Blasey Ford Camp Outlines Conditions; GOP Working On Counter Offer (UPDATE: Blasey Ford Camp Responds To Committee Deadline)

Yesterday, Christine Blasey Ford’s attorney, Debra Katz, outlined the conditions that must be met in order for Blasey Ford to testify before the Senate Judiciary Committee:

Ford will not appear any sooner than next Thursday*;

No questions to be asked at hearing by any outside counsel — only by Senators;

Mark Judge must be subpoenaed;

Kavanaugh would testify first, then Ford would testify, and Kavanaugh would have no opportunity to respond or rebut;

The Friday deadline for her to provide written statement before the hearing would be waived;

Provide adequate security;

Only one pool camera in hearing room;

Ford and Kavanaugh allotted the same amount of time to talk.

* Regarding a written statement by Friday is a “non-starter,” and testimony on Monday is a “dealbreaker” according to Katz:

…because “[i]t is simply not possible for her to prepare such testimony while at the same time trying to take appropriate security precautions in the face of the avalanche of threats she has been receiving.”

Obviously, the demand that Kavanaugh would testify first and have no opportunity for rebuttal is so problematic, it is unacceptable. As some have pointed out, yes, this isn’t a court of law, however:

Just this morning, CNN is reporting that the GOP is working on a response Blasey Ford’s demands:

Two sources say the Senate Judiciary Committee will likely send a proposal to Christine Blasey Ford’s lawyer proposing a Wednesday hearing, with Ford testifying first and Brett Kavanaugh second.

The proposal would have outside counsel asks the questions.

As noted:

Offer not final and not sent, per numerous GOP sources. Discussed on Judiciary R call this morning

We need to hear from both of them. Given that both sides of the aisle agree that a very serious allegation has been made, both the accuser and the accused should be provided a secure forum in which to which to be heard and be available for questioning and examination. In spite of various factions already assuming Kavanaugh’s dishonesty and Blasey Ford’s honesty and/or Kavanaugh’s honesty and Blasey Ford’s dishonesty, if the primary concern is rooting out the truth, then wouldn’t both sides of the political aisle want them to testify? And wouldn’t the individuals themselves want that opportunity as well? Ultimately, the public needs to hear from both to see if their claims stand up under scrutiny. If that hasn’t yet happened in full, how on earth has anyone already made a definitive call about guilt or innocence? Unless, of course, the real priority here isn’t really about any allegation and denial. And that, sadly, is where we find ourselves: If the voracious and insatiable appetite of partisan politics demands the exploitation of an individual’s alleged assault and the subsequent destruction of another individual – whether innocent or guilty, then so be it.

UPDATE: Earlier today, the Senate Judiciary Committee gave Ford a 10 p.m. Friday deadline to make her decision as to whether Christine Blasey Ford would testify on Wednesday:

The committee, led by chairman Chuck Grassley, R-Iowa, said Ford could testify Wednesday — a day earlier than she demanded, but also two days later than the day the committee had originally announced, Monday. The committee is also proposing that Ford testify before Kavanaugh, as opposed to after, and that outside counsel handle the questioning. According to a GOP committee aide, the exact language in the counter offer asks Ford, “Please respond by 5 p.m.”

Katz responded to the letter, which she made a point to note that it had been sent at 4:00 p.m.:

“I advised you that Dr. Ford had traveled to meet with the FBI for several hours about the death threats she had been receiving, and we would need until tomorrow to confer with her and to be able to provide you with a well-considered response,” Katz said in the letter. “Rather than allowing her the time she needs to respond to the take-it-or-leave-it demand you conveyed, you sent us an email at 5:47 p.m. – which you again gave to the media first – insisting that we accept your “invitation” for a Wednesday hearing by 10:00 p.m. tonight.”

She further claimed:

The 10:00 p.m. deadline is arbitrary. Its sole purpose is to bully Dr. Ford and deprive her of the ability to make a considered decision that has life-altering implications for her and her family. She has already been forced out of her home and continues to face harassment, hate mail, and death threats. Our modest request is that she be given an additional day to make her decision.

But I think we love it; we seem to value mudslinging and lies about others.

