Will Illegals Have to Buy That Mandatory Health Insurance? Will They Be Fined If When They Don’t?

Once mandatory purchasing of health insurance kicks in, will that apply to illegals as well?

And if they show up to the ER without insurance, are they going to be fined?

Or will they be the one class of persons exempt from the mandatory requirement?

I can’t easily find the answer to this question. I know that as of July 2009, Michelle Malkin reported that one version of the plan “creates a new preference for illegal aliens by exempting them from the mandate to buy insurance.” Is that still the case?

Here in California, State Senator Gil Cedillo once actually proposed legislation to exempt illegal immigrants from state laws punishing people who fail to purchase auto insurance. That measure failed, and we may never see such a provision written into law for health care insurance — but somehow I think the problem will be handled by a culture of nonenforcement. To the extent the issue arises, the liberals will tell us it would be cruel and wrong to impose the same sanctions on illegals that the rest of us face for noncompliance.

After all, that’s how they’re handling the issue of giving free care to illegals: technically rule it out and then gut the enforcement. Wouldn’t they do the same on the mandate?

  6. My big fear is that now that Obamacare has passed is what is actually happening: we’ve not cleaned up the national GOP part that set the country up for this by spending too much. I see today on several sites people advocating sending money to the national party. DON’T DO IT. These are the people who supported Scozzafava. All they care about are people with an “R” by their name, not about the country. Send money to individual candidates, and get active in the local party organizations and clean out the GOP leadership. If we send money to the national organization they will waste it in the traditional way.

    And I totally agree with Jeff. The GOP is clever to take advantage of this moment, but donating directly to candidates forces you to scrutinize candidates. It’s Army of Davids.

    I’m just amazed that someone would think it’s a good idea to exclude illegals from having car insurance. I guess all the legal citizens are to carry extra coverage against illegals? Why?

  14. I wanted to give him a chance but now I am of the opinion that Steele must be replaced. I am worried that this opportunity to retake the House in 2010 will be lost if the R. candidates are not vetted and if their campaigns are not coordinated, orchestrated and run like a fine chorale. He’s a good guy but unfortunately I don’t think Steele has the ability to manage that.

    That said, after last night’s impressive united stand at the “vote”, if I hear or see one more so called conservative opine that they would rather vote for a demon democrat than another RINO, because “at least you know where the democrat stands” I will personally rip them a new one. There is simply no possible way that even a RINO does not share more in our American values than any Democrat on the face of the earth. Last night I wondered if all the people who punished John McCain for being a RINO by voting for Obama or by staying home were happy campers. How did that, “it’s time to teach the party a lesson” thingy work out for you last night? Yep, I’m pretty pissed today.

  18. The illegals quickly figure out the system. They know how to go to the ER and they know the ER can’t report them. They also go to local medicos, some of whom are unlicensed healers with native remedies. They also like chiropractic for most injuries.

    There are a number of cultural issues like pap smears. Mexican women, even legal citizens, tend not to get pap smears. UCI did a study to figure out why because the mortality of cervical cancer is much higher in Mexican-American women. They know that cervical cancer is associated with promiscuity. Therefore, to have a pap smear, especially when young, is to admit you were promiscuous.

    Other cultures have odd health beliefs but they are much smaller segments of the population.

    A nice idea, but as I recall, a bill that is unsigned for 10 days goes into law automatically. The exception to this would be if Congress is not in session on the 10th day, in whcih case this is called a pocket veto.

    I’m not a partisan, even though I certainly feel like one since 2003, and I don’t see the GOP landslide as worth the damage.     Bipartisan as in Lindsey Graham will be the only Republican supporting it and he’ll probably crack under the pressure and ride the party line. Unlike opposition to Obamacare.

    Considering that a week before the bill’s passage, Homeland halted all work on the virtual fence – ironically happening just after the Hispanic Caucus and LaRaza voiced their indecision on the vote; and with that, the severe curtailing of border enforcement on our southern borders (according to Border Patrol officials, there is now 85% LESS activity taking place by officers per their directive from the powers that be), I don’t think it’s unduly pessimistic to realistically see this come full circle with amnesty a path to citizenship culminating in health coverage.

    IOW, the illegals will provide votes and support to this president for the next election. Crunch the numbers: How many independents vs. how many illegals will support Obama next go ’round? Who does he need more?

  37. Let’s not forget that something changed as a result of the healthcare bill. Scott Brown took away the Senate’s ability to absolutely ram stuff through. It’s not a huge barrier. There are moderates in the Senate, including Brown, but the crowing that this establishes momentum to do more is simply wrong.

    They have less now than they had in the past, which is why they had to use these strange procedural tactics. They must have some bipartisanship to pass Any New Legislation.

    Amnesty is a good example of how they might get a few Grahams, but I honestly would not count on it. Graham can try his crap next year, and he knows it.

  39. Assuming Scott Brown is who we think he is (not a “full social conservative”, but enough functioning brain cells to be conservative on some issues) I think the Senate is a wall at the moment. I think even McCain and Grahamnesty are peeved with “the other side of the aisle” at the moment. After all, they did not trust the Senate to put through a health care bill again.

    I repeat my question (stupid as it may be). What can Obama do with an executive order between now and November to undermine the election process more than he and his already have? (Say, prevent the DOJ from investigating voting irregularities where La Rasa is working with Black Panthers to “ensure proper voting registration”.

    I say we do the Iraqi thing and give people a purple finger, and absentees need to be verified with a thumbprint on the form- in fact, a thumbprint on who they are voting for.

The IRS will hire 18,000 people to keep track of the no-insurance fines, cross referenced with the HHS Secy, and the new $700 million comprehensive health record computer system. In so far as illegals even file 1040 forms, I can’t imagine IRS wants anything to do with tracking immigration status. Enforcement will be sloppy because nobody likes to be called racist.

  49. Wesson, one does not “prove” to the IRS that one is undocumented. Instead, what happens is that illegal aliens who wish to file tax returns obtain a “Taxpayer Identification Number” from the IRS and files under that. The IRS knows the source of these numbers means that the taxpayer is illegal and is only filing to obtain tax refunds of withheld wages, etc.

Certainly the bill itself presents no strong deterrent in this regard. And if they don’t buy it, they’ll what…get no service at the hospital?   66. My last visit to the ER, the person in front of me spoke Spanish, was only asked their name and told to have a seat. When I got to the window, I was asked to hand over my insurance info before going any further. This is common practice in this almost border town. More anchor babies are born in our one-only hospital than American babies. Off my soap box.
