Will Illegals Have to Buy That Mandatory Health Insurance? Will They Be Fined If When They Don’t?

Once mandatory purchasing of health insurance kicks in, will that apply to illegals as well?

And if they show up to the ER without insurance, are they going to be fined?

Or will they be the one class of persons exempt from the mandatory requirement?

I can’t easily find the answer to this question. I know that as of July 2009, Michelle Malkin reported that one version of the plan “creates a new preference for illegal aliens by exempting them from the mandate to buy insurance.” Is that still the case?

Here in California, State Senator Gil Cedillo once actually proposed legislation to exempt illegal immigrants from state laws punishing people who fail to purchase auto insurance. That measure failed, and we may never see such a provision written into law for health care insurance — but somehow I think the problem will be handled by a culture of nonenforcement. To the extent the issue arises, the liberals will tell us it would be cruel and wrong to impose the same sanctions on illegals that the rest of us face for noncompliance.

After all, that’s how they’re handling the issue of giving free care to illegals: technically rule it out and then gut the enforcement. Wouldn’t they do the same on the mandate?

  1. Or they will use the bill as a rationale for legalizing everyone. So they can enforce the mandates, mind you, not so they can get 12M new dependent voters!

    Patricia (e1047e)

  2. If anything this will prompt more people coming across the border thinking they will get free health care to go along with their free education.

If there is any serious attempt to enforce this law against illegals I will be shocked.

  3. no, no. next up will be immigration reform. and you can bet it will be rammed through. they need those newly minted voters to have any chance of surviving november.

  4. Remember, those soon – to – be – hired 16,000 IRS officers are there to enforce the new mandates on US citizens, and not the poor illegals.

  5. By this time next year, there won’t be any illegals.

  6. My big fear is that now that Obamacare has passed is what is actually happening: we’ve not cleaned up the national GOP part that set the country up for this by spending too much. I see today on several sites people advocating sending money to the national party. DON’T DO IT. These are the people who supported Scozzafava. All they care about are people with an “R” by their name, not about the country. Send money to individual candidates, and get active in the local party organizations and clean out the GOP leadership. If we send money to the national organization they will waste it in the traditional way.

  7. I recall one version of the bill actually disallowed undocumented immigrants from buying insurance. Quite an idiotic piece of nativism.

  8. When the current session of Congress goes on vacation, can Obama make an executive order making it legal for illegal aliens to vote????

  9. I think Kevin Murphy is onto the solution. :/

And I totally agree with Jeff. The GOP is clever to take advantage of this moment, but donating directly to candidates forces you to scrutinize candidates. It’s Army of Davids.

I’m just amazed that someone would think it’s a good idea to exclude illegals from having car insurance. I guess all the legal citizens are to carry extra coverage against illegals? Why?

  10. Thank you for attempting another threadjack that has nothing to do with the header for this post, imadouchebag. Banning will be quite difficult for you to deal with, methinks. After all, what else do you have in your little life?

  11. BTW:clicking on category “immigration” on your blog, the second post is a DRJ piece about how the hispanic caucus doesn’t like the treatment of the undocumented in this bill. That may have the answers you’re looking for.

It seems like you don’t understand how the mandate works.

    LOL.

It doesn’t make any difference what current legislation says…eventually, they’re going to get free health care…you’re going to pay for it.

  14. I wanted to give him a chance but now I am of the opinion that Steele must be replaced. I am worried that this opportunity to retake the House in 2010 will be lost if the R. candidates are not vetted and if their campaigns are not coordinated, orchestrated and run like a fine chorale. He’s a good guy but unfortunately I don’t think Steele has the ability to manage that.

That said, after last night’s impressive united stand at the “vote”, if I hear or see one more so called conservative opine that they would rather vote for a demon democrat than another RINO, because “at least you know where the democrat stands” I will personally rip them a new one. There is simply no possible way that even a RINO does not share more in our American values than any Democrat on the face of the earth. Last night I wondered if all the people who punished John McCain for being a RINO by voting for Obama or by staying home were happy campers. How did that, “it’s time to teach the party a lesson” thingy work out for you last night? Yep, I’m pretty pissed today.

    elissa (91236c)

  15. “It seems like you don’t understand how the mandate works.”

I realize you’re fishing and I’m only encouraging you, but that was a sarcastic joke from someone who has demonstrated an understand of the bill. You have repeatedly been made a fool of for your misunderstanding of this legislation, and I think that’s why you keep struggling to prove that everyone but you is too stupid to understand what the bill means. You’re projecting, and it doesn’t even make sense this time.

