NOM (and Free Speech) Win

Citing fair use, YouTube has restored the video by the National Organization for Marriage that was challenged as copyright infringement by Perez Hilton. This is apparently the first time in YouTube’s history that YouTube has restored a video for fair use reasons before the expiration of the DMCA counternotice window. Ben Sheffner explains.

  1. When I search YouTube for NOM gathering storm, all I get are pages and pages of “parodies” and “responses”. Lots of cussing and hate crime accusations.

  3. I think YouTube is laying down a marker.

    It’s a losing proposition to let itself be a ping-pong ball between idealogical opponents.

    I think it’s made the judgment that to simply cave in and pull content everytime someone makes a claim of copyright infringement is only going to result in an avalanche of bogus claims.

    It’s purpose for being is to host video content. Allowing itself to be whipsawed is at odds with that purpose. I think it’s judgment is that it would rather defend and prevail against a few meritless claims in order to stem the flow.
