Stupid Lawyer Pesters President with Incompetent Request for Pardon for Charles Manson

As a palate clenser, we get this idiotic story from TMZ:

Giovanni Di Stefano — known as “The Devil’s Advocate” — tells TMZ, he wants the Prez to set Manson free.

Di Stefano — who has also repped the likes of Saddam Hussein — says Manson was nothing more than a cult leader, not a murderer — Manson didn’t do the killing.  Di Stefano says at worst, Manson is guilty of telling his followers to “do something witchy” — never specifying murder.

Di Stefano complains, “Manson has been made out in America to be the Satan of the criminal justice system. He does not deserve the title.”

Right.  It is quite unfair the way we portray Manson as evil.  I mean look at that face!

Who could stay mad a face like that?

But the most ridiculous thing about this?  Manson was convicted under California state law.  And the President of the United States has no power to grant a pardon for state crimes.

Amazingly this idiot lawyer notes that Manson was convicted under California law on page four of the pardon letter.  And he quotes from the Constitution right off the bat, where it says, “Please accept this as an application under Article II, Section 2 of the United States Constitution which states that the President ‘shall have power to grant reprieves and pardons for offenses against the United States.’”  (Emphasis added.)  But amazingly he has no idea that those very words inform him that he is talking to the wrong guy.  The man you want to talk to is Governor Brown.

Personally my respect for Obama would skyrocket if he wrote a very simple response, on Presidential letterhead:

Dear Mr. Di Stefano,

I can’t grant pardons for state crimes even if I wanted to.  You are an idiot.

President Obama

Seriously, if you are currently being represented by Mr. DiStephano, consider finding competent counsel instead.

  9. Even Eric Holder concurs with Aaron’s interpretation of this provision of the Constitution, by the way. (I know, AG Holder is a dubious source to cite on matters of constitutional law — as is his boss, shamefully and shamelessly — but bear with me just on this one point.)

    On one of Holder’s webpages — from which they haven’t yet airbrushed the American flag, I’m glad to see — we find the United States Department of Justice’s Pardon Information and Instructions, which provided (boldface in original; italics mine):

    2. Federal convictions only

    Under the Constitution, only federal criminal convictions, such as those obtained in the United States District Courts, may be pardoned by the President. In addition, the President’s pardon power extends to convictions obtained in the Superior Court of the District of Columbia and military court-martial proceedings. However, the President cannot pardon a state criminal offense. Accordingly, if you are seeking clemency for a state criminal conviction, you should not complete and submit this petition. Instead, you should contact the Governor or other appropriate authorities of the state where you reside or where the conviction occurred (such as the state board of pardons and paroles) to determine whether any relief is available to you under state law. If you have a federal conviction, information about the conviction may be obtained from the clerk of the federal court where you were convicted.

This has now got me musing about quantum mechanics and parallel universes possibly being generated by the changes in phase state of a single electron in a single atom of a single molecule anywhere in the universe. I’m not much of a physicist — I’ve probably stumbled already in trying to refer to their theories, of which I have only a tenuous understanding at best anyway — but doesn’t there have to be some action, even this small, to generate a new universe?

    If so:

    How could something affect interstate commerce if it can’t even spawn a parallel universe in quantum theory?

On still further reflection: I still think it’s highly unlikely, but nevertheless, I think there is some very, very small possibility that at least once, Barack Obama has indeed contemplated the question of whether he could pardon Charles Manson. Say it happened during the transition, on December 19, 2008 — a random bit of musing by Obama as someone from Justice was briefing Obama on what part in his daily routine his constitutional pardon duties might play.

    That thought process and its bio-chemical and -electric components would have generated billions of parallel universes.

    But there are tens of thousands, probably hundreds of thousands, and possibly millions of schlubs here in the U.S. who’ve never troubled a single molecule of a single neuron in contemplating the purchase of health insurance.

    Dems would have us believe that even by not thinking about it, they’ve created even a single parallel alternative universe, when quantum theory says that’s impossible!

    They told me if I voted for the Republicans then the White House would make war on science … and they were right!

  16. I cannot believe how you constitutional scholars have missed the clear logical progression here.

    See, if Obama tells Holder not to do something he should do, like defend DOMA, then the concept in physics that every action has a reaction comes into play, and Obama can tell Holder to do something he shouldn’t do, like pardon Manson.

    But Manson will be immediately arrested for hate crimes because of his tatoo and locked up in a Fed pen without chance of parole, so everyone is quite safe, don’t you see, said Painted Jaguar.

    My understanding is not much better than yours, but I think you’re wrong about the quantum theory. (Not the constitutional theory, just the quantum theory).

    No action/not thinking would translate at the atomic level into atom or electron not changing phase state. Under that alternate universe theory, at the same time that it remained in the same phase state, an alternate universe would come into being in which it did change phase state.

    So even not acting and not thinking would result in an alternate universe in which you acted and/or thought, and could therefore be forced to purchase a health plan from United Health Care.

    The constitution allows you to appeal any case on grounds that implicate your constitutional rights. You can appeal any state conviction to a federal court for an illegal search, for example, or to demonstrate grounds for detention (habeus corpus).

    However, that’s judicial. Pardons are executive. Obama is not in charge of the execution of state laws. It’s not his job to make sure Cali did that correctly, or exercising special discretion over a state’s case that went bad (that’s what a pardon is for).

    Constitutional scholars are trying to figure out a way for the Commerce Clause… or anything in the Constitution… to allow the people to keep and bear arms. It doesn’t look good, though.

    Oh, and since only Chuck Norris can do the things that Chuck Norris does, the Commerce Clause can not do the things that Chuck Norris does.
    That makes things pretty simple. The first act of our next President will be to appoint Norris as Czar of Commerce, and he will define what can and cannot be considered as commerce to be subject to it.

    When the movie of Scott Walker is made, Norris will star in it, and it will be called, “Walker, Wisconsin Governor”.

    FWIW, my daughter’s sensei knows Norris personally and says he is one of the few people he has known that you can count on 100% to follow through on what he says.

I am 72, when i was a kid a common cliche was “you don’t have to make a federal case out of it”.Over the past 50 years more and more of federal encroachments have made thousands of things that should have remained with the states or the people are double covered so people might be prosecutedby by either,and in some cases both for essentially the same action.

    I have at times in the past virtually idolized Bugliosi, which now embarrasses me. I could not bring myself to read his pile of trash accusing George W. Bush of murder; it was the first book of his I didn’t read, and I feared it would cheapen all the rest if I did.

    I try to chalk that episode up to the theory that politics makes everyone insane — even people you otherwise admire.
