Stevie Wonder: I’m Boycotting Florida — And All the Stand Your Ground States!

Florida fans of Stevie Wonder who want to see the legend sing are going to have to go on a road trip for the near future. During a performance in Quebec City, Canada, on Sunday, the Grammy-winning performer spoke out about the recent acquittal of George Zimmerman and announced he would boycott the state.

“I decided today that until the ‘Stand Your Ground’ law is abolished in Florida, I will never perform there again,” he told the audience. “As a matter of fact, wherever I find that law exists, I will not perform in that state or in that part of the world.”

Like Florida, California has no duty to retreat, and I believe many other states follow suit, although I have seen varying numbers. This NPR article says it’s “21 plus.” Leave more accurate links in the comments.

I have a feeling his principles are going to evaporate, or there will be some parsing (“That’s not really a stand your ground state!”), once old Stevie realizes how many places he has taken off of his schedule.

As for me, I’m going to boycott blind singers.

    Some states also have the law through judicial interpretation, I guess, like CA.

  18. A real boycott would mean Stevie Wonder will not perform in any of those states or visit them. So no more vacations or visiting friends in a Stand-Your-Ground state, and no more layovers in a Stand-Your-Ground state airport while traveling.

    This could be difficult. My guess is the boycott won’t be that extensive or long-lived.

    First, they are painless. Second they don’t work. Third, Hi Opal. And fourth, it reduces the lines at whatever chain restaurant or box store that the left is mad at this week. Well, not really on the fourth, but boycott away everybody.

    I’m constantly amazed at has-beens who think they have some sort of moral authority. If I lived in a state that didn’t have a stand your ground law I’d lobby my legislature to pass one just to keep this loser out.

    The bills in Louisiana and West Virginia passed with Democratic control of both houses in the states’ legislatures, in 2006 and 2008, respectively.

    Former Michigan Gov. Jennifer Granholm now hosts “The War Room” on Current TV.     He successfully — he will tell you — boycotted my home state of Arizona back when we were one of the last holdout states on recognizing the federal MLK holiday; and now, he believes that repeating the exact same tactic will achieve similar results.

    Anyway, I’m going to negligently accept the Mother Jones map cited above:

    It might not be valid. But I’ll look up the other 21 states.

    1. California. (I know this one; too lazy to cite, but if you didn’t start it, you don’t have to retreat. For duty-to-retreat states, most don’t require it in the home.)

    2. Pennsylvania: Duty to retreat, if retreat can be done with “complete” safety. Commonwealth v. Buksa 655 A2d 576.

    3. Colorado: No duty to retreat. People v. Garcia (28 P.3d 340)

    4. Wyoming: Duty to retreat, mostly. If you can figure out the rule from Garcia v. State 667 P.2d 1178, you’re a better person than I am. Mendoza v. State, 2013 WY 55, is pretty clear, though, that there is usually a duty to retreat.

    5. New Mexico. No duty to retreat. State v. Chacon, 603 P.2d 320.

    6. North Dakota: Duty to retreat. State v. Leidholm, 334 NW 2d 811.

    7. Nebraska: No duty to retreat. (Phrased as: Duty to retreat if not the initial aggressor, but not otherwise in State v. White 819 NW 2d 473; 2012 case which made new law in that state.)

    8. Missouri: Duty to retreat, except in defending the home: State v. Johnson, 54 SW 3d 598.

    Assuming that the Mother Jones map is right, 25 of the other states have no duty to retreat by statute, and four states are considering statutes to make that rule; let’s assume those four are duty to retreat states. If so, that’s 19 states with a duty to retreat.

    Admittedly, finding this out was impossible for any media organization ever, because you would have to have Google. (OK, Google Scholar. Which is awesome for this sort of thing, and if you’re a prosecutor reading this and you need to determine out of state priorability for other-state crimes, it is muy bueno.)

    Yes, Ohio has a duty to retreat. We also have “castle doctrine” for your home and car, where you do not have a duty to retreat.

    It’s also “shall-issue”, you can go to a neighboring county to get your permit (no local idiot blocking you), and each year the laws are getting clearer and clearer.

    There’s still an annoying notification requirement (annoying because it’s worded poorly and easy to abuse; look up “Officer Roid Rage”), but this year they cleared up the laws on transporting in a car.

    Still, Bower says the city doesn’t have much ability to end Urban Beach Week, considering the throngs of tourists who flood Miami Beach’s Art Deco district don’t come for city permitted events, but for private concerts and parties.

    Perhaps, sir, if you got the word out about Florida’s SYG law you can do what the city of Miami and its residents want to do but can’t. End Urban Week.

Even in such case, however, the actor may not use deadly physical force if he or she knows that with complete personal safety, to oneself and others he or she may avoid the necessity of so doing by retreating; except that the actor is under no duty to retreat if he or she is:
    (i) in his or her dwelling and not the initial aggressor; or
    (ii) a police officer or peace officer or a person assisting a police officer or a peace officer at the latter’s direction, acting pursuant to section 35.30; or
    (b) He or she reasonably believes that such other person is committing or attempting to commit a kidnapping, forcible rape, forcible criminal sexual act or robbery; or
    (c) He or she reasonably believes that such other person is committing or attempting to commit a burglary, and the circumstances are such that the use of deadly physical force is authorized by subdivision three of section 35.20.

    So you really only have to retreat if you are outside your home AND it is completely safe to do so AND you are trying to stop generally non-violent crimes on your own.

Georgie set the scene for murder, if he’d done as he was told (do not engage, let the police handle it, stayed in his car, left his GUN out of it) Trayvon would be alive. In some parts of this country the political governmental systems are VERY racist. Remember, Georgie was part of Neighborhood WATCH, not stalk and kill! Now to the point, if the races had been reversed Georgie would have gone done without question. Don’t you get it? Regardless of the color of someone’s skin we are all of the same race – the human race. Why have you allowed yourself to be turned back 50 years in your thinking? White, black, brown, yellow, red, or purple, we are all humans and if we cannot get along in this world, & treat each other with fairness and kindness, we are over as a species. We are on the verge of much more important problems, climate change! And if we don’t get our little minds on this problem all the rest won’t matter. Either a tornado, hurricane, wild fire, disease, quakes or other catastrophe will get you and all your damn guns won’t do anything but maybe give you a quick out when you finally get it that this will be the end of humanity. Isn’t life hard enough without creating more drama. Let’s give each other a break, wake up to the REAL problems that we face, and get to work making a better world so that our children will have something to inherit. What will you say when your kid asks you what did you do when it was clear that we had a major problem…? Not to change the subject from all the glee some where having at Stevie Wonder’s expense.

  120. Let me state an unequivocal bottom line for all those silly “if George had stayed in his car” people:
    George and Trayvon each had the same “right”–an equal “right”, to walk around in that neighborhood as the other did. Trayvon was visiting residents there, and Zimmerman lived there. Something bad happened. But the cause is not that Zimmerman got out of his vehicle and was walking in his own neighborhood.