Anyway, carry on. You’ve got a long, long day of bombarding this blog ahead of you! I was wrong that this bill would fail to pass, and I’m probably wrong when I think the democrats wouldn’t dream of passing amnesty just to bolster their votes before November.

This post is simply pointing out that, once again, it’s the honest hard working tax paying person who is punished by these ‘reforms’. The power to tax (good jobs) is the power to destroy.

    Dustin (b54cdc)

  16. imdw

    > It seems like you don’t understand how the mandate works.

Even if true, who can blame him? The actual provisions of this bill aren’t even understood by the congresspersons who voted for it.

Remember, what pelosi said? they have to pass it to learn what is in it.

“Monty, i will trade in my car for whatever is behind door number 2.”

“Ah darn, it was a donkey flatulating.”

    A.W. (e7d72e)

  17. elissa, now is the perfect time to replace Steele. The big story is the health care crap, and a new GOP leadership campaign based on listening to the TEA party could legitimately be launched right now.

They could frame it as the GOP joining the TEA party instead of asking them to join the GOP.

    Dustin (b54cdc)

  18. The illegals quickly figure out the system. They know how to go to the ER and they know the ER can’t report them. They also go to local medicos, some of whom are unlicensed healers with native remedies. They also like chiropractic for most injuries.

There are a number of cultural issues like pap smears. Mexican women, even legal citizens, tend not to get pap smears. UCI did a study to figure out why because the mortality of cervical cancer is much higher in Mexican-American women. They know that cervical cancer is associated with promiscuity. Therefore, to have a pap smear, especially when young, is to admit you were promiscuous.

Other cultures have odd health beliefs but they are much smaller segments of the population.

A nice idea, but as I recall, a bill that is unsigned for 10 days goes into law automatically. The exception to this would be if Congress is not in session on the 10th day, in whcih case this is called a pocket veto.

  24. When will technology catch up with our actual needs? I mean how cool would it be if the Patterico site could be coded to automatically print out imdw’s and few of the other annoyances’ posts in say, red or in extremely tiny print? That way we could quickly see exactly which ones to just skip over and be better able to move along to read the posts of folks whose opinions we are actually interested in reading.

    elissa (91236c)

  25. I love how someone who proudly boasted they fantasized about Beck raping and killing little kids , and then said that kind of shit was “funny” is now crowing about the “teanuts” being “batty”.

You’re the extremist nut you see everywhere you look. You hate the right wing nuts because they are just like you.

Indeed, Amnesty is coming, and it will be labeled as bipartisan just as this health care bill was labeled as bipartisan. The opponents will be very passionate and angry, and indeed, the same jerks will call them names and pretend they are extremists and insane.

And the economy would probably have recovered a while ago if Obama wasn’t so busy doing this stuff.

I’m not a partisan, even though I certainly feel like one since 2003, and I don’t see the GOP landslide as worth the damage. Of course, democrats and republicans and independents who feel this way are all ‘teabagger’ nuts, and everything Obama wants is automatically bipartisan. Enjoy it while it lasts.

    Dustin (b54cdc)

  26. I don’t know if it will pass by November, but you will see bipartisan noise towards comprehensive immigration reform. It will make business happy, and drive the teanuts batty. Even more so.

Bipartisan as in Lindsey Graham will be the only Republican supporting it and he’ll probably crack under the pressure and ride the party line. Unlike opposition to Obamacare.

Also, comments 6 and 9 are indicative of exactly the problem. The holier-than-thous are responsible for yesterday. Feel proud of sitting at home and handing Democrats huge majorities yet? You sure sent the GOP a message, didn’t you? Don’t piss us off or we’ll stand aside and let the Democrats do more to us than you ever imagined, great!

    skwiself (b69230)

  27. AW, I swear I was on the “fire pelosi” site, ready to donate a decent $100 to the GOP last night, and I just couldn’t bring myself to do it because Steele has simply been irresponsible (though the GOP has made that par performance).

What value is Steele if he’s not vetting and organizing and spending his time promoting the GOP because he wants to? I don’t want to pay him to speak and go on book tours and become wealthy. That’s fine and dandy, but not for the chairman of the GOP in 2010.

  29. Of course it was no coincidence that tens of thousands of protesters were marching in support of illegal immigration on Saturday. In D.C.

