  2. It’s worthy of noting that regardless of salary, there is NO shortage of Federal judge candidates. Unless/until there is difficulty in filling posts with qualified candidates, the market dictates that the judges are paid appropriately.

    I’m a believer in the market but I think there’s a difference between having competent judges and high quality judges. Many competent lawyers want the prestige of a judicial position and they would make competent judges, but there are fewer and fewer high quality lawyers/judges willing to take the job. Add that to the difficulty conservative judges face in getting confirmed to appellate and Supreme Court positions (i.e., Miguel Estrada) and the line gets even shorter. We’re lucky to have judges like John Roberts but I’m not sure there are many others like him.
