My Metaphor for the Medellin Case

Simon says: Follow *all* my instructions without regard to whether I say “Simon says.”

Now, ignore that instruction.

Simon says: ignore that instruction.

Touch your nose.

  1. My nose just fell off. What do I do with it?

  2. Patterico – It sounds like you are describing the Christophe theory of compliance with the Vienna BS – You have to comply but you don’t have to actively try to comply – Especially if sanctuary city policies prohibit law enforcement personnel from making relevant enquiries to this treaty.

  3. I live in a city where law enforcement cannot ask about citizenship.
They can easily advise people that “if” they are citizens of a foreign country then those citizens have rights…. blah blah blah.
    No inquiry needed.
Simple statement of facts, just like miranda.
    No presumptions.

Not that hard. But once again, if you strip this case of the asshole on whose behalf it was brought, resolution would take about 30 seconds.

This didn’t come through before, but consider it the OT antidote to “all hispanics are sucking the life out of us”

  4. I still think that the police should just print up a piece of paper informing them of all the consular nonsense and asking them to affirm their current citizenship under penalty of perjury, and once a week the friendly neighborhood ICE agent could come thumb through the files.

  5. Ow.

    My brain hurts now…

  6. Simon says: Follow *all* my instructions without regard to whether I say “Simon says.”
    OK.

    Now, ignore that instruction.
Back to only obeying “Simon says:” instructions.

    Simon says: ignore that instruction.
    “Simon says” requirement re-removed.

    Touch your nose.
    Done.

Can I poke Simon’s nose now?

  7. Simon says: Follow *all* my instructions without regard to whether I say “Simon says.”
    OK.

    Now, ignore that instruction.
Back to only obeying “Simon says:” instructions.

    Simon says: ignore that instruction.
    Which one?

Possibility #1: ignore the immediately previous instruction, which said to ignore the first instruction. This is the interpretation htom went with. Now the original instruction is back in force. Ignore “Simon says.”

Possibility #2: ignore the original instruction. You’re now playing according to traditional “Simon says” rules.

    Touch your nose.
    Depends.

  8. I like to look at the scene in “Raiders of the Lost Ark” when Indy is confronted by the scimitar-weilding thug in the market square, and his response, as the proper reaction to all “Simon Says” word-games (metaphorically speaking, of course).
