatever you want, just admit that values aren’t a concern because you think your opponent is hopelessly bad. And prepare yourself for a smaller caucus because you will lose the Collins-Murkowski votes.

This is covered often and extensively in the uni-party handbook and reviewed in the newsletters. Marketing research predicts that if R’s give on values most voters have a hard time telling them apart from D’s and fundraising suffers.

  295. In short, James Comey, Peter Strzok and Lisa Page have all said or implied that the FBI had nothing linking Trump to Russia. Which, as John Solomon concluded last week, raises the question: If there was no concrete evidence of collusion, why did we need a special prosecutor?

  299. Spokesman for GOP on Kavanaugh nomination resigns; has been accused of harassment in the past

    https://www.nbcnews.com/politics/supreme-court/spokesman-gop-kavanaugh-nomination-resigns-has-been-accused-harassment-past-n912156

WASHINGTON — A press adviser helping lead the Senate Judiciary Committee’s response to a sexual assault allegation against Supreme Court nominee Brett Kavanaugh has stepped down amid evidence he was fired from a previous political job in part because of a sexual harassment allegation against him.

Garrett Ventry, 29, who served as a communications aide to the committee chaired by Sen. Charles Grassley, R-Iowa, had been helping coordinate the majority party’s messaging in the wake of Christine Blasey Ford’s claim that Kavanaugh sexually assaulted her 36 years ago at a high school party. In a response to NBC News, Ventry denied any past “allegations of misconduct.”

After NBC News raised questions about Ventry’s employment history and the sexual harassment allegation against him, Judiciary Committee Spokesman Taylor Foy replied in a statement: “While (Ventry) strongly denies allegations of wrongdoing, he decided to resign to avoid causing any distraction from the work of the committee.”

  302. @ #303, I just can’t imagine a Kavanaugh withdrawal being scored as a conservative victory. It would certainly elevate the unsupported accusation for the minority. It would give Dems the momentum going into the midterms. It would call into question whether a new nominee could get through…..especially under the unlikely possibility that the Dems take the Senate. A “more conservative” nominee will also elicit more hysterics and more foot dragging….which creates an even greater farcical situation….hurting the prestige of the institution. Ford’s demands make her appear nutty….how long does one need to practice telling the truth….or explaining why you don’t remember the date or place of such a traumatizing event? Now that she has gotten death threats, wouldn’t getting the testimony over be the most prudent action?

    AJ_Liberty (165d19)

  303. People are exaggerating the whole “there will be a cloud over him” thing. The same could be said of Clarence Thomas. But Clarence Thomas is by far my favorite justice. Cloud, schmoud, he has worked out great and so will Kavanaugh.

Push him through. This is (from what we know today, at least) no reason to deny him his seat.

    Patterico (1a35e1)

  304. a cloud is a badge of honor anymore

cloud me up I wanna serve my country!

    happyfeet (28a91b)

  305. So Ford has basically agreed in principle to testify (which she already had before) without accepting any of the specifics in the committee’s invitation. They say they still consider all the details subject to negotiation.

    Fairly predictable. More dilatory tactics.

    Dave (445e97)

  306. You can debate the ‘cloud’ issue on Thomas or Kavanaugh– or even Trump and Clinton for that matter, but it’s a cinch there will a line or two about the climate of their times and the ‘stormy skies’ in their obituariers.

    DCSCA (797bc0)

  307. why moderation??

    DCSCA (797bc0)

  308. 290… the credence given these specious accusations bothers me. Do not play their game, and a game is what it is. This time it’s fables from high school nearly 4 decades ago, that the accuser never shared with ANYONE until 2012, if even then.

The established process was followed, the nominee was vetted by the FBI. The Democrats were aware of this woman’s letter before the hearings – which were clownishly disrupted by their front-line fanatics – and they chose to not bring it up. They made the choice to take their approach and they should not be rewarded for these tactics. The media is not telling the truth about the supposed support for this woman. They never do tell the truth, they are driven by the Democrats’ agenda in everything they do.

Republicans should stop being frightened by their own shadows and hold firm.

    Colonel Haiku (2601c0)

  309. Don’t get it; don’t see any comments personally attacking other commenters; only ridicule of public officials which was believed to be within the guidelines.

    DCSCA (797bc0)

  310. It’s Time for Some Brett Kavanaugh Game Theory

I think Last is premature with his judgment because the game depends on whether or not Blasey Ford appears and, if she does show up, what she says and how Kavanaugh responds.

    Paul Montagu (0e687b)

  311. There’s value in pushing for a vote as opposed to pulling him. Same for giving her a chance to testify and him a chance to respond.

    frosty48 (6226c1)

  312. So he was employee for less time than Andrew lack and his creepy relationship with Jane wallace.

    Narciso (bce9d9)

  313. If she has agreed to testify, they should schedule her for Monday, Kavanaugh for Tuesday, and vote Wednesday. If she doesn’t like that schedule, she should have set her terms last week.

    DRJ (15874d)

  314. Republicans should stop being frightened by their own shadows and hold firm.

    Details.

One seat in the Senate could mean the difference f0r dozens of conservative nominees to lower courts, or even another Supreme, over the next two years.

Recall that in the last presidential election, four states were decided by a fraction of 1%.

It may be gratifying to “own the libs” by telling Ford to go pound sand, but he who laughs last laughs best.

    Dave (445e97)

  315. Setting a schedule for the hearings and extending a specific invitation to her to testify is not telling her to pound sand.

    DRJ (15874d)

  316. Setting a schedule for the hearings and extending a specific invitation to her to testify is not telling her to pound sand.

No, but it can be (and would be) portrayed as bullying, revictimization, etc.

Trump has made things harder for every Republican by validating the left’s caricatures.

There must certainly be a limit to what Grassley can concede, and that limit is the point where concessions begin to materially harm Kavanaugh’s prospects for confirmation.

I’m not convinced we’re at that point yet. If Spanky will just keep his mouth shut, Kavanaugh has the votes whether they are counted in two days or ten.

    Dave (445e97)

  317. “No, but it can be (and would be) portrayed as bullying, revictimization, etc.”

In their world, anything goes. That’s their world. We have a choice to not be of their world.

    Colonel Haiku (2601c0)

    Colonel Haiku (2601c0)

  321. It will be portrayed as bullying until Kavanaugh withdraws or loses. She should be extended an invitation but she does not set the terms. The Committee invites and sets the schedule. It is her choice whether to show up.

    DRJ (15874d)

  322. The sooner they start the hearing, the better.