  4. I strongly suspect the Dems will keep adding or changing demands and moving the goalposts.

    They clearly don’t want her to testify, and I suspect the plan is to keep stringing things out until Grassley finally throws his hands up and says “that’s our final offer, take it or leave it”. And then they will reject the offer and whine about “unwillingness to compromise”. This is all theater.

    The closer the two sides *appear* to be to an agreement, the harder it becomes for the GOP to say “no, that’s unacceptable” to any particular demand and just go ahead with a vote.

  5. What serious person — specifically what licensed attorney — would demand that Ms. Ford be allowed to make her allegations, but Kavanaugh not be given a chance to rebut them in a public forum? I hope Sen. Grassley lets the Ford Team know that is entirely unacceptable. I would imagine that committee Democrats will stage a dramatic walkout once Kavanaugh begins his rebuttal anyway.

    Yeah, that’s where we are. I think the folks here underestimate the titanic pressure Ford has got to be under right now. It’s not only the Supreme Court but control of the Senate that could be at play. Her side wants the visuals of Orrin Hatch asking inept offensive questions. God, the amount of promises and threats her allies are making…

    Frankly, this should be done in private or public with no cameras or recorders, with maybe one tape to be made available after the election. If you want truth, the cameras and recorders shouldn’t matter. And if this is just partisan nonsense, well, shame on you.

I think the next step the attorneys for Ms. Ford will make – is to make a statement to the Maryland police to bring Kavanaugh up on charges – then the media will parrot the meme “how can the Republicans vote for a SC candidate who’s under investigation of sexual assault” ???

  8. Based on the childishness I see daily—the juvenile nicknames, casual accusations of felonies like child molestation, and the fake macho tough guy attitude—I would argue, bendover, that not everyone is terribly grown up around here.

    Notice I said “hope.” My opinion matters too. Not just the folks who are quite literally the mirror image of the people they claim to hate.

  15. I agree, Anonymous. And I believe that some of the, um, flexible approaches to this kind of thing need to be out front and center. If we believe all accusers, and need to do whatever they wish or we are heartless trash…what about the Keith Ellison case?

    The best I have seen is to argue that Kavanaugh will have a lifetime appointment. And already some Democrats are claiming that they will try to impeach him.

    Sadly, I don’t think this has a darned thing to do with a purported sexual assault, or #MeToo. It is purely a “the ends justify the means” scorched earth war.

    And most Americans, honestly, prefer fairness. So I think putting the light on two related cases and how they are handled, is very appropriate.

    If the Democrats want to oppose Kavanaugh on professional grounds, they should. But I don’t believe they can. So here we are.

  18. I’m skeptical that this hearing will tell us anything we don’t already know. Dr. Fort (the appellation she insists on) has been unable to recall exactly when the alleged assault took place, or even whose house the party was at. Will she suddenly begin to recall more details? It will still come down to “she said he said,” and there will be no more clarity than before.

  20. This is probably worth an update. Since Ms. Ford’s lawyers are negotiating her appearance in public, the Senate GOP is doing the same with their counter, and this should be take it or leave it.

    “We’ll do it on Wednesday, we expect the accuser before the accused, and we do intend to have the counsel do the questioning,” the senator said, summing up the Republicans’ stance.
    The party is assenting to two of the terms Ford’s lawyers laid out in a Thursday evening call with staff from both parties, the senator said: limiting the hearing to one camera and ensuring that Kavanaugh is not in the same room as her.

    Sounds reasonable to me. The Dems rationale that she can’t appear before Thursday is ridiculous.

    This person is changing the course of the highest court in the land but she can’t fly across the country? Really? We ask a whole lot more of a whole lot of victims of crimes. In fact I believe our society often asks victims to be in the courtroom and identify the perpetrator. Exceptions make sense in extreme scenarios, but Dr. Ford is an adult, this crime was 35+ years ago, and I don’t really agree with those saying it’s reasonable they not be in the room together.

    As for the repeated demand that he testify before she makes her accusation… what? How? Why would a lawyer ever think that’s reasonable?

    But the worst part of this is that she claimed she was sexually assaulted, asked to remain anonymous, and was completely exposed. The person who did this needs to be identified and face consequences.

