Rudy on Appointing Conservative Judges

The other day I suggested that it would be a good idea for Rudy Giuliani to more clearly commit to appointing judges with a conservative judicial philosophy. Well, apparently when I say “Jump,” Rudy says “How high?”:

As President, I will nominate strict constructionist judges with respect for the rule of law and a proven fidelity to the Constitution – judges in the mold of Justices Scalia, Thomas and Alito and Chief Justice Roberts.

Not bad. Not bad at all.

  7. BTW, I include the House in my previous comment as a means of exemplifying political pressure in general, not just limited to the Senate confirmation per se.

  9. Some people may be disappointed by this Giuliani quote but I’m not:

    “Abortion is not a litmus test. Roe v. Wade is not a litmus test. No particular case is a litmus test. That’s not the way to appoint Supreme Court justices or any judge,” Giuliani said.

    Unfortunately in today’s political atmosphere that’s the response you’ll get from any candidate, right or left. “Of course we’re not going to politicize the court!” It’s a sentence with words but no meaning.

    Andrew is wrong. It’s only ammunition for people who believe in a “living” constitution, i.e. judiciocracy. Those people aren’t going to vote for Rudy anyway.

  13. Giuliani is simply lying. The acid test of whether someone would nominate Scalias and Thomases is whether he would appoint justices who would overturn Roe v. Wade. But Giuliani has refused to say that Roe was wrongly decided, and in fact he said three months ago that there’s a constitutional right to have an abortion. http://www.youtube.com/watch?v=QZe1j4csMq8 Why is anyone buying this?

  14. Another thing I dread is finding out where Giuliani’s judicial appointees will stand on the Second Amendment. My guess is they’ll vote to repeal it, just like Giuliani would.

    Now, I actually followed the link, and Giuliani once again said he’d nominate “strict constructionists.” What else has he said about strict constructionists? Has he said anything specific about how they’d deal with the worst Supreme Court decision in the last hundred years?

    I can’t imagine any other candidate taking that long to answer the question or doing it so unconvincingly.

Based on nothing more than my paranoia: I believe Giuliani to be a Trojan horse for Hillary Clinton whose job is to hurt the other Republican candidates, by dirtying them up and taking the money that otherwise would go to them, and that in the event he gets the nomination he will throw the race to her just like he did in the New York Senate race.

  16. Out of the 75 judges Rudy appointed while mayor, 6 were Republicans (probably of the Bloomberg stripe at that). I guess we can all count on similar type of “constructionist appointments” when he becomes President. Can you say Souter kiddies?
