Trayvon Martin’s Mother Seeks Money from HOA, State

At least as far as the state goes, this seems pretty standard:

Trayvon Martin’s mother is asking for at least $75,000 from the homeowners’ association of the gated community where her teenage son was fatally shot by neighborhood watch volunteer George Zimmerman, court documents show.

Sybrina Fulton also has asked for an undisclosed amount of money from a state fund set up to help crime victims with things like funeral expenses and counseling, according to state documents obtained by The Associated Press.

In murder cases in California, it is standard for victims’ families to have funeral expenses and related costs to be compensated from a state fund paid for by assessments on convicted criminals. The claim against the homeowners’ association strikes me as more dubious, but not completely surprising.

  1. I think they should sue the manufacturer of his automobile, the manufacturer of his gun, their local school for suspending him, and the 7-11 for selling him Skittles.

  2. However has the deep pockets. My guess is once the criminal trial is done she will sue Zimmerman in civil court for wrongful death. Whether that is the right thing to do or not is another matter but it wouldn’t surprise me.

    It is so sad that the real issues, and real resolution to TM’s family’s grief gets lost in the circus acts.

    There aren’t any facts to back up any claim I think.

Is it common for Trayvon Martin to be considered a crime victim simply because charges were filed against Zimmerman, even if it is ultimately determined that Zimmerman shot Martin in self-defense? In other words, is the mere existence of a criminal charge enough and the outcome of the criminal trial doesn’t matter?

    I can see an argument for why that should be so, but I also think the existence of a self-defense claim raises real questions about treating Martin as a crime victim.

  25. Problem is: Trayvon was the criminal and Zimmerman the victim. Zimmerman defended himself from a beating that may have proved fatal had he been unarmed.

    So, how does Trayvon’s family get money from the state when ALL of the witnesses identify him as the aggressor in the assault? Just because he ultimately lost the fight that doesn’t make him a ‘victim’.

  28. I do not understand “the claim” against the HOA. You don’t make a claim on the tortfeasors insurer. You sue him and he gives it to his insurer for defense and indemnity. The court case mentioned sounds like a coverage action between Travelers and the HOA.

  29. nk, probably you are right. However, in some rare cases, a plaintiff will take an assignment of a bad faith insurance claim from a defendant in settlement. But not in an initial complaint obviously.

  31. Yes,this is just a declaratory judgment action filed by the insurer to obtain a judicial determination if its D&O policy, which excludes “bodily injury” covers this event. You can bet there’s a companion General Liability out there, probably issued by the same insurer, which covers “bodily injury.” The insurer, obviously, has a legitimate interest in ascertaining whether the courts would find coverage under both policies, doubling the limits of its potential liability. (I have not world enough and time to expand on how this might be pulled off.) Fulton is a necessary party to the suit. $75,000 is merely the minimum jurisdictional limit of the federal court.

    So Mrs. Martin isn’t being a heartless vulture feeding on the carrion – it’s the government rules and regs that force her to appear so to a cursory observer.

    Has anybody here ever buried a child? It’s just as expensive as burying a parent or grandparent, plus such a remote possibility that a child would die first, nobody makes plans for such a thing.

    It’s a staggering loss.
    If the Martin family can get some relief legally more power to them.

    Personally, I think they would have better luck tapping the public’s emotional investment in the story, setting up a “help us bury Trayvon” paypal donation system getting the celebrity race hustlers and CNN anchors to plug the cause.

Trayvon’s mother bore him and loved him and whether or not he turned into the fine young man all mothers dream of when their boys are toddlers, she worried about him and has endured an unspeakable loss. Although Trayvon’s mother and dad were not still together it appears that Trayvon had an ongoing relationship with him and his second family. Trayvon lived with his mom and went to school there, then was sent to be with his dad when there was early trouble–probably in hopes of some male parental discipline and influence. Up until Trayvon’s last day on earth–which makes it different– this same story plays out every day in homes across America where scared parents are dealing with troubled teens. It happens in middle class families and also in some of the toniest neighborhoods.

    And another thing that really makes this story different is that politicians, professional race baiters, PR people, greedy lawyers, and the media got ahold of the grieving and vulnerable parents for their own purposes. Yes, the mom is looking for money now and I am sure she does feel she is “owed”–because people have told her so.

    I think one who has been part of a tragedy or has lost a child unexpectedly is prone to react in ways, or say and do things, that look wrong and out of proportion to the rest of us who are not grieving. I am going to try to hold my ire for Sybrina Fulton’s actions and unleash it upon the aforementioned vultures who continue to use that family.

  38. Oh, make no mistake about it, papertiger–when Crump sues, it will be for millions. And it’s hard to get real worked up over this if a sober review of the evidentiary record has led you to the conclusion that “Little Trayvon” (all 6 ft. of him) viciously attacked Zimmerman.

  40. Since when do the heirs of presumed criminals threatening their victims with bodily harm who have been killed get consideration as the victims of criminal action?

    Let Zim get convicted, THEN she should be eligible. Short of that, Trayvon brought this on himself and the State, the HOA, nor Zimmerman owes her anything but condolences.