    And yet it wouldn’t surprise me one bit if they accept this demand at the last minute. Therefore, it’s not really all that unreasonable is it? When you’re dealing with people who are already caving in, who repeatedly shown no backbone, and you are shameless enough to not give a rat’s about your reputation because past experience has shown you have been very, very successful at dictating what the new rules are, nothing is unreasonable.

    I suspect we’ve had scandals in politics prior to Donald Trump being criticized. In fact, I do not think criticism of Donald Trump is the root of really any evil at all. However, I do think Trump’s sexual scandals are a major aspect in the movement on the left to fuel this issue. Trump did, after all, brag about how his star power enabled him to grab women wherever he wanted, and actually I guess he’s done a lot worse than that.

    I think many of Trump’s supporters really like that he’s so anti-PC because they hoped it would just defuse the whole PC climate entirely. Just laugh it away. I actually saw some appeal to this, but it’s definitely not working.

    That seems like a very reasonable way to handle this.

    I realize Lany is joking, but the problem here is that I don’t think there’s probable cause for charges.

    I recall a really bad Lubbock rape conviction years ago, based entirely on eyewitness testimony of a credible woman. The convicted, innocent man, Timothy Cole, was later acquitted thanks to DNA evidence, but he had died in prison. Eyewitnesses can be wrong. I can’t even imagine how much more horrible the raped woman’s experience was because of how her testimony was mishandled.

    To me, 35 year old eyewitness testimony, with little detail, and little corroboration, is not probable cause. And that doesn’t mean the poor woman, Dr. Ford, is some evil witch as some commenters on this blog believe her to be.

    Shame on the people who leaked this whole issue without investigating it.

    That one actually seems to be a Senate rule. Committee meetings are not supposed to be scheduled less than a week in advance, so when that was proposed yesterday it couldn’t be scheduled for earlier than next Thursday. That’s why the invitation was originally scheduled for last Monday (September 17) Because the invitation was made on September 10. Now they are saying the following Monday (October 1)

    I can guess why.

    The better for her not to get caught in a lie or discrepancy.

    Senator Susan Collins proposed that a lawyer for Brett Kavanaugh be allowed to question Christine Blasey, and a lawyer for Christine Blasey be allowed to question Brett Kavanaugh. (with Senators asking questions later) Now Blasey’s lawyer captor, knows that her client’s prisoner’s story would be destroyed by that.

    She knows.

    That explains all of this.

    Another proposal I read would be to have two former Supreme Court clerks, one Democrat, one Republican do the questioning. Not quite as good. But one could be a former Kavanaugh clerk.

    Mark Judge must be subpoenaed;

    He apparently doesn’t want to make public statements. Not sure whether it’s because he doesn’t want to be vilified and worse, or because he would have to admit alcoholic blackouts, or perhaps a different incident.

    He is on record as denying it, but that statenment was made before this all became public.

    The committee is probably willing to hear Mark Judge but not to subpoena him. His testimony would be extremely useful of course.

    Kavanaugh would testify first, then Ford would testify, and Kavanaugh would have no opportunity to respond or rebut;

    A totally nonsensical and unfair procedure.

    Have they forgotten every thing they ever heard or knew about due process and civil liberties? I don’t think even the Star Chamber worked that way.

    The Friday deadline for her to provide written statement before the hearing would be waived;

    That one would be fair – except for the problem of fact checking.

    Provide adequate security

    Everyone seems to agree with that in principle, but talking about that presents many opportunities for obstruction and stalling, while not being openly unco-operative.

    Only one pool camera in hearing room;

    Could be a problem if the camera operator is too friendly to her or unfriendly to Kavanaugh. But basically not a problem. It’s just another obstacle where disagreement could derail the hearing.

    Ford and Kavanaugh allotted the same amount of time to talk.

    Equal time is the sort of thing that sounds fair, but it’s not.

    It takes less time to make an accusation than to rebut it, especially if some aspects of the accusation involve prejudices of the public, which need to be argued against. And the public also could be prepped for her testimony so that she could deliver it in a kind of shorthand.

    I think “equal time” can be very unfair. It’s invoked far too often. If you ever eheard radio debates you can see how that does not work.

    And who gets to decide how much time she gets. She uses as much as she wants (or she won’t co-operate) but he could be limited.

