Flurry of Lawsuits Over Bathroom Law

The United States and North Carolina tangled over transgender rights on Monday, with the Justice Department filing a civil rights lawsuit over the state’s so-called bathroom bill and state officials defiantly filing suits against the federal directive to stop the implementation of the controversial legislation.

Also, a major player in North Carolina — the state’s public university system — defied the governor and legislature and told the Justice Department on Monday it intends to act “in compliance with federal law” as it relates to House Bill 2, known as HB2.
The Justice Department seeks declaratory relief and threatens to curtail federal funding to the North Carolina Department of Public Safety and the University of North Carolina.

Once you give the federal government unlimited money to grant to (or withhold from) states as they see fit, the states have to dance to their tune or get slammed. I like that North Carolina is standing up to them in favor of their constitutional authority to decide such matters at a state level.

P.S. Americans face a stark choice this November between a candidate who thinks the North Carolina law never should have been passed, and a candidate who thinks the thinks the North Carolina law never should have been passed but then kinda sorta walked that back.

  6. I people want to see North Carolina prevail, they should encourage as many males as possible to invade the ladies rooms across the country. For all the abstract sympathy for transgenders, the reality of a man with a beard walking into their comfort zone will freak the ladies out. Big time! This will not be decided in court, it will be decided by public opinion.

    Democrats pull stunts like this in election years to pander to the gay community. This one goes too far.

  9. I think these state laws are silly and not needed but Washington has no business under any sane interpretation of the law to intervene here. This is another example of how the unaccountable administrative state – the OCR of the DOJ just making this up based on their own wishes – threatens our liberties.

    Imagine Trump being asked about federalism? “I love federalism, nobody loves it more than I do. Federalist love me!!”

    As people who have frequented this site for more than a few years may know, I’m a lifelong San Francisco resident that has seen the gay rights movement progress from a small “Only In San Francisco” parade to where we are today, where a woman can be accused of hatred because she’s uncomfortable with the idea of a man using the same restroom she is, and the Attorney General of the United States can call such a person a “bully.”

    Silly, immature, shallow twits like happyfeet, who has problems with both Christians and women, will never get it, because they’re too damned self-centered to comprehend the enormity of the Federal Government shoehorning a sexual minority into federal statutes and then using that questionable maneuver to prioritize their social justice goals over First Amendment rights of freedom of religion and freedom of association.

    Thank goodness Pat McCrory isn’t (thusfar) made of the gelatinous solution that Mike Pence and his ilk are.

  18. Here is a winning platform for a third party candidate:
    1) Congress and all federal employees must live by the same laws as everyone else,
    and when possible should live by new laws for 6 months prior to them taking effect in the rest of the country
    2) Work to bring all laws into alignment with #1 where differences now exist
    3) Females should have bathroom and locker room facilities free from males, (some kind of nice wording)

    Those alone with some other common sense commitment to the rule of law, including changing the Constitution only by Constitutional Amendment ,
    Should win an election.

    As I said before, hopefully the feds will yet make some folk heroes out of this nonsense.
    I read a quote even from Ginsberg years ago saying it was absurd to require men and women to use the same private space.

    I bet not.
    No one that I know of is suggesting testing or monitoring to prove no transsexuals use a bathroom,
    but no one with male genitalia should be allowed to expose themselves in a woman’s locker room or bathroom.

    They have problems with people telling other people what sex they are. According to them, a person is whatever sex they say they are, and people have no right to object, because if they do, they’re imposing on them.

    There is no privacy violation, because privacy violations only occur, in the public bathroom arena, when two people of the opposite sex are in the same bathroom, and they just told you no one has a right to dispute whatever sex anyone claims to be. 2+2=5.

  33. I do think that people generally act “logically” given what they value/believe/what facts they think are true.

    There are those of liberal leanings who see our duty in life is to be nice and see Jesus as a liberal who wants everyone to share, and doesn’t think of “forced sharing” as stealing.

    Then there are those who rebel and reject the conventional, they are not interested in being “nice people”, they are interested in proclaiming they are free to do what they please,
    if that looks like saying “stay out of my bedroom”, so be it,
    if that looks like “I want to go into whatever bathroom I want to go into, then go with that.

    The real issue is what “I want to do”, not what you or anyone “should do”,
    except, of course,

    A few years ago, I was exploring the archives of newspapers from the turn of the 20th century, and was fascinated when I came across images of women throughout the generations. Looking at early photography and daguerrotypes, as well as the artwork from masters like DaVinci, Rubens, Gauguin, and others, I made this observation: For many reasons, including modern developments in nutrition, exercise, cosmetics, cosmetic surgery, dentistry, changing attitudes about “plus size” females, (and fashion that followed them), women living in 21st Century are — on the whole — the most attractive in history.

    That’s about to end. Because with the promotion of Caitlyn Jenner as an example of female beauty, we’re going to have masculine “women” thrust in our face and be dared to express a problem with it. In recent days, Sports Illustrated magazine announced they will have a cover featuring Jenner wearing little more than the Stars and Stripes. That’s right: The magazine that over the decades caused many a prepubescent boy to discover the rush of his maturing body preparing him for eventual reproduction is now going to give him the opportunity to test whether a tranny can give him a woody.

    Yeah, I said it. In crude terms. Because it’s true. No matter how much they would like to spray perfume on it, that’s the fact: Someone at SI wants to promote the idea that the great Used-To-Be-Bruce is not unusual, and the equivalent of the hundreds of magnificent women who have graced its pages over the decades.   43. Massachusetts is now debating a bill similar to the one Charlotte had. If the Governor vetoes it, will the DOJ land on Massachusetts for refusing to protect sexual minorities?

    I have a feeling that this is all about making an example out of North Carolina – or any person who has the audacity to say that men ought not to shower in the women’s room. It is madness, and it is vicious.
