    I’m watching the U.S. Attorney Ortiz and she just said the guy was not given Miranda rights because of something I did not catch.

    I share your frustration, but I slightly disagree. Two things have changed since 9/10/2001 and 9/12/2001:
    1) We kill terrorists overseas instead of capturing them (I guess a Hellfire missile is thought by some to be kinder than water-boarding).
    2) The DOJ is using resources trying to deport parents who want to home school their children.

    I share your concern. I suspect the Obama Administration is relying on an expanded public safety exception to the Miranda Rule, despite the fact that Holder has previously suggested Congress should legislate a terrorism exception to Miranda — legislation that never came to pass.

    Maybe there’s been an executive order we don’t know about, or maybe the DOJ and federal law enforcement are simply repeating what they did with the New York City car bomber, Faisal Shahzad. Or both, since this Administration always seems willing to get what it wants.

    First, any United States citizen, regardless of origin, is entitled to the rights of the Constitution and the Bill of Rights.

    Second, if you may remember, there was a whole lot of folderol at a point in our history that a certain President did not extend rights to foreign combatants.

    Classmates from high school said Katherine was a 2007 graduate of North Kingstown Senior High School. A neighbor, Paula Gillette, 59, told NBC News that Katherine, the oldest of three girls in the Russell family, attended Suffolk University in Boston. A spokesman for Suffolk said that a Katherine O. Russell from North Kingstown was a communication major from the fall of 2007 to spring 2010, three academic years, but did not receive a degree.

    When she moved back in, Gillette said, she had a young daughter and had taken to wearing a hijab and Islamic dress and rarely left the house.

    Mitt Romney on Thursday said his former presidential rival gave a “superb” speech at a memorial service honoring the victims of the Boston Marathon bombings.

    “I must admit I was also very impressed with the words of the mayor, Mayor Menino, with our governor, Gov. Deval Patrick, and with the president,” Romney said, speaking on CNN’s “The Situation Room” several hours after the interfaith memorial service at which those leaders spoke. “I thought the president gave a superb address to the people of this city and the state and the nation. It was an inspiring day.”

    Mitt Romney, who was the Republican nominees for president in 2012, seems perplexed as to what possible motivations drove the so-called terrorists to make the explosions.

    “We begin, the first days, trying to understand how this could possibly happen,” Romney said. “We mourn, we grieve for those who are so badly injured and those who have lost their lives, but we also say, ‘Who has done this?’ And now it appears we’re zeroing in on serious suspects. Then of course we ask, why? Why would people be so demented, so stunted in their intellectual capacity, that they would do something so horrible? When I say intellectual capacity, I should say moral capacity. It’s hard to fathom.”

  123. I am really bothered by the idea that Tsarnaev might not be afforded his Constitutional rights and/or might be treated as an enemy combatant from the time he was taken into custody.

    He is an American citizen captured on American soil, and while it seems clear he is one of the bombers in this case — what if the evidence weren’t so clear? After all, other people who weren’t guilty apparently became the target of this investigation, and there’s no guarantee the police will get the right person every time.

    To me, the Public Safety Exception was intended to cover imminent, immediate threats. I think the doctrine was stretched beyond reason in the Shahzad case in New York, and the DOJ is repeating that here. There’s a reason Holder wanted a Terrorism Exception so he didn’t have to rely on the Public Safety Exception. There’s also reason why Congress declined to give it to him.

    An eyewitness account which has been in the press for days (yes, yes, I know, the press) has it that the brothers were in a shootout, threw a bomb that went 20 yards at most, and then one (clearly Tamerlan) charged the police and was tackled. At that point the other (clearly Dzhokhar) jumped into the Benz and drove directly at the police, broke through the cordon, and escaped.

    The eyewitness didn’t report seeing Dzhokhar run over his older brother, but if it happened that’s when it would have.

    Point being there’s no way Dzhokhar could have known Tamerlan was dead. The instant before he ran over him Tamerlan was charging and wrestling with the cops. Dzhokhar must have at least suspected Tamerlan was alive.

    Which is why I suspect there were some anger issues between the two brothers. In these types of cases there are always a clear leader and a clear follower. Think Johm Muhammad and Lee Malvo, the “DC snipers.” In this case Tamerlan was undoubtedly the leader.

    Tamerlan’s former boxing coach says Tamerlan was the best boxer in Boston, that he smoked all the pros even. He also described a personality change. When Tamerlan was boxing at his mixed-martial arts center he was always polite and respectful. But a couple of years back he stopped going there, instead training at another local gym. He did come back once recently. This time he was rude and arrogant, using other peoples’ equipment without asking and walking on the mats with his shoes.

    Just saying, it sounds like Tamerlan could be intimidating and he certainly was abusive and violent. On the other hand Dzhokhar was clearly competitive as well. Apparently he was captain of his H.S. wrestling team and won some state championships. Not all followers meekly accept their role like Malvo did. Sometimes the follower contests his role, and the leader has to keep him in line.

    Obviously I don’t know what kind of relationship the two brothers had. But running over his brother suggests it wasn’t all sweetness and light.

    Both the Committee to Protect Journalists, or CPJ, and Reporters Without Borders, or RWB, sounded alarms over the Israel Defense Forces’ deliberate targeting of two media centers in Gaza City Sunday during the continuing Hamas-Israel confrontation.

    “Journalists are civilians and are protected under international law in military conflict,” Robert Mahoney, New York-based CPJ’s deputy director, said in a statement. “Israel knows this and should cease targeting facilities housing media organizations and journalists immediately.”Along the same line, Christophe Deloire, Paris-based RWB’s secretary-general, said in a separate statement: “These attacks constitute obstruction of freedom of information. We remind the Israeli authorities that, under humanitarian law, the news media enjoy the same protection as civilians and cannot be regarded as military targets.”

    You’d never know the “media centers” she’s talking about are Hamas government buildings; propaganda centers. The press works out of Hamas “media centers” so their reporting can be controlled. Usually it’s not really necessary; the press wants to write pro-Hamas anti-Israel propaganda (so it’s fitting they’re in a building dedicated to exactly that purpose). As well as provide Hamas government buildings housing their psychological warfare effort, legitimate military targets, with human shields.

    Here they learn a brand of Islam/leftism that’s not at all traditional. It reminds me very much of the Japanese of WWII who thought they were adhering to Bushido when they refused to surrender or committed their various atrocities. Truth be told the Bushi (Japanese warriors) who lived when there was actual fighting to be done didn’t have a lot of time to sit around writing about Bushido. It was only later, during the long enforced peace of the Edo/Tokugawa period that they took the time to write about what they imagined Bushido demanded. It had no more basis in reality than a 1950s TV show could tell you about how it really was in the old west.

    Prisoners of war are not supposed to be given added privileges or threatened with punishments, even the death penalty, if they do not co-operate, but the FBI is perfectly free to do that to civilians who have been arrested.

    In an attempt to intimidate inmates, the lead American lawyer for Australian detainee David Hicks said, pictures of Saddam’s trial were also shown to detainees, along with articles about executions carried out by extremists.

    “Displaying photos of condemned men to those who may be facing capital charges can only be interpreted as an attempt to intimidate and compel submission under a threat of death and mentally torture an already abused detainee population,” Joshua Dratel said in a statement to media in Australia.

    This particular article has no confirmation as to whther this actually happened and whether they were told not to do it, but I think it did.