    You’re right! And just to back up your excellent point, there was that guy who bashed Cruz’s wife personally. And that guy who implied Cruz was not eligible to be president. And that other guy who implied Cruz’s father was a murderer. One guy compared Carson to a child molester. Someone attacked Hillary for being unable to “satisfy her husband.” A guy attacked Meghan Kelly for “blood coming out of her whatever”and a guy attacked Justice Sotomayor for being diabetic, and Ginsburg for her weight. Some weirdo claimed Obama’s birth certificate would show Obama is a Muslim and therefore he could not have changed his religion to Christian. A guy even made a lot of issues out of the size of his penis during a presidential debate.

    I’m really glad we have Trump and his fans out there, ever watchful for whoever it was who lowered the bar on evidence free hoax scandals.

    Ideally her name isn’t leaked. This is investigated in private. No big grand inquisition until they corroborate or resolve this as best as they can.

    But this isn’t the ideal.

    So second to that, yes, get her to DC and she can testify and be confronted and that is that. I somehow don’t think a bunch of Republicans cross examining Dr. ford is going to play well, but whatever.

    Third option, yeah, sure send a lawyer to her to give her a proper cross examination on video. I see no real problem with that.

    All of these are better than delaying the confirmation process for a long time as she treks across the country and we negotiate the terms of the testimony.

    Most of your comment doesn’t pertain to what I said though. What about sending someone to talk to her makes you think I believe her?

That immediately brings into question why someone would want to do the very thing Fors Blakey requested not be done. And that naturally leads us, reasonably and without partisan bias, to assume an ulterior motive was at play. Given the nature of the case and the nomination of a new SCJ, without reaching, it points directly to politics. So the question becomes, who would benefit most from setting this in motion before the public? Who has the most to gain?

    I believe that, whether Ford Blasey is telling the truth or not, or has misremembered the event/persons involved, she is being skillfully used by Democrats well-practiced in the art of deception to accomplish their ultimate goal: to make sure Kavanaugh is not seated. I just think there’s no use in dehumanizing her. Still, it’s worth investigating as best as we can.

    As far as I know, as far as everybody knows, she has no witnesses to the event that have corroborated her account.

    None of us were there or can get into Dr. Ford’s head. I tend to give people the benefit of the doubt, particularly people who are going through a huge upheaval in their lives to claim someone did something wrong. I get that there is a huge political motive for lying, but still, I suspect Ford believes her story and that it’s probably distorted from decades of reliving the experience.

    At this stage, Kevin is right and these folks are rehearsing questions with Ford, probably actually having literal dress rehearsals. She may not even be giving her own testimony, but rather something carefully crafted for whatever purposes political people have for this kind of thing.

    A lot of people have pointed out how this highlights cynical choices on the left, but it’s not making the GOP look that great either. Why is there a rush for this judge, but replacing Scalia took a year? Just politics. That’s all any of this amounts to. Whether this woman was assaulted is just a card being played in a game.

    With respect I disagree. This is a purely political attack, aimed at driving the nominee to withdraw and putting the confirmation in the hands of a Democrat Senate (which will confirm no one until 2021).

    I don’t believe the first word here, not even that something happened to her at someone else’s hands. Too much vagueness, too long unmentioned, too many “helpful” liars, too much orchestrated support by people informed solely by political preference. It’s an Anita Hill do-ever, planned and gamed for years, that found a willing participant.

    Why would she do this? We don’t know what she’s been promised but at the very least I’d expect a professorship somewhere nice like Smith. Maybe a stipend from a foundation.

It would give Dems the momentum going into the midterms. It would call into question whether a new nominee could get through…..especially under the unlikely possibility that the Dems take the Senate. A “more conservative” nominee will also elicit more hysterics and more foot dragging….which creates an even greater farcical situation….hurting the prestige of the institution.     The established process was followed, the nominee was vetted by the FBI. The Democrats were aware of this woman’s letter before the hearings – which were clownishly disrupted by their front-line fanatics – and they chose to not bring it up.     Trump has made things harder for every Republican by validating the left’s caricatures.

    There must certainly be a limit to what Grassley can concede, and that limit is the point where concessions begin to materially harm Kavanaugh’s prospects for confirmation.

    I’m not convinced we’re at that point yet. If Spanky will just keep his mouth shut, Kavanaugh has the votes whether they are counted in two days or ten.
