Is America ready for a Supreme Court justice who’s a goofy looking mormon who’s argued that the First Amendment protects religious polygamy, is my question.

If the first amendment protects polygamy, then that sort of makes hash of the “legalizing gay marriage will lead to legalizing polygamy” argument.

Note that I said “religious polygamy” – McConnell had things like the Mormon plural marriage in mind.

I had been thinking it was going to be Edith Clement, but I’ve had more qualms about her recently. I’m going out on a limb and saying Alice Batchelder.

Janice Rogers Brown would be very nice. It’d be great to see Patterico’s prediction come true, and watch the Democrats allow a white male conservative into the Supreme Court, and then watch them flounder as they try and find reasons to filibuster a black female.