I believe President Obama will play the race card and accuse those who resist the amnesty and inclusion of them into the health care family as xenophobic obstructionists and without compassion (IOW, the Party of No). It’ll be a massive emotional appeal. And it will work.

    Dana (1e5ad4)

  30. Actually, no, Dana, it won’t work. An immigration amnesty proposal of almost any kind will just further inflame independants.

It will just add pages to the Democrats longest suicide note.

    SPQR (26be8b)

  31. SPQR, I won’t jinx it by agreeing with you (trust me), but I hope you are right. The health care entitlement cost alone, of amnesty, would be insane (and I don’t think that would stop them).

These democrats, Obama, Pelosi, Rahm, Reid… they are not stupid people and they do not expect this to permanently reduce their electoral chances. Amnesty is the only way that makes sense to me.

    Dustin (b54cdc)

  32. Great, so the line in front of me will become even longer!

    dfbaskwill (e97ba1)

  33. I must disagree, SPQR.

Considering that a week before the bill’s passage, Homeland halted all work on the virtual fence – ironically happening just after the Hispanic Caucus and LaRaza voiced their indecision on the vote; and with that, the severe curtailing of border enforcement on our southern borders (according to Border Patrol officials, there is now 85% LESS activity taking place by officers per their directive from the powers that be), I don’t think it’s unduly pessimistic to realistically see this come full circle with amnesty a path to citizenship culminating in health coverage.

IOW, the illegals will provide votes and support to this president for the next election. Crunch the numbers: How many independents vs. how many illegals will support Obama next go ’round? Who does he need more?

    Dana (1e5ad4)

  34. Dana, any amnesty program would fail to actually enroll any significant numbers of new citizens before November 2012. Meanwhile, it would further drive independants away from Democrats.

It would be an absolutely disasterous strategy for Democrats.

    SPQR (26be8b)

  35. …and who are a grateful people going to support in an upcoming election: of course the President who showed *compassion* and made them legal. And gave them health care.

    Si se puede!

    Dana (1e5ad4)

  36. It would be an absolutely disasterous strategy for Democrats.

I thought the pursuit of nationalized health care would be a disastrous strategy for Dems, but there ya go.

I hope you’re right, SPQR, and perhaps you are feeling more optimistic than I am, but here in So Cal, where the illegals are firmly embedded in our population and the next natural step would seem to be amnesty. And there has never been a more sympathetic administration to their cause. Another thing to consider, is what was promised to the Hispanic Caucus and LaRaza to across the board support the HCR bill?

    Dana (1e5ad4)

  37. Let’s not forget that something changed as a result of the healthcare bill. Scott Brown took away the Senate’s ability to absolutely ram stuff through. It’s not a huge barrier. There are moderates in the Senate, including Brown, but the crowing that this establishes momentum to do more is simply wrong.

They have less now than they had in the past, which is why they had to use these strange procedural tactics. They must have some bipartisanship to pass Any New Legislation.

Amnesty is a good example of how they might get a few Grahams, but I honestly would not count on it. Graham can try his crap next year, and he knows it.

I think even McCain and Grahamnesty are peeved with “the other side of the aisle” at the moment. After all, they did not trust the Senate to put through a health care bill again.

I repeat my question (stupid as it may be). What can Obama do with an executive order between now and November to undermine the election process more than he and his already have? (Say, prevent the DOJ from investigating voting irregularities where La Rasa is working with Black Panthers to “ensure proper voting registration”.

I say we do the Iraqi thing and give people a purple finger, and absentees need to be verified with a thumbprint on the form- in fact, a thumbprint on who they are voting for.

This is a nasty can of worms. The IRS will hire 18,000 people to keep track of the no-insurance fines, cross referenced with the HHS Secy, and the new $700 million comprehensive health record computer system. In so far as illegals even file 1040 forms, I can’t imagine IRS wants anything to do with tracking immigration status. Enforcement will be sloppy because nobody likes to be called racist.

And what is wrong with being xenophobic?

    Michael Ejercito (526413)

  49. Wesson, one does not “prove” to the IRS that one is undocumented. Instead, what happens is that illegal aliens who wish to file tax returns obtain a “Taxpayer Identification Number” from the IRS and files under that. The IRS knows the source of these numbers means that the taxpayer is illegal and is only filing to obtain tax refunds of withheld wages, etc.
