Pima Sheriff’s Department Tells Me All Records Have Been Released

Someone from the Pima Sheriff’s Department called me yesterday regarding my open records act request. He told me that everything had already been released and was on their site.

I said that I had seen the information they had already released, and I couldn’t find anything that discussed death threats by Jared Loughner, as the sheriff himself had discussed in his press conference. The representative told me that they had released everything they had except for certain videos and pictures that the FBI had taken for evidence. I asked where the reports of death threats were, and he said that he believed that those were contained in reports from Pima Community College, which he said he believed had been released as well.

I asked him to memorialize what he had told me in an e-mail, which follows:

Per our conversation, the 911 calls, radio logs, PCSD case reports & all informational media releases are available on our website: www.pimasheriff.org. Items that are not available are photographs, videos and any items of evidence. All evidence was seized and sealed by the FBI. Hope this helps.

The reports from Pima Community College have indeed been released and are here. A quick read-through shows one report mentioning Loughner’s having talked about “killing people” — not enough, according to the report, to justify police contact:

Is this what Sheriff Dupnik was talking about when he said: “As we understand it, there have been law enforcement contacts with the individual where he made threats to kill”?

Or are there other reports not being disclosed?

Maybe when people like Chris Matthews get the sheriff on their show for an interview, they could ask him relevant questions like that, instead of questions like “Do you think that talk radio caused this?”

Journalism instead of tabloid trash, in other words.

Nah.

  1. The good Sheriff, like many of his contemporaries who reside too far on the political side of the job instead of on the LE side, has a bad habit of talking out of his ass; but, that is understandable, since that’s where it seems his head resides.

  2. I wouldn’t trust Dopenik as far as I could throw him with an anvil tied to him. He is politician through and through. That seems to be happening more and more as the former Orange County sheriff heads to jail and the LA County sheriff does favors for rich supporters.

  6. It is always a hoot to watch when you gather up your ropes, carbiners, helmet and all the rest of your rock-climbing regalia and slouch purposefully toward a molehill, all the while declaring your intention to reach the summit.
    The shurf probably was talking about what his office had heard from the campus cops, i.e. the tidbit that little report you pasted.
    Whatever.
    I don’t think you need to take oxygen supplies with you on this climb.

  9. I was lead to believe that the Community College had not (and was not by law required to) informed the police about Jared’s threats, and that all notifications to the family regarding Jared’s barring from campus.

    So I have a feeling that report did not come from the Sheriff’s Dept., and still wonder what the Sheriff was talking about when he said “reports”.

    I have a feeling that they’re holding out on us.

  12. Question: the college said that they had dismissed Loughner and that the police were sent to his home to notify both he, and his parents, of that decision.

    Where is that report? Was the visit conducted by the Pima County SD, the university police, etc? The university expelled a kid until he got a psychological evaluation showing he posted no harm to either himself or others and that report is no where to be found?

    Is the Pima County sheriff supressing evidence?

  15. Laws about confidentiality for psych issues are different, in PA anyway, than other medical records. What are the legal requirements/restrictions of/on a college to report concerns about an adult child to his/her parents- in AZ?

    IOW, I don’t know what is being “withheld” vs. tangled up in law.

    In PA, for example, a request for medical records from one doctor to another will NOT be adequate for psych records or for treatment of HIV infection unless explicitly written and agreed to by the patient.

  17. retire05, from what I have heard, it was campus cops that did the notifying. Now, I don’t know if those folks are rent-a-cops, or ACTUAL cops, but I suspect the Sheriff’s dept didn’t get those reports until they went and requested them AFTER the shooting.

    I’m satill left with the question regarding the death threats reported by Dupnik in media appearances. Either something’s being hold back (by either Dupnik’s department or Tucson PD) or Dupnik is a total talk-out-the-ass idiot who should never be allowed in front of a camera. Or both, as these are not mutually exclusive possibilities.

    The officer’s descriptions of Loughner’s behavior also tells me that before assigning his behavior strictly to “mental health issues” Loughner should be checked for physical brain problems to rule out tumor, etc. In any case, he’s a bucket full of short circuits.

  20. Campus cops are generally NOT “rent a cops,” however much people like to make fun of them. In this case, from the PCCC web site:

    “The Pima College Department of Public Safety (DPS) is a bona fide criminal justice agency and has its authority granted by the District Board of Governors and Arizona Revised Statutes. All DPS officers are certified by the Arizona Peace Officer Standards and Training Board (AZPOST) and have received a minimum 585 hours basic peace officer training approved by AZPOST. DPS police officers are armed and have full peace officer authority and powers of arrest.”

    In short, they’re ACTUAL cops.

  21. Well, campus police for REAL colleges are usually “actual” cops, but it’s rare, in my experience, for a community college to have campus security staffed by real police.

What I see from going over the records in the PCCC site is that Loughner’s suspension on 9/29 was triggered by the college’s discovery on that morning of his bizarre “Pima County College School Genocide” YouTube video, which he apparently posted immediately after his removal from class and subsequent meeting with the administrator on 9/23, and before his subsequent follow-up meeting with same with his mother present on 9/27.

    After discovery of the video on 9/29 PCCC admin immediately had a dismissal notice drawn up, which was delivered to Loughner that evening by two PCCC officers with two more standing by as backup. Clearly PCCC police/admin felt he was a potential public safety threat at that time.

    PCCC admin/police promptly followed through on CYA the morning of 9/30 by obtaining a Grand Jury subpeona signed by Deputy Pima County Attorney Barbara Lawall for the posting record of the video. Service of said subpeona was certified by Dupnik’s office on the same date. PCCC police reported the requested materials rec’d on 10/6. That’s when all follow-through apparently stopped cold.

Actually given the number of potential large lawsuits by victims and their families I understand why Shruff Doofus is “dissembling” or as my 9th grade English teacher would have put it “Lying through his Teeth” Brian and Katie and Bob may not like it but way too many people are involved here to keep any real secrets.
