Your Daily Blago Links: Illinois AG Seeks Court Finding That Blago Is “Unfit”; Blago Chief of Staff Resigns

The Illinois Attorney General has filed a motion to declare Blago “unfit” for office. I understand the desire to get him out, but this seems to set a bad precedent and should not be an issue for the courts.

Meanwhile, Blago’s Chief of Staff has resigned. As for Obama’s putative chief of staff, Rahm Emanuel . . . he sure has been quiet lately.

    You could have preceded that comment with the words, “On the advice of counsel,”

    Obama seems to have lots of contact with Blago since the election, so it’s hard to believe the subject of the Senate seat never came up. Moreover, they’ve been politically very close for the better part of a decade. Assuming Blago didn’t just start acting this way recently, then, one could assume Fitzgerald has Blago issues he’s investigating going back some time, maybe years. If that’s so then Obama’s name becomes even more a part of the equation. Follow the money, Fitz!

  2. At most, an argument could be made that Blago’s authority should be suspended for a week or two, to give the Illinois Legislature time to pursue impeachment. But that’s all.

  4. Illinois Supreme Court Rule 382 only provides a procedure in the event of the disability of an Illinois governor (analogous to Section 3 of the 25th Amendment). It does not provide an alternative to impeachment.

  6. Kass of the Chicago Trib says Madigan filed the suite because she doesn’t want Blago to testify in a trial. She and her Dad are part of the machine and are vulnerable, and she wants to be governor.

    Jeez, this is like watching the Mafia. Do you suppose they’ve actually killed anybody yet?

  8. Tonight’s article says Illinois Attorney General Madigan’s motion impairs Illinois’ ability to pay its bills. I see 3 possibilities:

    1. If the Court rules in Madigan’s favor, Blagojevich will be removed and the Lt. Governor will take office and be authorized to act as chief executive.

    2. If the Court rules against Madigan’s motion, she can take the position Blagojevich is authorized to govern and she has a court order to prove it.

    3. The gray area is if the Court refuses to rule for any reason. Then Illinois has a Governor that the AG has said is not able to govern. It’s going to be difficult to undo that opinion and thus Illinois may not be able to pay its bills.

    Maybe Obama will offer some of his leftover campaign cash to help Illinois out.
