UC Irvine Recommends Suspension of Muslim Student Group

The University of California at Irvine has recommended a Muslim student group be suspended for one year.

UC President Mark Yudof said he played no role in the decision, while UC Irvine Law School President Erwin Chemerinsky was supportive, saying: “Given the seriousness of the offense, I think it’s completely appropriate to suspend them for a year.” Meanwhile, Jewish groups were heartened by the suspension, calling it a victory against hate speech, and Muslim students claimed it unfairly punished the group for the actions of a few.

Although both groups want to portray this in ways that promote their views, I think this is what most colleges do with a school organization that knowingly breaks the law. It’s no different than suspending a fraternity for intentional hazing. It’s not the speech or the arrests that got the Muslim student group in hot water; It’s that the arrests resulted from an intentional, coordinated decision by the group.

  1. UC Irvine Law School President Erwin Chemerinsky was supportive

Hey, some sanity prevails yet. Your freedom of speech does not allow you to take away my freedom of speech (by heckling and disruption).

  2. I am pleased to see this from Erwin Chemerinsky. I was wondering a bit when he was offered this position.

  3. This was in the OC paper a few weeks ago. Apparently they proved intent by looking at emails!
By subpoena or not, I don’t know.

  5. Now, that gives them a year to really investigate and have this organization banned from all campuses of the UC system.

  6. The Muslim Student Union claimed the disruptions were caused by individuals and were not organized by their group.

    — Have ANY of those individuals been kicked out of the group?

I think we can all guess the answer to that one.

  7. I doubt Chemerinsky, UCI’s law-school dean, had much to do with this decision. I think these events involved UCI generally, not its nascent law school specifically. Anyone down there know?

  8. But yes, I agree it’s good (if surprising) to see Chemerinsky take this position. Should have said that initially; I was reacting to a friend in my office who said Chemerinsky was the one laying down the punishment.

  9. Is this the same group that attempted to disrupt Horowitz’s speech about a month ago? That woman who he effectively exposed and ridiculed should have been expelled immediately for hate speech.

  12. Mitch, you are probably right but have you ever seen Chemerinsky shut up about something?

  13. SPQR, are you invoking the “monkeys typing Shakespeare” meme? It’s true, EC does prattle on. Sooner or later, he will say something that makes sense?

  14. Eric, I sometimes claim that Erwin Chemerinsky was one of the reasons I left California. He used to write a column for the Cal Bar Assn tabloid that was painfully unreadable in its incoherence and partisan straining of the law. And in the law school that nk thinks I didn’t attend, I had Con Law from his ex wife …

I always shut down the radio when Hugh Hewitt has Erwin on his show because I can’t stand to listen to his voice and his intellectually dishonest partisan bleating.

  15. SPQR, I listen to Hugh Hewitt from time to time, too—mostly because he sounds pretty positive, even when times are bleak. I don’t always agree with him, but I think he does a good job. I particularly like how he lets people from the “other side” speak their piece, even as he disagrees with him.

    A “happy warrior,” maybe.

Anyway, I’m glad to hear you say that about Chemerinsky’s voice. It irritates me, and I thought I was being small minded. I’m glad to learn it isn’t just me.

A friend of mine on the UCI faculty tells me that Chemerinsky’s house was VERY expensive, and the subject of some controversy when he arrived.

I’m curious about two things: 1) Will the suspension actually be imposed? 2) Will any violence break out?

  17. Greetings:

While UCI’s action in this matter was more than I could hope for, what continues to trouble me is the “were arrested and cited for disturbing a public event, but none have been criminally charged” aspect. I live in the San Francisco Bay area and time and time again demonstrators are permitted to disrupt the commerce and travel of their fellow citizens without suffering any significant legal penalty.

I’m thinking that 30 days or so on the county farm would nicely disrupt the education of the disruptors and put a damper on this nonsense.
